No.3916 アンゴライギリスのNGOの職員がアンゴラのホテル滞在中に恣意的に拘禁されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、アンゴラにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>
人権擁護家のための監視機構は信頼できる情報筋より、「グローバル・ウィットネス」という天然資源の搾取と紛争、人権のつながりに取り組んでいる団体のキャンペーン担当上級職員である英国籍のサラ・ワイクスさんが逮捕されたという情報を入手しました。
情報によると、ワイクスさんは2007年2月18日にカビンダで警察に逮捕され、そのまま拘禁されているということです。警察は午前4時に彼女の宿泊先のホテルに来て、パスポート、デジタルカメラ、ペンドライブ2個、ノートブックPC1台などの所持品を押収しました。警官が令状を持っていなかったのでワイクスさんは同行を拒否しましたが、その結果、正式に逮捕され、警察署に連行されました。
彼女はそのまま刑務所で1晩過ごし、弁護士との接見が認められないまま2007年2月19日に裁判に付されました。
2007年2月20日に2千米ドルの保釈金による釈放が話し合われたということですが、この情報の発表時点ではカビンダの検事長は必要な書類に署名していません。保釈の条件もいまだにはっきりしません。ワイクスさんの審理は2007年2月21日に予定されています。しかし、監視機構は彼女の訴状を確認していません。
ワイクスさんはアンゴラの市民団体や当局とアンゴラの石油歳入のプロセスの透明性について話し合うため、2006年2月11日に同国に来ました。アンゴラ当局は彼女の訪問を十分認識しており、査証を発行しています。
監視機構はワイクスさんの拘禁を憂慮し、彼女の人権活動を制裁する狙いがあると思われるため、この拘禁が恣意的であると考えます。監視機構はアンゴラ当局に対し、ワイクスさんをただちに釈放するよう要請します。

<行動要請>
 アンゴラ関係当局に以下の内容の要請をお願いします。
1.いかなる情況にあろうとも、サラ・ワイクスさんの心身の安全を保障すること。
2.サラ・ワイクスさんの拘禁は恣意的であるので、彼女を即時無条件で釈放すること。
3.警察が押収したパスポートと所持品を彼女に返却すること。
4.人権擁護家に対するすべての嫌がらせ行為を中止すること。
5.1998年12月9日に国連総会が採択した人権擁護家に関する国連宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。
6.国際人権基準とアンゴラが批准した国際人権条約にしたがい、いかなる情況にあろうとも、国内における人権尊重と基本的自由を保障うすること。

1. To guarantee in all circumstances the physical and psychological integrity of Ms. Sarah Wykes;
2. To release her immediately and unconditionally since her detention is arbitrary;
3. To return her passport and the personal belongings that were seized by the police;
4. To put an end to all acts of harassment against human rights defenders;
5. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Angola.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Angola.

Description of the facts:

The Observatory has been informed by reliable sources of the arrest of Ms. Sarah Wykes, a British citizen and a senior campaigner of Global Witness, an organisation working on the links between the exploitation of natural resources, the conflicts and human rights.

According to the information received, on February 18, 2007, Ms. Wykes was arrested by the police in Cabinda, where she remains detained. Indeed, at 4 am, police officers came to her hotel room, and seized a number of her personal belongings, including her passport, a digital camera, two pen drives and a notebook. As the policemen did not have any warrant, Ms. Wykes refused to follow them. As a result, she was formally arrested and brought to the police station.

She then spent the night in jail and was brought to court on February 19, 2007, without being allowed to meet her lawyer.

On February 20, 2007, her release on bail for an amount of US$ 2,000 was reportedly discussed, but the Attorney General in Cabinda has not yet signed the necessary papers as of the date of issuing this urgent appeal. The bail conditions also remain unclear. Ms. Wykes should appear in Court again on February 21, 2007. Yet, the Observatory is not aware of any charge against her.

Ms. Wykes had arrived in Angola on February 11, 2006 to meet with civil society and local authorities, to discuss the process of transparency in oil revenues in Angola. The Angolan authorities were fully aware of the visit of Ms. Wykes and had granted her a visa.

The Observatory expresses its deep concern regarding Mrs. Wykes’ detention, and considers it as arbitrary, as it appears to be aimed at sanctioning her human rights activities. The Observatory further urges the Angolan authorities to release her immediately.

Action requested:
Please write to the Angolan authorities urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Ms. Sarah Wykes;

ii. Release her immediately and unconditionally since her detention is arbitrary;

iii. Return her passport and the personal belongings that were seized by the police;

iv. Put an end to all acts of harassment against human rights defenders;

v. Conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
