貧困撲滅活動をしているNGOの職員が襲撃されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、エチオピアにおける下記の状況に関して皆様の働きかけをお願いします。 

<事件の概要>

 人権擁護家のための監視機構は信頼できる情報筋より、貧困撲滅活動をしている国際NGO、アクションエイド・エチオピアの政策・研究・擁護部長のダニエル・ベケレさんがアジスアベバ市内のアジス・ゲベヤ(アジス市場)で襲撃されたという情報を入手しました。

 入手した情報によると、2005年10月16日午後8時頃、ダニエル・ベケレさんは自家用車の車内で、見知らぬ2人の武装した男に襲われました。車で友人を送り届けたベケレさんが車を発進させようとしたところ、2人の男が銃口を突きつけて停車させ、車のドアを開けました。男の1人が「EPRDF(与党のエチオピア人民革命民主戦線)を批判するお前は何様だ?」と言い、もう1人とともに銃のハンドルでベケレさんの目や頭を殴打しました。

 すぐさま、ベケレさんは車のクラクションを鳴らすことができたので襲撃者は逃げていき、数人が助けにやってきました。ベケレさんは最寄の警察に被害届けを出し、アクションエイド・エチオピアは連邦警察委員会に訴えを提出しました。しかし今のところ調査は始まっていません。

 監視機構はダニエル・ベケレさんに対する襲撃を強く非難し、これは2005年5月15日に行われた選挙を監視した「エチオピアNGO執行委員会」やその他の市民運動に彼が関わっていることに関連があると考えています。ベケレさんは、選挙手続き中に起きた不正について意見を発表しています。

 監視機構はこの事件が1998年12月9日に国連総会が採択した「人権擁護家保護のための宣言」の全条文、とりわけ、第6条(c)「すべての者は、個々にまた他の者と共同して、すべての人権と基本的自由の法と実践の両面における遵守について研究し、討論し、意見を形成、保持する権利を有する。またこれら、あるいは他の適切な手段を通じて、それらの問題に対する一般の関心を喚起する権利を有する」と、「国家は、この宣言に掲げられた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するための、すべての必要な措置をとるべきである」とした第12.2条に甚だしく違反していると考えます。

<行動要請>

 エチオピア関係当局に以下の内容の要請をお願いします。

  1. いかなる情況にあろうとも、ダニエル・ベケレさんおよびエチオピアのすべての人権擁護家の心身の安全を保障すること。
  2. ダニエル・ベケレさんおよびエチオピアのすべての人権擁護家に対するあらゆる形態の嫌がらせを止めること。
  3. 犯人を特定し、裁判に付し、罪の重さに応じた判決を言い渡すために、公正、中立で独立した調査を実施すること。
  4. 1998年12月8日、国連総会が採択した人権擁護家の宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と上記6(c)条および12.2条に従うこと。
  5. さらには、世界人権宣言の条文と、エチオピアが批准したその他の国際人権文書に従うこと。

I was disturbed at the news of the attack on Mr. Daniel Bekele of Acionaid Ethiopia on October 16, 2005. I would like to urge you the followings:

  1. To ensure under all circumstances the physical and psychological integrity of Mr. Daniel Bekele, and of all human rights defenders in Ethiopia;
  2. To put an end to any form of harassment against Mr. Daniel Bekele, and all human rights defenders in Ethiopia;
  3. To conduct a fair, impartial and independent inquiry into these events, in order to identify the perpetrators, bring them to justice and pronounce sentences proportional to the gravity of their crime;
  4. To conform with the provisions of the Declaration on Human Rights Defenders, adopted by the United Nations General Assembly on December 9, 1998, in particular article 1 which provides that "everyone has the right, individually or in association with others, to promote and to strive for the protection and the realization of human rights and fundamental freedoms at the national and international level," which provides that "everyone has the right, individually or in association with others, to study, discuss, form and hold opinions on the observance, both in law and in practice, of all human rights and fundamental freedoms and, through these and other appropriate means, to draw public attention to those matters", and article 12.2 which stipulates that "the State shall take any necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure, adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
  5. To conform with the provisions of the Universal Human Rights Declaration and other international instruments ratified by Ethiopia.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Ethiopia:

Brief description of the situation:

The Observatory has been informed by a reliable source of the attack perpetrated against Mr. Daniel Bekele, Policy, Research and Advocacy Manager for Actionaid Ethiopia, an international NGO dedicated to the fight against poverty, in Addisu Gebeya (Addis Market), in the city of Addis Ababa.

According to the information received, on October 16, 2005, at around 8:00 pm, Mr. Daniel Bekele was attacked in his car by two unknown armed men. Mr. Bekele was just starting his car after having dropped a friend, when the two assaulters stopped him at the gun point and opened his door. One of the men told him "who are you to criticize EPRDF [Ethiopian People's Revolutionary Democratic Front - ruling party]?“, before hitting him on the eyes and the head, helped by the other man, with the handle of their pistols.

After a moment, Mr. Bekele succeeded in blowing the horn of his car, and the assaulters ran away, while some people came to help him. Mr. Bekele lodged a complaint to the nearest police station, and Actionaid Ethiopia lodged a complaint to the Federal Police Commission. To this date, no investigation has been launched yet.

The Observatory strongly condemns this attack against Mr. Daniel Bekele, and believes it is linked with his activities as member of Executive Committee of the Network of Ethiopian NGOs and other civil society organisations, which monitored May 15, 2005 elections. In this regard, Mr. Bekele had publicly expressed his opinion on irregularities during the electoral process.

The Observatory notes that these facts are blatantly violating the provisions of the Declaration on Human Rights Defenders, adopted by the United Nations General Assembly on December 9, 1998, in particular article 6(c) which provides that "everyone has the right, individually or in association with others, to study, discuss, form and hold opinions on the observance, both in law and in practice, of all human rights and fundamental freedoms and, through these and other appropriate means, to draw public attention to those matters", and article 12.2 which stipulates that "the State shall take any necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure, adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration".

Action requested:
