セウタ自治地域で、外国籍のストリートチルドレンを
本国送還するという宣言がなされました。

SOSトーチャー国際事務局は、スペインのセウタ自治地域における下記の状況に関して皆様の緊急の働きかけをお願いします。
SOSトーチャー国際事務局は信頼できる消息筋から、セウタの新任の社会福祉カウンセラー、モハメド・チャイブさんが、セウタ自治地域が面倒をみている外国人の子どもたちに関する宣言を発表し、L. V. モロ政府代表もそれを支持したという情報を入手しました。
入手した情報によると、2001年2月23日、モハメド・チャイブさんは地方紙（「エル・ファロ・デ・セウタ」）に、サン・アントニオ・センターを閉鎖して子どもたちを本国に送還し、その家族かおそらくはモロッコのNGOが運営しているセンターに引き渡すつもりであると発表しました。彼は、セウタで路上生活をしている外国人の子どもたちは“社会に統合されるのをきらい、盗癖をもっている”とも述べたと言われています。
後に、セウタのモロ政府代表は報道関係者に対し、カウンセラーを支持し、「新しい哲学の共有が生まれた」と宣言したと言われています。
国際事務局は上記の宣言に対する不支持を表明します。これらの宣言はスペインの法律、とくに子どもを保護するための法律に反していると考えます。これらの宣言は子どもの権利条約にも反しています。同条約は第2条において次のように規定しています：「締約国は、その管轄の下にある子どもに対し、子どもまたはその父母もしくは法的保護者の人種、皮膚の色、（…）、国民的、種族的もしくは社会的出身、財産、（…）にかかわらず、いかなる差別もなしにこの条約の定める権利を尊重し、および確保する。」
国際事務局はこうした状況、とくにすべてのストリートチルドレンの心身の安全について重大な懸念を表明するとともに、スペイン政府に対し、子どもの権利条約にしたがって、国民的出身、人種または社会的地位を理由とするいかなる差別もなく、セウタのストリートチルドレンを他のスペインの子どもたちと同様保護することを求めます。
SOSトーチャー国際事務局は信頼できる消息筋から、セウタにおいてモロッコ人のストリートチルドレンが逮捕、拘禁、そしていくつかの場合には拷問と虐待を受けているという情報を入手しました。
情報によると、セウタのストリートチルドレンは市の中心でしばしば警察のワゴン車で連行されています。彼／彼女らは拘禁されていやがらせを受け、なかには警察官からだけでなく、原理主義的な性格を持ったソーシャル・ワーカーの組織であるVIAS（イスラム社会活動ボランティア）センターを運営する指導員たちからも虐待を受けている子どもたちもいると言われています。
未成年者の逮捕と不法な追放を確認する告発が行われています。たとえば、1998年10月5日にセウタ市の警察官のグループが行ったものがあります。この告発では、警察官たちが、子どもたちが通訳の補助をもたず、そのため司法的な支援を得られないという理由でスペイン領から追放されたと述べています。
スペイン関係当局に対し、以下のことを要請して下さい。
1. セウタにおけるすべてのストリートチルドレンの心身の安全を保障すること。
2. ストリートチルドレンを保護、教育、リハビリして社会に再統合するために必要なあらゆる措置を講じ、彼／彼女らの犯罪者扱いと本国送還をやめること。
3. すべてのストリートチルドレン、特にモロッコ人の子どもたちに対する迫害といやがらせをただちにやめること。
4. 国内法および国際人権基準、とくに子どもの権利条約と拷問等禁止条約に従い、同国全体において人権と基本的自由の尊重を保障すること。

CHILD CONCERN
The International Secretariat of OMCT requests your urgent intervention to the following situation of the autonomous community of Ceuta in Spain.
New information
The International Secretariat of OMCT was informed by reliable sources of declarations allegedly released by Mr Mohamed Chaib, new Counsellor of Social Welfare (Consejero de Bienestar Social) in Ceuta, subsequently backed by the Government Delegate, Mr L.V. Moro, on the situation of foreign children being attended to by the autonomous community of Ceuta.
According to the information received, on 23 February 2001, Mr Mohamed Chaib declared to a local newspaper (El Faro de Ceuta) that he intends to close down the San Antonio Centre and repatriate the children and hand them over to their families or to centres supposedly run by NGOs in Morocco. He also allegedly declared that the foreign children who are homeless in Ceuta "are not willing to integrate and are thievish".
Subsequently, Mr Moro, Delegate of the Government in Ceuta, allegedly declared to the press that he supports the counsellor and that "a new shared philosophy is born".
The International Secretariat of OMCT expresses its disapproval on the above-mentioned declarations and considers them contrary to the Spanish legislation, especially that which protects children. They are also contrary to the Convention on the Rights of the Child, which sets in article 2 that: "States Parties shall respect and ensure the rights set forth in the present Convention to each child within their jurisdiction without discrimination of any kind, irrespective of the child's (.) race, colour, (.) national, ethnic or social origin,(or) property (.)".
The International Secretariat of OMCT expresses its grave concern about the situation, and particularly about the physical and psychological safety and integrity of all street children and calls on the Spanish Government to protect the street children in Ceuta as any other Spanish child, without any discrimination on the ground of national origin, race or social status, in accordance with the Convention on the Rights of the Child.
Brief remainder of the situation
The International Secretariat of OMCT was informed by reliable sources of the arrest, detention and in some cases, the alleged torture and ill-treatment of several street children of Moroccan origin, in Ceuta.
The information reported that in Ceuta street children are often picked-up in police wagons in the city centre. They are allegedly harassed in detention and some of them ill-treated not only by police officers but also by the educators who run the centres of VIAS (Islamic Volunteers of Social Action), an institution of social workers allegedly with a fundamentalist character.
Denunciations exist confirming the arrest and illegal expulsion of minors. For example on 5 October 1998, a group of police officers of the city of Ceuta, acknowledged that minors were expelled from the national territory for the reason that they did not have the assistance of an interpreter and therefore no judicial assistance.
Action requested:
Please write to the authorities in Spain urging them to:
i. guaranteethe safety, the physical and psychological integrity of all street children in Ceuta;
ii. takeall necessary measures to protect, educate, rehabilitate and reintegrate street children and to impede their criminalisation and repatriation;
iii. put an immediate end to the persecution and harassment of all street children, and especially those of Moroccan origin;
iv. guaranteethe respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards and in particularly the Convention on the Rights of the Child and the Convention against Torture.
