2004年にメーデー集会参加のために逮捕された労働組合員が非合法組織との関係を理由に恣意的に有罪判決を受けました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、イランにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<新情報>

 人権擁護家のための監視機構は国際自由労連(ICFTU)より、サッケズ革命裁判所が労働組合員5人に有罪判決を出し、2人を無罪にしたという情報を入手しました。

 入手した情報によると、2005年11月9日、「労働組合設立のための組織委員会」スポークスマンで「サッケズ・ベーカリー労働者組合」元委員長、「労働者団体結成のための調整委員会」共同設立者であるマフムード・サレヒさんが禁固5年とゴーヴェー市への追放3年の判決を受け、「サッケズ市ベーカリー労働者協会」メンバーのジャラル・ホセイニさんが禁固3年の判決を受けました。「サッケズ・ベーカリー労働者組合」メンバーのハディ・タノマンドさんとエスマイル・コードカムさんは無罪となりました。

 同じ日、もしくは翌日以降にサッケズ革命裁判所は、「イラン作家協会」会員のモフセン・ハキミさんと「サッケズ・ベーカリー労働者組合」組合員のボルハン・ディヴァンガールさんとモハマド・アブディプールさんに禁固2年の有罪判決を出しました。

 この7人は2004年のメーデーの平和的な行事に参加したために逮捕された後釈放され、その後「禁じられている政治組織「コマラ」との関連」で起訴されていました。(背景情報参照)

 マフムード・サレヒさんは違法組織「コマラ」との関連での起訴では無罪となりました。しかし彼は、国家治安に対する犯罪を謀議するために集まると禁固2年から5年の罪と規定するイスラム処罰法第610条により有罪となりました。

 監視機構は、サレヒさん、ホセイニさん、ハキミさん、ディヴァンガールさん、アブディプールさんが最初2004年5月のメーデーの記念行事への参加に関連して逮捕され、その後すぐに起訴されたことから、労働組合活動のみを理由として有罪になったのではないかと危惧します。その上、サレヒさんの審理では検察が、彼が2004年4月にICFTUの訪問団と会合したことも含めた労働組合活動を挙げて非難しました。

 監視機構はサレヒさん、ホセイニさん、ハキミさん、ディヴァンガールさん、アブディプールさんの有罪判決を深く懸念し、これは1998年12月9日に国連総会が採択した「人権擁護家保護のための宣言」の全条文、とりわけ、「すべての人びとは、不当な遅滞なく不服申し立てについての決定を提出するべき国内の権限ある司法、行政、あるいは不法当局、もしくは国家の司法制度によって規定された権限あるほかのあらゆる当局に対し、請願あるいはその他の適切な方法により、人権と基本的自由の侵害に関する公務員個人や政府機関による政策あるいは行動について不服申し立てを行なう権利を有する」とした9条3(a)項に甚だしく違反していると考えます。

 監視機構は、その後サレヒさん、ホセイニさん、ハキミさん、ディヴァンガールさん、アブディプールさんが逮捕され拘禁されたかどうか現時点では分かりません。

<背景情報>

 2005年8月4日、マフムード・サレヒさんが、イランのクルド州サッケズ市で行われたデモに参加したとして逮捕され1時間拘禁されました。2005年7月9日にクルド人の反政府活動家がイランの治安部隊にマハバード市で殺害される事件が起き、クルド人の多いサナンダジ、マハバード、サルダシュト、ピランシャフル、オシュナヴィエ、バネー、シンネ、ボカン、サッケズといった近隣地域でデモが発生しました。デモは国の治安部隊や特別機動隊と衝突し、クルド人の人権活動家を含む数百人のデモ参加者が逮捕されました。サレヒさんは釈放される前に、サッケズでのデモやストに参加しないように、と警告されました。

 2005年8月7日午前2時、イラン治安部隊がボルハン・ディヴァンガールさんの自宅を強制捜査しました。ディヴァンガールさんは逮捕され、コンピューターなどが押収されました。彼はその日のうちに、「自由な労働団体設立のフォローアップのための委員会」への参加、最近結成された失業者の団体への参加、Tashakolというウェブサイトの運営、サッケズ市でのデモへの参加などを理由に起訴されました。

<行動要請>

 イラン関係当局に以下の内容の要請をお願いします。

  1. いかなる情況にあろうとも、サレヒさん、ホセイニさん、ハキミさん、ディヴァンガールさん、アブディプールさん、タノマンドさん、コードカムさんおよびイランのすべての人権擁護家の心身の安全を保障すること。
  2. ディヴァンガールさん、サレヒさん、ハキミさん、ホセイニさん、ディヴァンガールさんの有罪判決をくつがえすよう保障すること。
  3. 2005年8月7日の逮捕におけるディヴァンガールさんに対する容疑はすべて恣意的なため、それらを取り下げるよう保障すること。
  4. 国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条、上記第9条3(a)項、そして「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を遵守すること。
  5. いかなる情況にあろうとも、国際人権基準およびイランが批准した国際人権文書に従って、人権尊重と基本的自由を保障すること。

To comply with the provisions of the Declaration on Human Rights Defenders, in particular its article 1, which states that "everyone has the right, individually or in association with others, to promote the protection and realisation of human rights and fundamental freedoms at the national and international levels", and article 9.3(a), which provides that everyone has the right "to complain about the policies and actions of individual officials and governmental bodies with regard to violations of human rights and fundamental freedoms, by petition or other appropriate means, to competent domestic judicial, administrative or legislative authorities or any other competent authority provided for by the legal system of the State, which should render their decision on the complaint without undue delay," and article 12.2, which states that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
  5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Iran.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information on the following situation in Iran and requests your urgent intervention:

New information:

The Observatory has been informed by the International Confederation of Free Trade Unions (ICFTU) about the condemnation of five trade unionists and the acquittal of two others by the Saqez Revolutionary Court.

According to the information received, on November 9, 2005 Mr. Mahmoud Salehi, Spokesman for the Organisational Committee to Establish Trade Unions, former President of the Saqez Bakery Workers' Union, and co-founder of the Coordinating Committee to Form Workers' Organisations, was sentenced to five years imprisonment and three years in exile in the city of Ghorveh, and Mr. Jalal Hosseini, a member of the Bakery Workers' Association of the city of Saqez, to three years imprisonment. Mr. Hadi Tanomand and Mr. Esmail Khodkam, two other members of the Saqez Bakery Workers' Union, were acquitted.

On the same day or in the following days, the Saqez Revolutionary Court has also sentenced Mr. Mohsen Hakimi, member of the Iranian Writers' Association, Mr. Borhan Divangar and Mr. Mohammad Abdipoor, members of the Saqez Bakery Workers' Union, to two years of imprisonment.

All seven were arrested and further released after having participated in peaceful May Day 2004 celebrations and subsequently charged with "association with the banned political association Komala" (see background information)

Mr. Mahmoud Salehi was reportedly found not guilty with regards to the charges pertaining to association with the banned association Komala. Despite this fact, he was sentenced according to article 610 of the Islamic Punishment Act, prescribing penalties from two to five years of imprisonment for congregating to conspire to commit crimes against national security.

The Observatory fears that Mr. Salehi, Mr. Hosseini, Mr. Hakimi, Mr. Divangar, and Mr. Abdipoor were sentenced for their sole trade union activities, especially given the fact that the initial arrests were made in connection with their participation in May Day 2004 celebrations and that charges against them were made shortly thereafter. Furthermore, during the court hearings against Mr. Salehi, his trade union activities were held against him by the prosecutor, including a meeting he had with an ICFTU delegation in April 2004.

The Observatory is deeply concerned about this condemnation of Mr. Salehi, Mr. Hosseini, Mr. Hakimi, Mr. Divangar, and Mr. Abdipoor, and considers that this blatantly violates the provisions of the Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, in particular article 9.3(a), which provides that everyone has the right "to complain about the policies and actions of individual officials and governmental bodies with regard to violations of human rights and fundamental freedoms, by petition or other appropriate means, to competent domestic judicial, administrative or legislative authorities or any other competent authority provided for by the legal system of the State, which should render their decision on the complaint without undue delay".

As of the time of writing, the Observatory does not know whether Mr. Mahmoud Salehi, Mr. Jalal Hosseini, Mr. Mohsen Hakimi, Mr. Borhan Divangar, and Mr. Mohammad Abdipoor have since then been arrested and put in detention.

Background information:

On August 4, 2005, Mr. Mahmoud Salehi was arrested for one hour for participating in demonstrations in Saqez, in the Kurdish province of Iran. Indeed, following the killing on July 9, 2005, of a Kurdish opposition activist by Iranian security forces, in the town of Mahabad, demonstrations had erupted in the mainly Kurdish neighbouring towns of Sanandaj, Mahabad, Sardasht, Piranshahr, Oshnavieh, Baneh, Sinne, Bokan and Saqez. Hundreds of demonstrators were arrested subsequent to clashes with the state security forces and special anti-riots units, including Kurdish human rights defenders. Before his release, Mr. Mahmoud Salehi was warned against participating in any demonstrations and strikes in Saqez.

Moreover, on August 7, 2005, at 2 am, the Iranian security forces raided the home of Mr. Borhan Divangar. The latter was then arrested and his computer and other belongings were seized. Later that day he was charged, among other things, with membership of the "Committee to Follow up the Establishment of Free Labour Organisations", membership of the newly formed unemployed workers' organisation, managing a labour website in Iran called Tashakol (www.tashakol.com), and with participating in the demonstrations in Saqez.

Actions requested:

Please write to the Iranian authorities and ask them to:

  1. Guarantee under all circumstances the physical and psychological integrity of Mr. Borhan Divangar, Mr. Mahmoud Salehi, Mr. Mohsen Hakimi, Mr. Jalal Hosseini, Mr. Mohammad Abdippoor, Mr. Esmail Khodkam, and Mr. Hadi Tanomand, and all human rights defenders in Iran;
  2. Ensure that the conviction of Mr. Borhan Divangar, Mr. Mahmoud Salehi, Mr. Mohsen Hakimi, Mr. Jalal Hosseini, and Mr. Mohammad Abdippoor be overturned;
  3. Ensure that all charges against Mr. Borhan Divangar in connection with his arrest on August 7, 2005 be dropped, as they are arbitrary;
  4. Comply with the provisions of the Declaration on Human Rights Defenders, in particular its article 1, which states that "everyone has the right, individually or in association with others, to promote the protection and realisation of human rights and fundamental freedoms at the national and international levels", and the above-mentioned articles 9.3(a) and article 12.2, which states that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
  5. Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Iran.
