No.3942 トルコ:平和的デモに関った11人の労組リーダーが有罪判決を受けました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、トルコにおける下記の状況に関して皆様の緊急の働きかけをお願いします。 

<事件の概要>

人権擁護家のための監視機構は国際労働組合総連合(ITUC)より、労働組合リーダー11人が受けた判決について情報を入手しました。

情報によると、2007年4月4日、公務員労働組合連合(KESK)傘下のさまざまな組合の執行委員が、集会とデモに関する法律第2911条の違反で禁錮1年3ヶ月と罰金407トルコリラ(約223ユーロ)の判決を受けたという情報を入手しました。

判決を受けた労働組合リーダーは以下の通りです:

KESK会長のイスマイル・ハッキ・トムブル博士、エギティム・セン会長のアラーディン・デンチェル、市労働組合(BES)元代表のビュレント・カヤ、医療福祉公務員組合(SES)代表のケクサル・アイディン、建設道路労働組合(YAPI YOL Sen)代表のベドリ・テキン、運輸労働組合連合(BTS)会長フェーミ・クタン、エギティム・セン事務局長エミラリ・シムセク、エギティム・センのアンカラ第1支部支部長オズギュル・ボズドガン、エギティム・センのアンカラ第2支部支部長アブドゥラー・シフトチ、SES事務局長エルカン・シュメル、エギティム・センのアンカラ第2支部執行委員ムラット・カーラマン

上記の労働組合リーダーのうち9人は執行猶予となりましたが、イスマイル・ハッキ・トムブルさんとフェーミ・クタンさんは執行猶予になりませんでした。もしこの判決がトルコ上級控訴裁判所で認められれば、2人は収監されます。このアピール発表時点では控訴審の日付は決まっていません。

この11人の組合活動家は、2005年11月26日にエギティム・センがアンカラで行った教員の平和的なデモが警察によって強制的に弾圧された後、起訴されました。デモでは正当な労働組合の権利を行使していただけにも関わらず、教員17人が負傷させられ、そのうち10人が逮捕されました。 

監視機構は、人権活動を制裁することのみが目的と思われるこの11人の労働組合活動家の有罪判決を憂慮し、トルコ当局に対し、すべての恣意的な訴状を取り下げるよう、要請します。

<行動要請>

 トルコ関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、トルコで平和的なデモに参加した人びとの心身の安全を保障すること。

2.上記の11人の人権擁護家たちに対する嫌疑は恣意的です。それらが取り下げられるよう、彼らを

公正で中立な控訴審に付すよう保障すること。

3.トルコの人権擁護家に対するあらゆる形態の嫌がらせおよび虐待を停止し、いかなる情況にあろうとも、人権擁護家と人権組織が妨害なくその活動を遂行できるよう保障すること。

4.1998年12月9日国連総会が採択した人権擁護家に関する宣言の条項、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項にしたがうこと。

5.トルコが批准しているILO第87および98条約(結社の自由と、組織する権利の保護に関する条約)の条文を守ること。

6.国際人権基準およびトルコが批准した国際人権文書に沿って、国内全土における人権尊重と基本的 自由を保障すること。

I am writing you to express my concern over the sentencing of 11 trade union leaders. As the charge against them are arbitrary, I would like to urge you the followings:

1. To guarantee in all circumstances the physical and psychological integrity of peaceful demonstrators in Turkey;
2. To ensure that the eleven human rights defenders be granted a fair and impartial trial in appeal so that the charges against them be dropped as they are arbitrary;
3. To end all forms of harassment and ill treatment of human rights defenders in Turkey, and guarantee in all circumstances that human rights defenders and organisations are able to carry out their work without any hindrance;
4. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
5. To conform with the provisions of the Conventions 87 and 98 of the International Labour Organisation on freedom of association and protection of the right to organise, ratified by Turkey;
6. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Turkey.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Turkey.

Brief description of the situation:

The Observatory has been informed by the International Trade Union Confederation (ITUC) about the sentencing of eleven trade union leaders.

According to the information received, on April 4, 2007, 11 Executive Committee members of a number of unions, which all belong to the Confederation of Public Employees’ Unions (KESK), were all sentenced to one year and three months’ imprisonment and a fine of 407 YTL (about 223 euros) each, for having violating Law n° 2911 on Public Meetings and Demonstrations.

These trade union leaders are: Dr. Ismail Hakki Tombul, KESK President, Mr. Alaaddin Dincer, President of Egitim Sen, Mr. Bulent Kaya, former President of the Municipality Workers’ Union (BES), Mr. Koksal Aydin, President of the Trade Unions of Public Employees in Health and Social Services (SES), Mr. Bedri Tekin, President of the Construction and Roads Workers’ Trade Union (YAPI YOL Sen), Mr. Fehmi Kutan, former President of the United Union of Transport Employees (BTS), Mr. Emirali Simsek, Secretary General of Egitim Sen, Mr. Ozgur Bozdogan, President of Egitim Sen Ankara Branch n°1, Mr. Abdullah Ciftci, President of Egitim Sen Ankara Branch n° 2, Mr. Erkan Sumer, SES Secretary General, and Mr. Murat Kahraman, Executive Committee member of Egitim Sen Ankara Branch n° 1.

While the sentences of nine of the above-mentioned trade union leaders were suspended, the sentences for Mr. Ismail Hakki Tombul and Mr. Fehmi Kutan were not. If these sentences were to be confirmed by the Turkish Higher Court of Appeal, both union leaders would be sent to prison. As of the date of issuing this urgent appeal, no date for the hearing in appeal had been set up.

These eleven trade union leaders were prosecuted following a peaceful teachers’ demonstration organised by Egitim Sen in Ankara on November 26, 2005, which was forcibly repressed by the police. 17 teachers were injured, and ten of them arrested, merely for exercising their legitimate trade union rights.

The Observatory expresses its deep concern about the sentencing of these eleven trade union leaders, which seems to merely sanction their human rights activities, and calls upon the Turkish authorities to drop all arbitrary charges against them.

Actions required:

Please write to the authorities of Turkey urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of peaceful demonstrators in Turkey;

ii. Ensure that the eleven human rights defenders above-mentioned be granted a fair and impartial trial in appeal so that the charges against them be dropped as they are arbitrary;

iii. End all forms of harassment and ill treatment of human rights defenders in Turkey, and guarantee in all circumstances that human rights defenders and organisations are able to carry out their work without any hindrance;

iv.
