パキスタン南西部で国内人権委員会の
調査団が襲撃されました。
「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、パキスタンにおける下記の状況に関して皆様の緊急の働きかけをお願いします。
<事件の概要>
人権擁護家のための監視機構は「パキスタン人権委員会(HRCP)」より、2006年1月8日にパキスタン南西部のバロチスタン州でHRCPの事実調査団が襲撃されたという情報を入手しました。
入手した情報によると、この調査団はアスマ・ジャハンギルHRCP会長、アフラシアブ・カタックHRCP前会長、ジャーナリストのムニザエ・ジャハンギルさん、カメラマンのムハンマド・ナディームさんがメンバーでした。この調査団は、パキスタン軍が2005年12月17日に開始した軍事行動に伴う、バロチスタン州での人権状況の悪化を監視しようとしていました。彼らの車に対する襲撃の際、カラシニコフ銃による銃撃が3発ありましたが、幸い誰も負傷しませんでした。
バロチスタン解放軍(BLA)がクエッタ・クラブに電話してきて、この襲撃の犯行声明を出したということです。BLAは犯行声明を出すとき、通常は自分たちのウェブサイトに記者発表を掲載するので、今回の行動はいつもと少し違っています。入手した情報によると、調査団の車を情報機関がずっと撮影していたため、政府は車の正確な位置をつかんでいたということです。HRCPは被害届を出しましたが、警察の第一報告書も出ず、捜査も行われていません。
監視機構はこの襲撃を懸念し、パキスタン軍の関与の可能性を危惧します。これに関し、監視機構は、同州の状況を監視しようとするあらゆる者を黙らせようと当局が繰り返し試みていることを、HRCPが非難していることを想起します。
<行動要請>
パキスタン関係当局に以下の内容の要請をお願いします。
- いかなる状況にあろうともパキスタンのすべての人権擁護家の心身の安全を保障すること。
- HRCPミッションに対する攻撃の情況を明らかにし、責任者を特定して裁判に付し、その罪の重さに応じた刑を言い渡すために、公正で独立した調査を実施すること。
- パキスタンのすべての人権擁護家に対するすべての嫌がらせ行為に終止符を打つこと。
- 1998年12月9日に国連総会で採択された人権擁護家に関する国連宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「すべての人は、個々にまた他の者と共同して、すべての人権と基本的自由に関する意見、情報、知識を出版、発表もしくは他の者に伝える権利を有している・・・すべての人権と基本的自由の法律上および実践上での遵守に関して、調査、議論、意見の形成あるいは保持を行い、これらおよびその他適切な手段を通して、こうした問題に一般の注意を惹く権利を有している」とした6条を遵守すること。
- 国際人権基準およびパキスタンが批准した国際文書にしたがい、あらゆる情況下において人権尊重と基本的自由を保障すること。

I am writing you to express my concern at the report of the attack on the mission of the Human Rights Commission of Pakistan on January 8, 2006. I would like to urge you the following:
- To guarantee in all circumstances the physical and psychological integrity of all human rights defenders in Pakistan;
- To conduct a fair, impartial and independent investigation in order to clarify the circumstances of the attack against the HRCP mission, identify those responsible, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
- To put an end to all acts of harassment against all human rights defenders in Pakistan;
- To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels" and article 6, which states that "everyone has the right, individually and in association with others: to know, seek, obtain, receive and hold information about all human rights and fundamental freedoms (...), freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms and to study, discuss, form and hold opinions on the observance (...) of all human rights and fundamental freedoms and, through these and other appropriate means, to draw public attention to those matters".
- To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Pakistan.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Pakistan.
Brief description of the facts:
The Observatory has been informed by the Human Rights Commission of Pakistan (HRCP) that a HRCP fact-finding mission was attacked in the Pakistani south western region of Balochistan, on January 8, 2006.
According to the information received, the mission delegation was composed by Ms. Asma Jahangir, HRCP Chairperson, Mr. Afrasiab Khattak, former HRCP Chairperson, Mr. Munizae Jahangir, a journalist, and Mr. Muhammad Nadeem, a cameraman. The mission aimed at monitoring the deterioration of the human rights situation in Balochistan subsequent to the military operations launched by the Pakistani armed forces on December 17, 2005. Three charges of Kalashnikov were fired during the attack against the vehicle; fortunately none of the mission members got wounded.
The Balochistan Liberation Army (BLA) reportedly made a phone call to the Quetta club to claim responsibility for the attack. This attitude is not common for the BLA, which generally claims responsibility for its actions by posting a press release on its website. According to the information received, the government knew the exact position of the vehicle because the intelligence services photographed it along the way. The HCRP delegates filed a complaint but it has not been followed neither by a police first information report nor by an investigation.
The Observatory expresses its concern about this attack, and fears that the Pakistani Army might have been involved in it. In this regard, the Observatory recalls that HRCP denounces the regular attempt of the authorities to silence anyone who wishes to monitor the situation in the province.
Actions required :
Please write to the authorities of Pakistan urging them to:
- Guarantee in all circumstances the physical and psychological integrity of all human rights defenders in Pakistan;
- Conduct a fair, impartial and independent investigation in order to clarify the circumstances of the attack against the HRCP mission, identify those responsible, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
- Put an end to all acts of harassment against all human rights defenders in Pakistan;
