「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、イスラエルにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

人権擁護家のための監視機構はパレスチナのNGO「アル・ハク（Al-Haq）」より、同NGOのフィールドワーカーのジヤド・ムハマド・シェハデー・フメイダンさんに対する行政拘禁命令が延長されたという情報を入手しました。
入手した情報によると、フメイダンさんの行政拘禁は2005年11月23日に終了することになっていました。しかしイスラエル当局は2005年11月14日に、行政拘禁を更新し、さらに6ヶ月延長するとフメイダンさんに通告しました。手続き的には、今週中に更新命令の審理が行われなければなりません。
監視機構は、フメイダンさんが2005年5月23日の逮捕以来、正式に起訴されず、拘禁の理由も告げられていないことを想起します。
これらの措置はイスラエルが当事国である「市民的及び政治的権利に関する国際規約(ICCPR)」の第9条「逮捕される者は、逮捕の時にその理由を告げられるものとし、自己に対する被疑事実を速やかに告げられる。」に甚だしく違反しています。また、1998年12月9日に国連総会が採択した「人権擁護活動家保護のための宣言」が保障する「すべての人は、個々にまた他の人と共同して、国内、国際レベルにおいて人権および基本的自由の保護ならびに実現を伸長、奨励する権利を有する（第1条）」にも反しています。監視機構は、フメイダンさんは占領地(OPT)のベツレヘム地域における国際人権法と国際人道法の違反を監視し、記録する活動のために拘禁されたのではないかと危惧しています。
＜背景情報＞
ジヤド・ムハマド・シェハデー・フメイダンさんは2005年5月23日午後4時30分頃、ラマラとエルサレムの間にある検問所カランディヤを通ろうとして逮捕されました。イスラエル兵士が彼のID番号をコンピューターに打ち込み、彼を脇に連れていき、手錠をかけました。逮捕後数日間、彼の行方は分かりませんでした。彼は5月27日からエルサレムのモスコビヤ拘禁センター（別名「ロシアン・コンパウンド」）で拘禁されました。
フメイダンさんはエルサレムにあるモスコビヤ拘禁センターの軍事裁判所に5月31日に出廷する予定でしたが、イスラエル当局がそれを1日早め、2005年5月30日に審理が開かれました。その日、裁判官はフメイダンさんを尋問のためにさらに18日間拘禁することを命令しました。彼は起訴されませんでしたが、イスラエル情報機関幹部は彼についてのファイルがあることをほのめかし、「秘密の証拠」に関する議論が行われているようでした。2005年6月2日に弁護士がモスコビヤを訪問してフメイダンさんに面会しようとしましたが、会わせてもらえませんでした。
2005年5月30日には、1970年制定の軍規則378に基づき「弁護士面会禁止令」が出され、フメイダンさんは2005年5月30日から6月5日までの8日間、弁護士との面会を禁じられました。この禁止令やその後の行政拘禁は、治安を理由にして正当化されましたが、その具体的な理由はフメイダンさんにも弁護士にも明らかにされませんでした。彼は、この期間後には弁護士に面会できるようになったということです。
フメイダンさんの拘禁期日が終了した2005年6月16日に、モスコビヤ軍事裁判所で審理が開かれました。審理中、検察はイスラエル当局が彼についての「秘密のファイル」もしくは機密扱いの情報があると言いました。それを根拠に裁判官は6ヶ月の行政拘禁の判決を出しましたが、正式な起訴もなく、この拘禁の根拠となる証拠も弁護士に示されませんでした。
2005年6月28日のフメイダンさんの審理中、軍事法廷の裁判官が軍副司令官が出した6ヶ月の行政拘禁の判決を確認しました。この裁判官は、これまでの拘禁期間も刑に算入するよう定めました。
フメイダンさんは2005年7月3日に占領地(OPT)の外のネゲブ砂漠にあるアンサル第3拘禁センターに移されました。
＜行動要請＞
イスラエル関係当局に以下の内容の要請をお願いします。
- ジヤド・ムハマド・シェハデー・フメイダンさんの心身の安全を保障すること。とりわけ、フメイダンさんが拷問あるいはその他の残虐で非人間的で品位を貶めるような処遇あるいは処罰を受けないよう保障すること。
- フメイダンさんの拘束は恣意的なため、即時無条件の釈放を命じること。
- 国連人権擁護家に関する宣言の条文、とりわけ、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項と、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第１条に従うこと。
- いかなる情況にあろうとも、市民的及び政治的権利に関する国際規約と拷問及び他の残虐な、非人道的な又は品位を傷つける取り扱い又は、刑罰に関する条約を含め、イスラエルが批准した国際人権文書に従って、国内およびパレスチナ占領地区全体で人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the continued detention of Mr. Ziyad Muhammad Shehadeh Hmeidan, a field-worker of the Al-Haq. I would like to urge you the followings:
- To guarantee the physical and psychological integrity of Mr. Ziyad Muhammad Shehadeh Hmeidan, and in particular ensure that Mr. Hmeidan is not subjected to torture or other cruel, inhuman or degrading treatment or punishment;
- To order the immediate and unconditional release of Mr. Hmeidan, since his detention is arbitrary;
- To comply with the provisions of the UN Declaration on Human Rights Defenders, in particular article 12(2), which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration" and article 1, which provides every person's right "to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels" ;
- More generally, to ensure in all circumstances the respect for human rights and fundamental freedoms throughout the country and the Occupied Palestinian Territories in accordance with international human rights instruments ratified by Israel, including the International Covenant on Civil and Political Rights and the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

URGENT APPEAL - THE OBSERVATORY
The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information and requests your urgent intervention in the following situation in Israel.
New information:
The Observatory has been informed by Al-Haq, a Palestinian human rights NGO, about the renewal of the administrative detention order of Mr. Ziyad Muhammad Shehadeh Hmeidan, one of its fieldworkers.
According to the information received, Mr. Ziyad Hmeidan's administrative detention was due to be completed on November 23, 2005. Nevertheless, on November 14, 2005, the Israeli authorities informed him that they were renewing his administrative detention order for another six months. In terms of procedure, a review of the renewal order should take place this week.
The Observatory recalls that since his arrest in May 23, 2005, no formal charges have been brought against Mr. Hmeidan, nor has he been informed of the reasons for his detention.
The Observatory considers that these measures are in flagrant violation of article 9 of the International Covenant on Civil and Political Rights, to which Israel is party, which states, in particular, that "anyone who is arrested shall be informed, at the time of arrest, of the reasons of his arrest and shall be promptly informed of any charges against him". They also contravene the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly on December 9, 1998, which guarantees every person's right "to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels" (article 1). Indeed, the Observatory fears that Mr. Hmeidan is detained due to his monitoring and documenting of violations of international human rights and humanitarian law in the Bethlehem area of the Occupied Palestinian Territories.
Background information:
Mr. Ziyad Muhammad Shehadeh Hmeidan was arrested on May 23, 2005, while he was trying to cross through Qalandiya, a checkpoint between Ramallah and Jerusalem. The Israeli soldiers entered his ID number into their computer, pulled him aside and placed handcuffs on him. His whereabouts remained unknown for a few days after he was put under arrest. Since May 27, 2005, Mr. Hmeidan had been kept at the Moscobiyya detention centre, in Jerusalem (also known as the Russian Compound).
Mr. Hmeidan was due to appear before a military court of the Moscobiyya detention centre on May 31, 2005. However, the hearing was brought forward by the Israeli authorities to May 30, 2005. On that date, the judge ordered that Mr. Hmeidan be held for another 18 days for investigation. No charges were filed against him, but Israeli security officials indicated that there was a file on him, and there seemed to be discussions of "secret evidence". On June 2, 2005, a lawyer tried to visit Mr. Hmeidan in Moscobiyya, but he was denied access.
On May, 30, 2005, an "Order Prohibiting Meeting with Counsel" was issued in his case, stating that Mr. Hmeidan was banned from meeting with legal counsel for eight days, starting on May, 30, 2005, and ending on June 5, 2005, on the basis of Military Order 378 of 1970. This order, and his subsequent administrative detention, were justified by security reasons, which have not been disclosed neither to Mr. Hmeidan nor to his legal counsel. According to the information received, Mr. Hmeidan was able to meet with his lawyer after this period of time.
On June 16, 2005, Mr. Hmeidan had a hearing before the Moscobiya Military Court, as his detention period was due to expire that day. During the hearing, the prosecutor referenced that the Israeli authorities have a "secret file" of classified information about him. On this basis the judge then decided to issue a six-month administrative detention order for an indefinitely renewable period of six months, although no formal charges were brought against him, nor has the evidence supporting his detention made available to his lawyer.
On June 28, 2005, during the hearing of Mr. Hmeidan, the judge of the military court confirmed the six month administrative detention order that had been issued by the Deputy Military Commander. The judge stipulated that the time already spent in detention was to be included in the detention period.
On July 3, 2005, Mr. Hmeidan was transferred to the Ansar III Detention Centre located in the Naqab (Negev) Desert, outside the Occupied Palestinian Territories.
Actions requested:
Please write to the authorities in Israel urging them to:
- guarantee the physical and psychological integrity of Mr. Ziyad Muhammad Shehadeh Hmeidan, and in particular ensure that Mr. Hmeidan is not subjected to torture or other cruel, inhuman or degrading treatment or punishment;
- order the immediate and unconditional release of Mr. Hmeidan, since his detention is arbitrary;
- comply with the provisions of the UN Declaration on Human Rights Defenders, in particular article 12(2), which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration" and article 1 mentioned above;
