SOSトーチャー国際事務局は、バングラデシュにおける下記の状況に関して皆様の緊急の働きかけをお願いします。
<事件の概要>
SOSトーチャー国際事務局は、SOSトーチャーのネットワークのメンバー団体であるODHIKARより、ボーラ県チャル・ファシオンにおいて、カビルル・イスラム・ドゥラルさん(32歳)が2007年2月21日に海軍に恣意的に逮捕され、拷問された後、死亡したという情報を入手しました。
情報によると、2007年2月21日に海軍チャル・ファシオン分遣隊のS.M.レザ少佐率いる海軍士官11人(そのうち9人は私服を着用)が、チァル・ファシオン市コミッショナーのカビルル・イスラム・ドゥラルさんを武器携帯の容疑で逮捕しました。ドゥラルさんは容疑を否認し、海軍の武器引き渡し要請に従わずにいたところ、目隠しをされ、手をロープで縛られ、海軍の士官にひどく殴打されたということです。
報じられたところによると、カビルル・イスラム・ドゥラルさんは自宅までロープで引きずられ、武器を隠し持っていないか家宅捜索を受けました。自宅では、妻と2人の子ども(3歳と5歳)のいる前で地面に叩きつけられ、蹴られました。妻も殴られ、子どもたちも平手打ちにされ、銃口を突き付けられたということです。海軍の士官はドゥラルさんの家に損傷を与えたあと、彼を近所の家に引きずっていきました。隣人は海軍の士官たちに武器を出せと言われ、その場を切り抜けるために息子のおもちゃの銃を手渡しました。
情報によると、その後ドゥラルさんは近くにある元国会議員所有の家に連れて行かれました。その家には元議員は現在住んでいませんでしたが、士官たちは武器を捜索しようとして4階建てのその家の鍵をすべて壊しました。また、それを止めようとした家の管理人を殴打しました。
報じられたところによれば、カビルル・イスラム・ドゥラルさんは元議員の家の隣の家に連れていかれ、無理矢理トウガラシの粉と籾殻、塩を食べさせられました。水が欲しいと言ったら手を縛られ、目隠しをされ、近くの池に投げ込まれました。そして溺れそうになったところを池から引きあげられ、海軍分遣隊に連行され、衣服を脱がされ、殴られ、池に投げ込まれました。
目撃者によると、チャル・ファシオン・ウパジラ保健施設に運ばれたドゥラルさんを診た医師は、その場で死亡宣告をしました。遺体は検死のためにボーラ・サダル病院に運ばれました。医師の一人がODHIKARに話したところによれば、ドゥラルさん病院に着くかなり前に死亡していたということです。また、遺体は大量の水を飲んでおり、手首にはロープで縛られたあとがあり、一部の皮膚がはがれ落ちたあとがありました。睾丸にもあざがあり、のどは膨張しており、足や手の爪の一部がはがれていました。医師はチャル・ファシオン市警察に報告書を送ったということです。
ODHIKARの事実調査員が海軍分遣隊を訪問し、S.M.レザ少佐と面会しましたが、同少佐はカビルル・イスラム・ドゥラルさんを殺そうと思って逮捕したのではない、彼は早く死ぬ運命にあったのだと言いました。また、この事実調査員をJMB(急進的な地下組織)の一員として逮捕すると脅しました。ODHIKARの報告書によると、チャル・ファシオン海軍分遣隊のアシュラフ少佐は、後に、カビルル・イスラム・ドゥラルさんは地元住民の脅威となっており、数々の苦情を受けたために、逮捕したと言ったそうです(しかし、これは地元住民の証言と矛盾している)。アシュラフ少佐はODHIKARの事実調査員に、ドゥラルさんの説明をうけてから、それにそって武器を捜索し、ドゥラルさんの自宅近くでインド製ピストルを発見したと述べたそうです。分遣隊で、ピストルを持ったドゥラルさんの写真を撮ろうとして、手首を縛っていたロープを解いたところ、逃げようとして池に落ちたということです。ドゥラルさんは救助され、病院に運ばれましたが、病院で亡くなりました。
情報によると、地元のジャーナリストたちは海軍から脅迫を受け、「ドゥラルは逃げようとして池に落ちて死亡した」とだけ書くように言われました。その上、S.M.レザ少佐は、ドゥラルさんの父親に賄賂を渡し、白紙に署名させ、遺族は訴訟を起こさないという証文を後で書こうと企てましたが、父親はそれを拒否しました。
SOSトーチャー国際事務局は、カビルル・イスラム・ドゥラルさんが海軍で拘禁中に拷問を受け、死亡したという申し立てを憂慮し、遺族の心身の安全を懸念します。国際事務局は責任者を特定するために迅速で公平な調査に着手し、加害者を有効で独立した裁判に付し、免責されないよう、法律に基づいて刑法上と行政法上の制裁を適用するよう、当局に要請します。国際事務局は、当局に対し、国の法律と国際的な人道法および人権基準に沿って、全国で人権と基本的自由の尊重を保障するよう要請します。
<要請行動>
バングラデシュ関係当局に以下の内容の要請をお願いします。
1.カビルル・イスラム・ドゥラルさんの家族の心身の安全を保障すること。
2.責任者をすべて特定し、裁判に付し、法律に基づき刑事、行政罰を適用するために、これら事件について綿密で公正な調査を命じること。
3.カビルル・イスラム・ドゥラルさんの家族に適切な補償を保障すること。
4.国内法および国際人権基準にそって、国内全土における人権尊重と基本的自由を保障すること。

iv. To ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Arbitrary arrest/Excessive use of force/Torture/ Extrajudicial killing
The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in Bangladesh.
Brief description of the situation
The International Secretariat of OMCT has been informed by ODHIKAR, a member of the SOS-Torture network, of the arbitrary arrest, torture and subsequent death of Mr. Khabirul Islam Dulal (32 years old) while in Navy custody, on 21 February 2007 in Char Fashion, Bhola.
According to the information received, 11 Navy officers (9 of whom were wearing civilian clothing) led by Lieutenant Commander SM Reza of Char Fashion Naval Contingent arrested Char Fashion Municipality Commissioner Mr. Khabirul Islam Dulal at his office on 21 February 2007 under allegations of arms possession. When the victim denied the allegations against him and failed to fulfill the Navy personnel’s request to hand in the arms, he was blindfolded, had his hands tied together with rope and was severely beaten by the Navy personnel.
Mr. Khabirul Islam Dulal was then reportedly dragged home by the rope in search of the alleged weapons. Once home, he was thrown to the ground and kicked violently in the eyes of his wife, who was also beaten, and his two children (3 and 5 years old), who were slapped and held at gunpoint. After damaging his property, the Navy personnel dragged the victim on to a neighbor’s house, who reportedly provided them with her son’s toy gun in an attempt to fulfill the Navy officer’s request to hand in any arms.
According to the information received, he was then taken to the nearby house of a former local Member of Parliament which was unoccupied at the time. The Navy personnel broke all the locks of the 4-story building, damaged this second property while looking for the arms, and indiscriminately beat the house’s caretaker when he attempted to intervene.
It is also reported that Mr. Khabirul Islam Dulal was then taken to a house next door, where he was forcefully fed red chili powder, rice husks and salt in an attempt to make him hand in the arms. It was then that the victim, hands tied up and blindfolded, was thrown into a nearby pond after having asked for some water. Furthermore, after having been rescued from near drowning, Mr. Khabirul Islam Dulal was taken to the Navy contingent, where he was allegedly stripped, beaten severely, and thrown into another pond.
According to an eyewitness, when Mr. Khabirul Islam Dulal arrived at the Char Fashion Upazila Health Complex, the doctor in duty declared him dead. His body was then sent to the Bhola Sadar Hospital for a post-mortem analysis. One of the doctors stated to Odhikar that the victim died long before being admitted to the hospital. He also reportedly informed Odhikar that there was a lot of water inside the dead body, marks had been left on the wrists by the ropes, pieces of skin were falling off the body due to severe bruising, the victim’s testicles were also bruised, his throat was distended, and some of his toe and finger nails appeared to be missing. The doctors reportedly sent a report to the Char Fashion Police Station.
Odhikar fact-finding officer visited the Navy Contingent to talk with Lieutenant SM Reza who reportedly claimed not having arrested Mr. Khabirul Islam Dulal to kill him and that Mr. Khabirul Islam Dulal was not meant to live a long life. He also threatened to have the fact-finding officer arrested as a member of JMB (an underground radical group). According to Odhikar’s report, Lieutenant Commander Ashraf of Char Fashion Naval Contingent later stated that Mr. Khabirul Islam Dulal was a threat to the people of his locality and was arrested based on a number of their complaints (which appears to contradict the people’s declarations). Lieutenant Commander Ahsraf also reportedly stated to Odhikar fact-finding officer that, following Mr. Khabirul Islam Dulal alleged statement, the navy conducted an arm search operation in various places and found an Indian pistol in a house nearby his home. When they untied Mr. Khabirul Islam Dulal’s wrists in order to take a picture of him with the pistol at the contingent, he allegedly tried to escape but fell into the pond. He was rescued and sent to the hospital where he died.
According to the information, local journalists received threats from the Navy and were told only to write that “Dulal jumped into a pond and died when trying to flee”. Furthermore, Lieutenant SM Reza reportedly tried to bribe the victim’s father for his signature on a blank piece of paper and his assurance that the victim’s family would not take any legal action, which the victim’s father refused to do.
The International Secretariat of OMCT is gravely concerned about the alleged torture and subsequent death of Mr. Khabirul Islam Dulal while in Navy custody and is preocuppied for the physical and psychological integrity of his family. OMCT calls upon the authorities to launch a thorough and impartial investigation into these allegations, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law for impunity should not prevail. Finally, OMCT urges the authorities to guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international humanitarian law and human rights standards.
Action requested
Please write to the authorities in Bangladesh urging them to:
i. Guarantee the physical and psychological integrity of Mr. Khabirul Islam Dulal’s family;
ii. Order a thorough and impartial investigation into these events, in order to identify all those responsible, bring them to trial and apply the civil penal and/or administrative sanctions as provided by law;
iii. Guarantee that adequate compensation is awarded to Mr. Khabirul Islam Dulal’s family;
iv. Ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
