No.3949 ウズベキスタン:ジャーナリストで人権侵害被害者の支援活動をしている人が脅迫を受 けています。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ウズベキスタンにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<新情報>

人権擁護家のための監視機構は信頼できる情報筋より、サマルカンドのジャーナリストで活動的な人権擁護家であるカミル・アシュロフさんが脅迫や嫌がらせを受けているという情報を入手しました。アシュロフさんは人権侵害の被害者に対する無料の法律相談や裁判での弁護活動、虐待の監視や通報などを行っています。

入手した情報によると、2007年5月18日、カミル・アシュロフさんはサマルカンドの「ルーク・オボド」モスク内で金曜の礼拝のあとに侮辱され、殴打されました。金曜の礼拝が始まる午後12時20分頃、サマルカンドのアロフィというマハラ(地域共同体)に古くから住む住人の1人が何人かの人を集め、これからカミルがモスクに礼拝に来るが、カミルは「大統領を批判した」ので二度とモスクに来ないよう、皆で彼を殴打しようと呼びかけました。この男性はさらにウズベキスタン治安局(SNB)がこの行為を支援しているとも言いました。しかし群衆はこの男性に立ち去れと言いました。

午後1時頃、カミル・アシュロフさんがモスクに到着し、兄のユルダシュ・アシュロフさんに会いました。兄は状況をカミルさんに伝え、SNBの人間がモスク周辺にたくさん来ていると言いました。

礼拝後、アシュロフさんはモスクから出て、兄を待っていました。先ほどのアロフィ・マハラの住民は仲間を集められなかったので1人でアシュロフさんの腕をつかみ、モスクの玄関に行くように言いました。この高齢の男性はアシュロフさんの20歳頃の写真を服のポケットから取り出し、この写真の人物はアシュロフさんかと尋ねました。アシュロフさんがそうだと言うと、この男性はアシュロフさんをののしりはじめ、お前に大統領を批判する権利はないと言いました。また、モスクを訪れていた大勢の人の前でアシュロフさんの顔面を殴りました。アシュロフさんがなぜこんなことをするのかと尋ねると、この老人はヒステリックに「お前は蛇だ、サソリだ、我々はお前を殺さなければならない」と言いました。

この出来事を見た多くの人がこの老人に向かって、なぜ礼拝に来た人を殴るのかと尋ねました。そうすると老人は「なにが礼拝だ?彼は信者ではない。もし家の中で蛇やサソリを見つけたら殺すだろう。彼は蛇なのだ。我々は彼を殺さなければならない」と言いました。またこの老人は、数人のSNB職員が家を訪ねてきて、アシュロフさんはイスラム教徒ではなくキリスト教徒に改宗した人物なので、モスクから追放しなければならないと言ったと言いました。また、アシュロフさんの写真と、彼が大統領を批判した記事を手渡されたとも言いました。

さらに、イマームーハティーブ(礼拝指導者)とその補佐がカミル・アシュロフさんのところに来て、二度とモスクに来るなと言いました。アシュロフさんは、この老人の行為の背後に誰がいるか分かっているので、彼の行為に腹も立てていないし、侮辱された気もしていないと言いました。しかしこの老人は再びやってきて、アシュロフさんにモスクに来てはならないと言い、殴りました。

さらに、SNBの人間が20人ほど周囲におり、車の中から事件をビデオにとっていました。

監視機構はこの暴行がカミル・アシュロフさんの人権擁護活動に関連があると信じ、政府に対し、彼および国内のすべての人権擁護家の心身の安全を確保するために必要なあらゆる措置を講じるよう要請します。

<行動要請>

 ウズベキスタン関係当局に以下の内容の要請をお願いします。

1. いかなる情況にあろうとも、カミル・アシュロフさんの心身の安全を保障すること。

2. 実行者を裁判に付し、犯罪の重さに応じて判決を言い渡すために、これら事件に公正で独立した調査を行うこと。

3. カミル・アシュロフさんのおよび国内の人権擁護家に対するあらゆる形態の嫌がらせと脅迫を止めること。

4. 1998年12月9日、国連総会が採択した国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

5. 国際人権基準およびウズベキスタンが批准した国際文書に従って、国内全土における人権尊重と基本的自由を保障すること。

Dear President Karimov,

I am writing you to express my concern over the situation of Mr. Kamil Ashurov, who is a journalist and an active human rights defender in Samarkand. Among others, Mr. Ashurov provides free legal consultation to victims of human rights violations, legal defence in court, and monitoring and reporting upon abuses. I would like to urge you the followings:

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Kamil Ashurov;
2. To conduct a fair, impartial and independent inquiry into the events above-mentioned, in order to bring the authors to justice and pronounce sentences proportional to the gravity of their crimes;
3. To put an end to all acts of harassment and threats against Mr. Kamil Ashurov as well as against all human rights defenders in the country;
4. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Uzbekistan.

URGENT APPEAL - THE OBSERVATORY

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Uzbekistan.

New information:
The Observatory has been informed by reliable sources about the threats and acts of harassment against Mr. Kamil Ashurov, a journalist and an active human rights defender in Samarkand. Among others, Mr. Ashurov provides free legal consultation to victims of human rights violations, legal defence in court, and monitoring and reporting upon abuses.

According to the information received, on May 18, 2007, Mr. Kamil Ashurov was insulted and beaten in the area of “Rukh obod” mosque of Samarkand, soon after Friday’s prayers. Around 12.20 p.m, before Friday prayers had started, an old resident of “Allofi” Makhalla of Samarkand gathered some people to inform them that Mr. Kamil was coming to the mosque to pray and tried to encourage them to beat Mr. Kamil, so as to discourage him form visiting the mosque in the future, because “he dared to criticize the President”. The man also said that the Uzbek Security Services (SNB) supported this action. However, the crowd asked the old man to leave the place.

Around 1.00 p.m., Mr. Kamil Ashurov arrived at the mosque where he was met by his elder brother, Mr. Yuldash Ashurov, who informed him of the situation and of the fact that many SNB people had gathered around the mosque.

After the prayer, Mr. Ashurov left the mosque and waited for his brother outside. Because the old resident of “Allofi” Makhalla of Samarkand had failed to find supporters, he decided to act alone and, grabbing Mr. Ashurov’s arm, asked him to go to the entrance of the mosque. The old man took a twenty-year-old picture of Mr. Ashurov out of his pocket and asked if it was him. When Mr. Ashurov confirmed the fact, the man started insulting him and told him that he did not have any right to criticise the President. He also started hitting Mr. Ashurov in his face in front of many mosque visitors. When Mr. Ashurov asked why he was doing this, the old man hysterically said, “you are a snake, a Scorpio and we should kill you…”.

Many people who witnessed this incident asked the old man why he was beating a person coming to pray. The old man said: “What prayers He is not a believer. If you find a snake or a Scorpio in your house, you will kill it. So is he like a snake and we need to kill him”. He also added that he had been visited by some SNB members who had told him that Mr. Ashurov was not a Muslim but a converted Christian, and that he therefore had to be exiled from the mosque. He added that the SNB gave him Mr. Ashurov’s picture and an article where he allegedly had criticised the President.

Furthermore, the Imam-Khatib and his Deputy approached Mr. Kamil Ashurov to order him not to come to the mosque anymore. Mr. Ashurov told them that he was not offended by the old man or insulted by his actions, as he understood who was actually behind them. But the old man came again close to Mr. Ashurov, told him that he should not come to this mosque and hit him once again.

Moreover, dozen of SNB people were around the place and filmed the incident from their cars.

The Observatory believes that this assault might be linked to Mr. Kamil Ashurov’s work of in defence of human rights and urges the government to take all the necessary measures to ensure his physical and psychological integrity as well as of all human rights defenders in the country.

Actions required:

Please write to the Uzbek authorities urging them to:
i. Guarantee in all circumstances the physical and psychological integrity of Mr. Kamil Ashurov;
ii. Conduct a fair, impartial and independent inquiry into the events above-mentioned, in order to bring the authors to justice and pronounce sentences proportional to the gravity of their crimes;
iii. Put an end to all acts of harassment and threats against Mr. Kamil Ashurov as well as against all human rights defenders in the country;
iv.
