人権組織の役員であり民間ラジオ局の理事である弁護士が深刻な嫌がらせを受けています。

　「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ジンバブエにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

＜事件の概要＞

　人権擁護家のための監視機構は「ジンバブエ人権機構（Zimrights）」と「ジンバブエ人権弁護士協会(ZLHR)」より、Zimrights 会長でZLHR執行役員であり、政治問題に関する独自の番組を放送しているラジオ局「人民の声(VOP)」の理事であるアーノルド・ツンガさん（男性）が深刻な嫌がらせを受け、心身の安全が懸念されているという情報を入手しました。

　入手した情報によると、2006年1月21日早朝、ムタレにあるツンガさんの自宅を警官2人と兵士1人が強制捜査しました。彼らはツンガさんの使用人である女性のメイドと、管理人のチャールズ・ニャムフクザさんに警察署への同行を求めました。その時ツンガさんと家族は不在でした。

　さらに、2006年1月17日付のザ・ヘラルド紙は、「偽りの人権活動が暴露された」というタイトルで、人権弁護士の活動を攻撃し、具体的な弁護士名や法律事務所名に言及したシーザー・ズヴァイ署名記事を掲載しました。

　また、2006年1月17日、ツンガさんと他のVOPの理事であるデヴィッド・マスンダさん（女性）、ミリセント・フィリさん（男性）、ローレンス・チブウェさん（男性）、ンララ・ングウェニャさん（男性）、イサベラ・マタンバナゾさん（女性）の5人が逮捕され、「無免許放送」（放送法第7条１）の嫌疑で起訴されました。この罪状は最高2年の禁固になる可能性があります。その日のうちにこの6人は保釈されましたが、そのうちツンガさんを含む5人は、犯罪捜査局法・秩序部に毎週報告しなければなりません。審理は2006年2月10日に延期されました。

　その上、2006年1月26日、見知らぬ男がZimrightsの事務所に来て、ツンガさんとの面会を求めました。ツンガさんは不在でしたが、軍隊と関係があると思われるこの男性は、ジンバブエ軍情報部隊(ZIC)の複数の隊員が自分のもとを2回訪れ、ツンガさんを追跡し、殺害する命令を政府から受けている、と言われた、と説明しました。

　監視機構はこの情報を深く懸念し、ツンガさんの心身の安全を深刻に危惧します。これに関し、監視機構は、1998年12月9日に国連総会が採択した「人権擁護家保護のための宣言」第12条2項「国家は、この宣言に掲げられた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するための、すべての必要な措置をとるべきである」を想起します。

　さらに監視機構は全般的に、ジンバブエの人権擁護家が安全を脅かされ、表現や結社の自由を侵害されている状況を懸念していることを再度、強調します。

＜行動要請＞

　ジンバブエ関係当局に以下の内容の要請をお願いします。

  1. アーノルド・ツンガさんおよびジンバブエのすべての人権擁護家の心身の安全を保障すること。
  2. アーノルド・ツンガさん、デヴィッド・マスンダさん、ミリシェント・フィリさん、ローレンス・チブウェさん、ンララ・ングウェニャさん、イサベラ・マタンバナゾさんにかけられた嫌疑は恣意的なため、それらが取り下げられるよう、公正で中立な裁判を行うよう保障すること。
  3. アーノルド・ツンガさんおよびジンバブエのすべての人権擁護家、並びにデヴィッド・マスンダさん、ミリシェント・フィリさん、ローレンス・チブウェさん、ンララ・ングウェニャさん、イサベラ・マタンバナゾさんに対するすべての嫌がらせ行為に終止符を打つこと。
  4. 人権擁護家に関する宣言のすべての条文、とりわけ「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第１条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項にしたがうこと。
  5. 国際人権基準およびジンバブエが批准した国際文書にしたがい、いかなる情況にあろうとも、国内における人権尊重と基本的自由を保障すること。

I would like to urge you the followings:

  1. To guarantee, in all circumstances, the physical and psychological integrity of Mr. Arnold Tsunga, and of all human rights defenders in Zimbabwe;
  2. To ensure that Mr. Arnold Tsunga, Mrs. David Masunda, Mr. Millicent Phiri, Mr. Lawrence Chibwe, Mr. Nhlahla Ngwenya and Mrs. Isabella Matambanadzo be granted a fair and impartial trial so that all charges against them be dropped, as they are arbitrary;
  3. To put an end to all acts of harassment against Mr. Arnold Tsunga, all human rights defenders in Zimbabwe, as well as Mrs. David Masunda, Mr. Millicent Phiri, Mr. Lawrence Chibwe, Mr. Nhlahla Ngwenya and Mrs. Isabella Matambanadzo;
  4. To conform with the provisions of the Declaration on Human Rights Defenders, in particular its article 1 which states that "Everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", and article 12(2) which states that "The State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
  5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Zimbabwe.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT) requests your urgent intervention in the following situation in Zimbabwe.

Brief description of the situation :

The Observatory has been informed by the Zimbabwe Human Rights Association (Zimrights) as well as by Zimbabwe Lawyers for Human Rights (ZLHR) about serious acts of harassment and risks for the physical and psychological integrity of Mr. Arnold Tsunga, Chairman of the organisation, ZLHR Executive Director, and a trustee of the radio station Voice of the People (VOP), which produces independent programmes on political issues.

According to the information received, on January 21, 2006, two police officers and one soldier raided in the early hours of the morning Mr. Tsunga's home, in Mutare. The men requested that Mr. Tsunga's workers, a female maid and Mr. Charles Nyamufukudza, caretaker, accompany them to the police station. Mr. Tsunga and his family were not at home at the time of the visit.

In addition, on January 17, 2006, an article, published in The Herald, and wrote by one Mr. Ceasar Zvayi, entitled "Pseudo Human Rights activism exposed", had attacked the work of human rights lawyers and mentioned specific lawyers and law firms.

Besides, on January 24, 2006, Mr. Tsunga, along with five other VOP trustees, Mrs. David Masunda, Mr. Millicent Phiri, Mr. Lawrence Chibwe, Mr. Nhlahla Ngwenya and Mrs. Isabella Matambanadzo, were arrested and charged with " broadcasting without a license " (section 7.1 of the Broadcasting Services Act), punishable of a two-year prison sentence. On that day, these six persons were released on bail, but five of them, including Mr. Tsunga, have to report weekly before the Criminal Investigation Department (CID) Law and Order. The hearing was postponed to February 10, 2006.

Furthermore, on January 26, 2006, an unknown man came to Zimrights' office, asking to talk with Mr. Tsunga. As Mr. Tsunga was absent, this man, who seemed to be linked with the Army, explained that he had been visited twice by some members of the Zimbabwe Military Intelligence Corps (ZIC), who told him that they had received orders from the government to hunt Mr. Tsunga down, and to kill him.

The Observatory expresses its deepest concern regarding this information, and seriously fears for Mr. Tsunga's physical and psychological integrity. In this regard, the Observatory recalls the article 12.2 of the Declaration on Human Rights Defenders, adopted by the United Nations General Assembly on December 9, 1998, which states that "The State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration".

More generally, the Observatory reiterates its concern about the situation of human rights defenders in Zimbabwe, who face serious risks to their security as well as infringements of their freedoms of expression and association.

Action requested :

Please write to the Zimbabwean authorities, urging them to :

  1. Guarantee, in all circumstances, the physical and psychological integrity of Mr. Arnold Tsunga, and of all human rights defenders in Zimbabwe;
  2. Ensure that Mr. Arnold Tsunga, Mrs. David Masunda, Mr. Millicent Phiri, Mr. Lawrence Chibwe, Mr. Nhlahla Ngwenya and Mrs. Isabella Matambanadzo be granted a fair and impartial trial so that all charges against them be dropped, as they are arbitrary;
  3. Put an end to all acts of harassment against Mr. Arnold Tsunga, all human rights defenders in Zimbabwe, as well as Mrs. David Masunda, Mr. Millicent Phiri, Mr. Lawrence Chibwe, Mr. Nhlahla Ngwenya and Mrs. Isabella Matambanadzo;
  4. Conform with the provisions of the Declaration on Human Rights Defenders, in particular its article 1 which states that "Everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", and article 12(2) above-mentioned;
  5. Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Zimbabwe.
