No.3940 バングラデシュ:海軍に拘束中の男性が拷問を受け死亡しました。

  SOSトーチャー国際事務局は、バングラデシュにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

SOSトーチャー国際事務局はSOSトーチャーのネットワークのメンバー団体であるODHIKARより、2007年3月21日にウッター・シャシガンジ村の30歳のファリドさん(という名前で特定されている)が、海軍に拘禁されている時に拷問され死亡したという情報を入手しました。

情報によると、2007年3月20日の夜中にファリドさんは滞在していたいとこの家で地元の海軍分遣隊に逮捕されました。この海軍分遣隊のチームは火器を押収しに来たということです。その後ファリドさんはボーラ県タズムッディン・ウパジラの海軍分遣隊の基地に連行されたということです。2007年3月21日午後2時頃、レザ少佐、モニール・ホサイン伍長、アザド伍長、ジャマル伍長(アピール発表時には姓名すべてを確認することができなかった)の4人の海軍軍人がファリドさんをチェラグ・アリ・チョーキダールさんという人の家の前の溝に連れていきました。この軍人たちは溝にたまっていたわずかな水をかき出し、火器を探したということです。しかし、何も見つかりませんでした。

海軍士官はファリドさんをののしった後、棒で殴り始め、火器の隠し場所を教えなければ運河に投げ込むと言って脅しました。情報によると、この士官はファリドさんの腕や背中を棒で殴り、また胸部の両側をとがった棒で突いたということです。また、ファリドさんが水を求めると、一口すすらせたあと、顔に水を浴びせたということです。そしてファリドさんの髪をつかんで引きずり、リキシャに乗せたということです。目撃者によると、リキシャに投げ込まれた時、すでにファリドさんは死んでいたということです。

ODHIKARの事実調査チームによると、ファリドさんは2007年3月21日午後3時頃に海軍軍人によりタズムッディン・ウパジラ保健施設に運ばれ、そこで死亡宣告を受けました。ファリドさんの遺体は、両方の足首、足先、肘に傷があったということです。左足には傷があり包帯に巻かれていました。

ファリドさんの事件を調べた治安判事兼タズムッディン・ウパジラのウパジラ・ニルバヒ行政官(地方自治体の長)であるシュクール・アリは、ODHIKARの事実調査チームに、地元の海軍軍人はファリドさんを死亡の前日に逮捕したと言ったそうです。その海軍軍人は、ファリドさんが尋問中に告白したという火器の隠し場所に行ったと言っています。この海軍軍人によると、ファリドさんはこの行動から戻る途中に体調を崩し、病院に入院した後に死亡したということです。ファリドさんの死亡に関しては2007年3月21日付け第2/07号死因不明事件が申し立てられました。

ファリドさんの兄によると、ファリドさんの逮捕と死亡は、この海軍分遣隊と関係の深い村の有力者たちが、意見の違うファリドさんを敵とみなしていたことと関係があるのではないかということです。

SOSトーチャー国際事務局は、海軍に拘禁中にファリドさんが拷問を受け死亡したという事件について、同じボーラ県で海軍拘禁中の死亡事件が2ヶ月以内に起きたばかりであるため、非常に憂慮します。(アピールBGD020307参照)国際事務局は責任ある者を特定するために迅速で公平な調査に着手し、加害者を資格のある独立した裁判に付し、法律に基づいて刑法および行政罰を適用し、免責を防止するよう当局に要請します。国際事務局は国内の法律および国際人道法と人権基準に則り、全国で人権と基本的自由の尊重が保障されるよう、当局に要請します。

 バングラデシュ関係当局に以下の内容の要請をお願いします

1.ファリドさん家族の心身の安全を保障すること。

2.責任者すべてを特定し、裁判に付し、法に基づき民事あるいは行政罰を適用するために、これら事件について綿密で公正な調査を命じること。

3.ファリドさん家族に適切な補償が届くよう保障すること。

4.国内法および国際人権基準に沿って国内全土における人権尊重と基本的自由を保障すること。

Arbitrary arrest/Alleged Torture/ Death/ Impunity

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in Bangladesh.

Brief description of the situation
The International Secretariat of OMCT has been informed by ODHIKAR, a member the SOS-Torture network, about the alleged torture and subsequent death of Farid (identified as such), 30 years old, resident of Uttar Shashiganj village, while in Naval custody on 21 March 2007.
According to the information received, Farid was arrested on 20 March 2007 around midnight at his cousin’s house where he was staying, by a team of the local Naval contingent, allegedly to seize firearms, and was then brought to the Naval contingent based in Tazmuddin Upazilla, Bhola District. At around 2pm on 21 March 2007, four Naval personnel, reportedly Lieutenant Reza, Corporal Monir Hossain, Corporal Azad and Corporal Jamal (complete names at the time of issuing the urgent appeal not available), took Farid to a ditch in front of the house of a certain Mr. Cherag Ali Chowkidar in Uttar Shashiganj. The Naval personnel reportedly bailed out the small quantity of water that the ditch contained and searched for arms. However, they did not find any.
The senior officer reportedly started beating Farid with a stick after having verbally abused him and threatened to throw him into a canal if Farid would not tell him where the arms were hidden. According to the information, the senior officer kept striking Farid’s arms and back with a stick and also pricked both side of his chest with a pointed stick. It is further reported that when Farid asked for water, he was only given a sip and the water was then thrown over his mouth. The Naval personnel then put him in a rickshaw while dragging him by his hair. According to a witness, Farid was already dead when he was charged into the rickshaw.
According to ODHIKAR’s fact-finding mission, Farid was brought to the Tazumuddin Upazilla Health Complex by the Naval personnel at around 3 pm on 21 March 2007 where he was declared dead. Farid’s body reportedly carried wounds above both ankles and had injuries on both his feet and elbows. It is reported that an injury he had on his left leg was already bandaged.
The Magistrate and the Upazilla Nirbahi Officer (head of sub-district administration) of Tazumuddin Upazilla, Shukur Ali, who conducted the inquest into Farid’ case, reportedly said to ODHIKAR’s fact-finding team, that the local Naval personnel arrested Farid the day before he died. The Naval personnel reportedly went to the place where Farid had allegedly confessed to have hidden the arms during the interrogation. According to the Naval personnel, Farid fell ill on their way back from the operation and died after being admitted at the hospital. An Unidentified Death (UD) case was reportedly filed regarding the death of Farid under the case number 2/07 dated 21/3/07.
According to Farid’s elder brother, his arrest and death might be linked to village leaders who have close links to some officials of the local Naval contingent and who considered Farid as their enemy for his stand against them.
The International Secretariat of OMCT is gravely concerned about the alleged torture and subsequent death of Farid while in Naval custody, particularly because this is the second reported death in Naval custody in Bhola District (see OMCT BGD 020307) within two months. OMCT calls upon the authorities to launch a thorough and impartial investigation into these allegations, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law for impunity should not prevail. Finally, OMCT urges the authorities to guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international humanitarian law and human rights standards.

Action requested

Please write to the authorities in Bangladesh urging them to:

i. Guarantee the physical and psychological integrity of Farid’s family;
ii. Order a thorough and impartial investigation into these events, in order to identify all those responsible, bring them to trial and apply the civil penal and/or administrative sanctions as provided by law;
iii. Guarantee that adequate compensation is awarded to Farid’s family;
iv. Ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
