人権デーの取り組みに関連して、人権NGOの
役員の人たちが逮捕され、一人だけ保釈されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、カンボジアにおける以下の状況に関して、皆様の引き続きの働きかけをお願いします。

<事件の概要>

 人権擁護家のための監視機構は、「地域法教育センター(CLEC)」所長であり国際人権デー記念行事実行委員会のメンバーであるイェン・ヴィラックさんが、1月11日に保釈されたという情報を受けました。

 イェン・ヴィラックさんは、2005年12月10日の国際人権デーにおける彼の役割に関して、2005年12月31日に逮捕され、同日名誉毀損で起訴されました(背景情報を参照のこと)。

 監視機構はイェン・ヴィラックさんの釈放のために介入してくださったすべての人々および組織に対してお礼を申しあげます。

 しかし、監視機構は、2005年12月31日に逮捕された「カンボジア人権センター(CCHR)」代表のケム・ソカさんと、2006年1月4日に逮捕されたCCHRの副理事でありCCHR“民主主義の声”のプロデューサーであるパ・ニュオン・ティアンさんが、プノンペン近辺にあるプレイ・サル刑務所に引き続き拘禁されていることを想起します。

 イェン・ヴィラックさん、ケム・ソカさんそしてパ・ニュオン・ティアンさんは、国際人権デーのイベントで掲げられた横断幕に関して、名誉毀損の理由で起訴されました.3人に対する裁判は係属中です。

<背景情報>

 2005年12月10日、CCHRを含むNGO63団体が57回目の国際人権デーを記念し、多彩なプログラムと各団体の活動や物品の展示ブースによるイベントを開催しました。このイベントには数千人が参加しましたが、警官が警備し、私服警官が監視していました。CCHRもブースを1つ出していました。CCHRは2003年に使われた古い横断幕をデコレーションに使っており、その横断幕には「私の投票は私の命」、「人々の心に恐怖を植えつける政党には投票しない」という言葉がクメール語で印刷されていました。また、CCHRが2003年に一般向けに行った活動に参加した人々の手書きの言葉も残っていました。午前11時頃、ブースにいたスタッフはイベントの運営委員会から、警察当局がその横断幕について苦情を言ってきていると伝えられました。それを聞いたスタッフは、横断幕をブースから外すことにしました。

<行動要請>

 カンボジア関係当局に以下の内容の要請をお願いします。

  1. いかなる情況にあろうとも、ケム・ソカさんとパ・ニュオン・ティアンさんの心身の安全を保障すること。
  2. ケム・ソカさんとパ・ニュオン・ティアンさんを即時釈放すること。
  3. ケム・ソカさん、イェン・ヴィラックさんおよびパ・ニュオン・ティアンさんに対するすべての嫌疑は恣意的であるため、取り下げられるよう保障すること。
  4. ケム・ソカさん、イェン・ヴィラックさん、パ・ニュオン・ティアンさんおよびカンボジアのすべての人権擁護家に対する嫌がらせ行為に終止符を打つこと。
  5. 1998年12月9日国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条、「すべての人は、個々にまた他の者と共同して、すべての人権と基本的自由に関する意見、情報、知識を出版、発表もしくは他の者に伝える権利を有している」とした第6条(b)、「すべての人は、個人あるいはその他の人々と共に、政府機関や組織および公共業務に関係している機関に、それらの機能を向上させるための批判や提案を出したり、人権および基本的自由の促進、保護および実現を妨げたり遅らせるようなそれらの業務活動に対して注意を惹きつける権利を有する」とした第8条2項を遵守すること。
  6. 国際人権基準およびカンボジアが批准した国際文書に従い、いかなる情況にあろうとも人権尊重と基本的自由を保障すること。

Dear Prime Minister Hun Sen,

I am writing you to express my concern at the news of the arrest and charges against Mr. Kem Sokha, President of the Cambodian Centre for Human Rights (CCHR), Mr. Pa Nguon Teang, Deputy Director of the CCHR, and Mr. Yeng Virak, Director of the Community Legal Education Centre (CLEC) in relation to their activities for the celebration of the International Human Rights Day on December 10, 2005. While I welcome the release of Mr. Yeng Virak, I still remain concerned about the other two people who are currently detained in the Prey Sar prison.

I would, therefore, urge you the followings:

  1. To guarantee in all circumstances the physical and psychological integrity of Mr. Pa Nguon Teang and Mr. Kem Sokha;
  2. To release immediately Mr. Pa Nguon Teang and Mr. Kem Sokha;
  3. To ensure that all charges against Mr. Yeng Virak, Mr. Pa Nguon Teang and Mr. Kem Sokha be dropped, as they are arbitrary;
  4. To put an end to all acts of harassment against Mr. Pa Nguon Teang, Mr. Kem Sokha and Mr. Yeng Virak, as well as all other human rights defenders in Cambodia;
  5. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", article 6(b), which states that "everyone has the right, individually and in association with others (...) to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms", and its article 8(2), which provides that "everyone has the right, individually and in association with others, to submit to governmental bodies and agencies and organisations concerned with public affairs criticism and proposals for improving their functioning and to draw attention to any aspect of their work that may hinder or impede the promotion, protection and realisation of human rights and fundamental freedoms";
  6. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Cambodia.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information and requests your urgent intervention in the following situation in Cambodia.

New Information:

The Observatory has been informed that Mr. Yeng Virak, Director of the Community Legal Education Centre (CLEC) and member of the organising committee of the International Human Rights Day celebration, was released on bail on January 11, 2006.

Mr. Yeng Virak had been arrested on December, 31, 2005, in relation to his role in the International Human Rights Day celebration on December 10, 2005, and was charged with defamation on the same day (See background information).

The Observatory thanks all the persons, organisations and institutions who intervened in favour of Mr. Yeng Virak's release.

However, the Observatory recalls that Mr. Kem Sokha, President of the Cambodian Centre for Human Rights (CCHR), and Mr. Pa Nguon Teang, Deputy Director of the CCHR and Producer of the CCHR Voice of Democracy radio programme, who were respectively arrested on December 31, 2005 and January 4, 2006, remain detained at the Prey Sar prison near Phnom Penh.

Mr. Yeng Virak, Mr. Kem Sokha and Mr. Pa Nguon Teang were all charged with defamation in connection with banners displayed at the International Human Rights Day event. Judicial proceedings remain pending against the three of them.

Background information:

On December 10, 2005, a group of 63 NGOs, including CCHR and CLEC, organised a celebration for the International Human Rights Day with a gathering including booth displays, where participating NGOs displayed their activities and products. Thousands of people participated in the event, which was guarded by police officers and closely monitored by plain-clothes police officers. One of the booths was occupied by CCHR. It was decorated with old banners, which were used in 2003 and had slogans printed in Khmer script: "My vote is my life" and "I don't vote for any party that sows fear to the people".

The banners also had handwritings on them, some of which allegedly criticised the policies of Cambodian Prime Minister Mr. Hun Sen. At around 11:00 a.m., CCHR staff members manning the booth were informed by the steering committee that the police authorities had complained about the banners displayed at the stall. Upon receiving this information, CCHR staff members decided to remove the banners.

Actions Requested

  1. Guarantee in all circumstances the physical and psychological integrity of Mr. Pa Nguon Teang and Mr. Kem Sokha;
  2. Release immediately Mr. Pa Nguon Teang and Mr. Kem Sokha;
  3. Ensure that all charges against Mr. Yeng Virak, Mr. Pa Nguon Teang and Mr. Kem Sokha be dropped, as they are arbitrary;
  4. Put an end to all acts of harassment against Mr. Pa Nguon Teang, Mr. Kem Sokha and Mr. Yeng Virak, as well as all other human rights defenders in Cambodia;
  5.
