平和的デモに参加する途中の政治活動家が、
ネパール軍兵士に突然発砲され、
一人が死亡、一人が重傷を負いました。

　SOSトーチャー国際事務局は、ネパールにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

＜事件の概要＞

　SOSトーチャー国際事務局はSOSトーチャーネットワークメンバーである「インフォーマル・セクター・サービス・センター(INSEC)」より、2006年2月8日午後12時半にダン郡ゴラヒのスーパー・ロッジ道路で、スワルガドワリ・プレスの経営者でネパール共産党（CPN/UML）の県評議会委員のウメシュ・タパさん（45歳）が死亡し、ネパーリ・コングレス党のクリシュナ・ギリさん（55歳、住所：Dharna-4; Dang）が負傷したという情報を入手しました。

　入手した情報によると、ウメシュ・タパさんとクリシュナ・ギリさんは2006年2月8日にネパール軍に撃たれたということです。事件当時、この2人の男性は他の政治活動家15人と地方選挙に反対する平和的なデモに参加するため、現地に向かっている途中でした。ネパール軍兵士は彼らに反対方向から2台の車で近づき、25発から30発の銃弾を浴びせ、タパさんを死亡させました。治安部隊は2006年2月10日まで遺体をタパさんの遺族に引き渡さなかったので、ヒンドゥーの定める24時間以内の葬儀を行うことができませんでした。ギリさんは胸と足を撃たれ、ネパールグンジにあるベリ・ゾナル病院で治療中です。事件後、ネパール軍は集団に対して発射された銃弾を回収し、持ち去りました。

　この発砲事件の前日の2006年2月7日、カマル・タパ内務相が選挙当日はデモ参加者に対して発砲せよ、という命令を出していたと報じられています。

　国際事務局は、他の15人の政治活動家についての情報は得ていません。

　国際事務局は、ウメシュ・タパさんの死亡とクリシュナ・ギリさんの負傷を招いた発砲に対し、深い懸念を表明します。

＜行動要請＞

　ネパール関係当局に以下の内容の要請をお願いいたします。

  1. クリシュナ・ギリさんの心身の安全を保障すること。
  2. ウメシュ・タパさんの家族に適切な補償が行われるよう保障すること。
  3. 責任者を特定し、裁判に付し、裁判に基づいて刑事あるいは行政処罰を適用するために、これら事件の綿密で公正な調査を命じること。
  4. 国内法および国際人権基準に基づき、国内における人権尊重と基本的自由を保障すること。

  3. To order a thorough and impartial investigation into these events, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
  4. To ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Extrajudicial Execution / Injury

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Nepal.

Brief Description of the Situation

The International Secretariat of OMCT has been informed by the Informal Sector Service Center (INSEC), a member of the OMCT network, about the death of Mr. Umesh Thapa (45), proprietor of Swargadwari Press and district council member of the Communist Party of Nepal (CPN/(UML)), and injury of Mr. Krishina Giri (55), of Dharna-4; Dang of Nepali Congress, on 8 February 2006 at 12.30 pm at Super Lodge Road, Ghorahi, Dang.

According to the information received, Mr. Umesh Thapa and Mr. Krishina Giri were shot on 8 February 2006 by the Royal Nepalese Army (RNA). At the time of the incident the two men were on their way to participate in a peaceful demonstration, together with 15 other political activists, against the municipal election. The RNA personnel approached the men from the opposite direction with two vehicles and opened 25-30 rounds of fire at them, resulting in the death of Mr. Thapa. The security force refused until 10 February 2006 to hand over the dead body of Mr. Thapa to the family, thereby making it impossible to have the funeral within 24h as the Hindu tradition prescribes. Mr. Giri was allegedly shot in the chest and leg and is currently being treated at Bheri Zonal Hospital at Nepalgunj. After the incident, the RNA collected and took away all the bullets fired by them on the mass.

It is reported that on 7 February 2006, the day previous to the shooting, Home Minister Kamal Thapa's had ordered to open fire on demonstrators on the day of election.

OMCT holds no further information on the 15 political activists.

The International Secretariat of OMCT expresses its deep concern over the shooting resulting in the death of Mr. Umesh Thapa and the injury of Mr. Krishina Giri.

Action Requested:

Please write a letter to the authorities in Nepal urging them to:

  1. Guarantee, in all circumstances, the physical and psychological integrity of Mr. Krishina Giri.
  2. Guarantee that adequate compensation is awarded to Mr. Umesh Thapa's family.
  3. Order a thorough and impartial investigation into these events, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
  4. Ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
