No.3939 フィリピン:3人の人権擁護活動家が襲撃され、1人は重傷を負い、2人は“失踪”させられたままです。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、フィリピンにおける下記の状況に関して皆様の緊急の働きかけをお願いします。 

<事件の概要>

人権擁護家のための監視機構は「フィリピン人権連合(KARAPATAN)」より、ホセ・エリー・ガラチコさんに対する殺害未遂と、マリア・ルイサ・ポサ・ドミナドさんとニロ・アラドさんの誘拐がイロイロ市で起きたという情報を入手しました。3人とも人権擁護家です。

入手した情報によると、2007年4月12日にこの3人の人権擁護家が帰宅するためイロイロ市オトンのカバンバナンを通過中、武装した3人の男に車を銃撃され、KARAPATANの広報担当であり、「解放と恩赦を求め、拘禁に反対する元被拘禁者協会(SELDA)」のメンバーであるホセ・エリー・ガラチコさんが重傷を負ったということです。ホセ・エリー・ガラチコさんは首の左側と肺の負傷で入院中です。同じくSELDAメンバーのマリア・ルイサ・ポサ・ドミナドさんと、「フィリピン小作農運動」のニロ・アラドさんはその場から誘拐されました。このアピールの発表時点でも2人は失踪したままです。彼らが乗っていた車はイロイロ市から北西に33キロメートル離れたグアダルーペ集落で焼けた状態で見つかりました。

情報によると、アラドさんは農地改革を求める運動のために2006年12月に殺害脅迫を受けていました。すべての政治囚の釈放を求める活動に参加していたガラチコさんとポサ・ドミナドさんは、拷問反対運動で有名でした。

監視機構はフィリピンで人権擁護家を標的にする事件が続いていることを憂慮し、行方不明になっている2人の人権擁護家の心身の安全を危惧します。

<行動要請>

1. いかなる情況にあろうとも、マリア・ルイサ・ポサ・ドミナドさん、ニロ・アラドさん、ホセ・エリー・ガラチコさんの心身の安全を保障すること。

2.マリア・ルイサ・ポサ・ドミナドさんとニロ・アラドさんの所在を探しだし、それを公表し、即時釈放を保障するために、迅速な行動をとること。

3.責任者を特定し、裁判に付し、犯罪の重さに応じた判決を言い渡すために、事件の公正で中立な調査を実施すること。

4.フィリピンのすべての人権擁護家に対するあらゆる形態の嫌がらせを停止し、人権擁護家と人権組織が何ら妨害をうけることなくその任務を遂行できるよう保障すること。

5.1998年12月9日に国連が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

6.国際人権基準およびフィリピンが批准した国際人権文書に従い、国内全土において人権尊重と基本的自由を保障すること。

Dear President Arroyo,

I am writing you to express my concern over the assassination attempt against Mr. Jose Ely Garachico and the kidnapping of Mrs. Maria Luisa Posa-Dominado and Mr. Nilo Arado, three human rights defenders in the area of Iloilo, both taken place on April 12, 2007. I would like to urge you the followings.

1. To guarantee in all circumstances the physical and psychological integrity of Mrs. Maria Luisa Posa-Dominado, Mr. Nilo Arado and Mr. Jose Ely Garachico;
2. To take prompt action in order to locate Mrs. Maria Luisa Posa-Dominado and Mr. Nilo Arado, make public their whereabouts, and ensure their immediate release;
iii. Conduct a fair and impartial investigation into the incident in order to identify those responsible, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
3. To end all forms of harassment and ill-treatment of human rights defenders in the Philippines, and guarantee in all circumstances that human rights defenders and organisations are able to carry out their work without any hindrance;
4. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the Philippines.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in the Philippines:
Brief description of the situation:

The Observatory has been informed by the Alliance for the Advancement of Peoples’ Rights (KARAPATAN) about the assassination attempt against Mr. Jose Ely Garachico and the kidnapping of Mrs. Maria Luisa Posa-Dominado and Mr. Nilo Arado, three human rights defenders in the area of Iloilo.

According to the information received, on April 12, 2007, while these three human rights activists were returning to their residence, they were stopped in Cabanbanan, Oton, Iloilo, by three armed men who shot several times against their vehicle and injured seriously Mr. Jose Ely Garachico, public information officer of KARAPATAN and member of Society of ex-Detainees for Liberation, Against Detention and for Amnesty (SELDA). He is currently hospitalised with traumas at the left side of his neck and at his lungs. Mrs. Maria Luisa Posa-Dominado, also a member of SELDA, and Mr. Nilo Arado, member of the Peasant Movement of Philippines, were abducted on the spot. As of the time of issuing this urgent appeal, they remain missing. The vehicle in which they were travelling was found burnt down in the area of Barangay Guadalupe, 33 km northwest of Iloilo city.

According to the information received, Mr. Arado had already received death threats in December 2006 for his action in favour of a genuine agrarian reform while Mr. Garachico and Mrs. Posa-Dominado, participating in campaigns for the release of all political prisoners in Philippines, were known for their action against the use of torture.

The Observatory is deeply concerned about the continuing attacks targeting human rights defenders in Philippines and fears for the physical and psychological integrity of the two human rights activists whose whereabouts remain unknown.

Actions required:
Please write to the authorities of Philippines urging them to:
i. Guarantee in all circumstances the physical and psychological integrity of Mrs. Maria Luisa Posa-Dominado, Mr. Nilo Arado and Mr. Jose Ely Garachico;

ii. Take prompt action in order to locate Mrs. Maria Luisa Posa-Dominado and Mr. Nilo Arado, make public their whereabouts, and ensure their immediate release;
iii. Conduct a fair and impartial investigation into the incident in order to identify those responsible, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
