シリアのジャーナリストが政府の人権侵害を非難したことで逮捕されました

(ジュネーブ・パリ発 4月11日)

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、シリアにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は、シリア人権・民主的自由擁護委員会(CDF)より、シリア軍情報局(SMID)が、シリアにおける人権侵害を非難する記事を自らのホームページに掲載した小説家兼ジャーナリストのモハメド・ガネムさんを、軍事法廷で裁く決定をしたという情報を受けました。

情報によれば、モハメド・ガネムさんは、彼のホームページ“Souriyoun”(シリア人の意)に「シリアにおける人権に対する見せかけの侵害に関する偽りのニュースを掲載し」、「シリアの国内事情に関する偽りのニュースを公表したことで国民の意気を消沈させ」、「シリア国土に不協和音をもたらした」という理由で告訴されました。

 信頼ある情報筋によれば、2番目の嫌疑は、ガネムさんが自分のホームページで、シリアにおける腐敗と抑圧について出した記事と報告に関係しており、3番目の嫌疑は、シリアにいるクルド人マイノリティの文化的、政治的権利を支持した記事を彼が書いたことによるものと思われます。事実、ガネムさんは、1963年にアルバーサ党が権力を掌握して以来、シリアのクルド人の政治的および文化的権利が認められるよう、彼らのコミュニティを支援してきたシリアのアラブ系知識人の一人です。

1965年に発布されたシリア戒厳令法第6によれば、上記の嫌疑のいずれかにより有罪とされた人は、3年から15年までの懲役刑に処せられます。

<背景情報>

 2006年3月31日、モハメド・ガネムさんは北シリアのアルリカにある自宅で、シリア軍情報局(SMID)の武装将校により逮捕されました。その後すぐに、ダマスカスに移送されたガネムさんは、現在もそこにある軍情報安全部の“パレスチナ支部”(第235支部)に拘束されています。そこは拘禁所の中で最も過酷な条件にあることで知られています。

ガネムさんは現在まで、弁護士にも家族にも会うことも許されていません。

監視機構は、ガネムさんが2004年3月にも25日間拘留されていて、独房拘禁される中、虐待を受けていたことを想起します。その時は、シリア軍と情報局によるクルド人マイノリティの弾圧作戦を非難する記事を彼が書いたことが理由でした。

監視機構は、モハメド・ガネムさんの人権を支持する活動への制裁と、その他すべての人権擁護家への見せしめのためだけに思える彼の恣意的拘禁と彼にかけられた嫌疑を、強く非難します。

<行動要請>

シリア関係当局に以下の内容の要請をお願いします。

  1. いかなる情況にあろうともモハメド・ガネムさんの心身の安全を保障すること。
  2. ガネムさんを即時釈放し、彼にかけられた嫌疑はすべて恣意的なため、それらが取り下げられるよう保障すること。
  3. シリアのすべての人権擁護家に対するすべての嫌がらせ行為に終止符を打つこと。
  4. 1998年12月9日に国連総会が採択した人権擁護家に関する国連宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を順守すること。
  5. 国際人権基準およびシリアが批准した国際文書にしたがい、あらゆる情況において、人権尊重と基本的自由を保障すること。

I would like to express my concern over the detention of Mr. Mohammed Ghanem, who is a novelist and a journalist in Syria. As his detention is arbitrary, I would like to urge you the followings:

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Mohammed Ghanem;

2. To release Mr. Ghanem immediately and ensure that all charges against him be dropped, as they are arbitrary;

3. To put an end to all acts of harassment against him and all other human rights defenders in Syria;

4. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the United Nations General Assembly on December 9, 1998, especially its article 1, which states that “everyone has the right, individually or in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12-2 which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;

5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Syria.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Syria.

Brief description of the situation:

The Observatory has been informed by the Committee for the Defence of Human Rights and Democratic Freedoms in Syria (CDF) that the Syrian Military Intelligence Department (SMID) has decided to try Mr. Mohammed Ghanem, a novelist and a journalist who posts articles denouncing human rights violations in Syria on his website “Souriyoun”, before a military court.

According to the information received, Mr. Mohammed Ghanem is accused of publishing “false news about pretended violations being done against human rights in Syria” on his website “Souriyoun” (Syrians), “weakening the nation’s spirit by publishing false news on Syria’s internal situation” and “working to split the Syrian homeland“.

According to reliable sources, the second charge would be linked with the articles and reports that Mr. Ghanem published on his website about corruption and repression in Syria”, while the third accusation would be the result of his articles supporting the cultural and political rights of the Kurdish minority in Syria. Indeed, Mr. Ghanem is one of the Syrian Arab intellectuals who support the Kurdish community in Syria to get their political and cultural rights recognized, since the Al-Ba’ath Party came to power in 1963.

According to Syrian Martial Law No.6 issued in 1965, anybody who would be found guilty of one of those charges is facing a 3 to 15 years prison term with hard labor.


Background information :

On March 31, 2006, Mr. Mohammed Ghanem was arrested in his residence in Ar-Rika, North Syria, by armed officers of the Syrian Military Intelligence Department (SMID). He was immediately transferred to Damascus, where he remains detained in the “Palestine Branch” of the Military Intelligence Security (Branch 235), a place that is known for its extremely harsh conditions of detention.

Mr. Ghanem has not been allowed yet to meet neither his lawyer nor his family.

The Observatory recalls that Mr. Mohammed Ghanem had already been detained during 25 days in March 2004, and was then subjected to ill-treatments while kept in confinement, because of his articles condemning the repressing campaigns that were run by the Syrian army and intelligence services against the Kurdish minority.

The Observatory strongly condemns Mr. Mohammed Ghanem’s arbitrary detention and the charges against him, which seem to only aim at sanctioning his activities in favour of human rights in Syria, and at intimidating all human rights defenders.

Action requested:

Please write to the Syrian authorities and ask them to :

  1. Guarantee in all circumstances the physical and psychological integrity of Mr. Mohammed Ghanem;

  2. Release Mr. Ghanem immediately and ensure that all charges against him be dropped, as they are arbitrary;

  3. Put an end to all acts of harassment against him and all other human rights defenders in Syria;

  4.
