No. 3951 イラン:人権弁護士が革命裁判所で無罪を言い渡されました。

(ジュネーブ・パリ発 5月30日)

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、イランにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は「人権擁護のためのイラン同盟(LDDHI)」から、テヘラン弁護士会所属で「人権擁護活動家センター(DHRC)」設立者のアブドルファッター・ソルタニさんが、革命裁判所で無罪になったという情報を入手しました。

監視機構はソルタニさんの無罪を歓迎し、彼のために行動して下さった個人および団体の皆さまにお礼申し上げます。

<背景情報>

アブドルファッター・ソルタニ弁護士は2005年7月30日に、サイード・モルタザヴィ検事が彼に対して逮捕状を出したことに抗議してテヘラン弁護士会で座り込みをしていて逮捕されました。逮捕状は「スパイ活動」に対するものですが、それ以上は何も説明がありませんでした。

 2005年7月31日、司法省の広報官が、ソルタニさんは弁護しているイランの核に関する機密漏洩の嫌疑をかけられている人物から違法に情報を漏らしたために逮捕されたと発表しました。2005年12月3日、彼の件を調査する裁判官が、さらに3ヶ月の予備拘禁を決定しました。彼は弁護人の1人に接見できた2006年1月までエビン刑務所で隔離拘禁されていました。

国内および国際社会の連帯のおかげで、ソルタニさんは10万ユーロの保釈金で2006年3月6日に保釈されました。

2006年7月16日、拘禁中に拷問と虐待を受け2003年7月に死亡した、イラン系カナダ人写真家ザフラ・カゼミさんの初期調査が部外秘だったのを守らなかったという理由で5年の刑期と市民権の剥奪の判決をテヘラン革命裁判所が言い渡したということをソルタニさんは知らされました。カゼミさんの遺族を代理するソルタニさんは、サイード・モルタザヴィ検事など事件に関わったと言われる主だった公務員が起訴されていないと指摘し、裁判の独立性と公平性に疑問を呈していました。ソルタニさんはこの判決に対して控訴しました。

<行動要請>

 イラン関係当局に以下の内容の要請をお願いします。

1. いかなる情況にあろうともアブドルファッター・ソルタニさんおよびイランのすべての人権擁護家の

心身の安全を保障すること。

2.イランのすべての人権擁護家に対する司法上の嫌がらせも含めあらゆる形態の報復行為を即時停止すること。

3.1998年12月9日に国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

4.国際人権基準とイアンが批准した国際人権文書に沿って、国内全土における人権尊重と基本的自由を保障すること。

Your Excellency Ayatollah Khamenei,

While I would like to welcome the acquittal of Mr. Abdolfattah Soltani, a lawyer at the Bar of Tehran and a founding member of the Defenders of Human Rights Centre (DHRC), by the Revolutionary Court of Tehran, I still remain concerned about the human rights situation in your country.
I would like to urge you the followings:

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Abdolfattah Soltani and all human rights defenders in Iran;
2. To put an immediate end to any kind of reprisals - including judicial harassment - against all human rights defenders in Iran;
3. To conform in any circumstances with the provisions of the Declaration on Human Rights Defenders, adopted on December 9, 1998 by the United Nations General Assembly, in particular its article 1, which states that “everyone has the right, individually or in association with others, to promote the protection and realisation of human rights and fundamental freedoms at the national and international levels”, and articles 12.2 which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
4. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Iran.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information on the following situation in the Islamic Republic of Iran.

Description of the situation:

The Observatory has been informed by the Iranian League for the Defence of Human Rights (LDDHI) of the recent acquittal of Mr. Abdolfattah Soltani, a lawyer at the Bar of Tehran and a founding member of the Defenders of Human Rights Centre (DHRC), by the Revolutionary Court of Tehran.

The Observatory welcomes Mr. Soltani’s acquittal and thanks all the persons, organisations, and institutions that intervened in his favour.

Background information:

Mr. Abdolfattah Soltani was arrested on July, 30, 2005 while taking part in a sit-in at the Bar of Tehran in order to protest against the arrest warrant issued against him by Mr. Said Mortazavi, the Prosecutor of Tehran, on July 27, 2005, for “espionage”, without any other precisions.

On July 31, 2005, a spokesman for the Ministry of Justice announced that Mr. Soltani had been arrested for having illegally disseminated information from one of his clients who was charged with revealing Iran’s nuclear secrets. On December 3, 2005, the investigating judge in the case against Mr. Soltani decided that the latter should remain in pre-trial detention for a period of three additional months. Mr. Soltani was detained incommunicado at the Evin Prison up to January 2006, when he was allowed to meet one of his lawyers,.

On March 6, 2006, Mr. Soltani was released after a bail of 100,000 euros was paid thanks to national and international solidarity.

On July 16, 2006, he was informed that the Revolutionary Court of Tehran had sentenced him to a five-year prison term and to the loss of his civic rights, for failing to respect the confidentiality of the preliminary inquiry into the case of Ms. Zahra Kazemi, an Iranian-Canadian photographer who died in 2003 from acts of torture and ill-treatments to which she was subjected during her detention. Mr. Soltani, the Kazemi family's lawyer, had questioned the independence and fairness of the trial, stressing that the main officials allegedly involved in the case had not been prosecuted by the court, including Mr. Said Mortazavi. Mr. Soltani appealed against this judgment.

Actions requested:
Please write to the Iranian authorities and ask them to:

Guarantee in all circumstances the physical and psychological integrity of Mr. Abdolfattah Soltani and all human rights defenders in Iran;

Put an immediate end to any kind of reprisals - including judicial harassment - against all human rights defenders in Iran;
