野党副党首が拘束され拷問されました。

 SOSトーチャー国際事務局は、アゼルバイジャンにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局はSOSトーチャーネットワークメンバーであるアゼルバイジャン人権センターより、元ギャンジャ警察部長で、現在は野党の民主党副党首のナティク・エフェンディエフさんが拷問され、現在バク市内の病院に入院しているという情報を入手しました。

 情報によると、エフェンディエフさんは2005年10月17日にクーデターを計画した容疑で拘禁されました。これはラスル・グリエフさんと親しいことが理由でもあると言われています。彼は殴打され、電気ショックを与えられたということです。彼は内務省の組織犯罪課で拘禁されました。彼の妻によれば、弁護士が接見した時、彼は面会中に何度も失神し、ほとんど話すことができなかったということです。その上、彼の予審は法律にのっとった裁判所ではなく、組織犯罪課で裁かれました。

 エフェンディエフさんは元政治囚で、2004年に大統領恩赦を受けています。彼は10月17日に、アゼルバイジャン民主党党員であり、やはり2004年に大統領恩赦を受けた元政治囚のエティバール・グリエフさんとともに逮捕されました。

 アゼルバイジャン民主党党首のラスル・グリエフさんは横領で起訴されましたが、この起訴は政治的動機によるものと思われます。グリエフさんは数年間米国で暮らしており、大統領選に出馬するために帰国すると宣言しました。検事長は、彼が帰国したらすぐに逮捕し、収監すると言明していました。(エルダール・サラエフさんの逮捕に関連するAZE031105参照)

<行動要請>

 アゼルバイジャン関係当局に以下の内容の要請をお願いします。

  • ナティク・エフェンディエフさんとエティバール・グリエフさんの心身の安全の保障に必要なすべての措置をとること。
  • 正当な起訴理由が不在の中、ナティク・エフェンディエフさんとエティバール・グリエフさんの即時釈放を命じること。そのような理由が存在するなら、彼らを迅速で公正な裁判に付し、その間、彼らの手続き上の権利を保障すること。
  • 責任者を特定し、裁判に付し、法律の規定に基づき刑事罰あるいは行政罰を適用できるよう、これら事件、とりわけ拷問の報告について、綿密で公平な調査を命じること。
  • 国際人権基準に沿って、国内全体において人権尊重と基本的自由を保障すること。

Dear President Aliyev,

I would like to express my concern over the report of torture that Mr. Natik Efendiyev, currently the deputy chairman of the opposition Democratic Party, has been subjected to after he was detained on October 17, 2005.

I would like to urge you the following:

  1. To take all necessary measures to guarantee the physical and psychological integrity of Mr. Mr. Natik Efendiyev and Mr. Etibar Guliyev;
  2. To order the immediate release of Mr. Natik Efendiyev and Mr. Etibar Guliyev in the absence of valid legal charges, and if such charges exist, to ensure that they are given a prompt and fair trial, in which their procedural rights are guaranteed at all times;
  3. To order a thorough and impartial investigation into the circumstances of these events, in particular the reports of torture, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
  4. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with international human rights standards.

Arbitrary arrest and detention / Torture

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Azerbaijan.

Brief description of the situation

The International Secretariat of OMCT has been informed by the Human Rights Centre of Azerbaijan, a member of the OMCT network, that Mr. Natik Efendiyev, former head of the police department of Gyandja, and currently the deputy chairman of the opposition Democratic Party, has been tortured and is currently in hospital in Baku.

According to the information received, Mr. Efendiyev was detained on 17th October 2005, on charges of plotting a coup d'etat, and reportedly due to his close relationship to Mr. Rasul Guliyev. He reportedly was beaten and electrocuted. He was held at the organised crime unit of the Interior Ministry. His wife stated that when his lawyer went to visit Mr. Efendiyev, he repeatedly fainted during the meeting and could hardly speak. Furthermore, Mr. Efendiyev's case has been preliminary tried in the Department of Organised Crimes, instead of in court as required by the law.

Mr. Efendiyev is a former political prisoner and received a pardon from the president in 2004. He was arrested on 17th October, along with Mr. Etibar Guliyev, also a member of the Azerbaijan Democratic Party, and previously a political prisoner pardoned by the president in 2004.

Mr. Rasul Guliyev, leader of the Democratic Party of Azerbaijan, has been accused of embezzlement, charges which seem to be politically motivated. Mr. Guliyev has been living in the United States for several years and declared that he would return to Azerbaijan to run in the presidential elections. The prosecutor-general had said that he would be immediately arrested and jailed if he returned to Azerbaijan. (See also Case AZE 031105 relating to the arrest of Prof. Eldar Salayev)

Action requested:

Please write to the authorities in Azerbaijan urging them to:

  1. Take all necessary measures to guarantee the physical and psychological integrity of Mr. Mr. Natik Efendiyev and Mr. Etibar Guliyev;
  2. Order the immediate release of Mr. Natik Efendiyev and Mr. Etibar Guliyev in the absence of valid legal charges, and if such charges exist, to ensure that they are given a prompt and fair trial, in which their procedural rights are guaranteed at all times;
  3. Order a thorough and impartial investigation into the circumstances of these events, in particular the reports of torture, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
