No.3952 ネパール:人権擁護家で当局の責任を公に追及してきた弁護士が当局より脅迫を受けています。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ネパールにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は信頼できる情報筋より、弁護士、ジャーナリスト、人権活動家のジットマン・バスネットさんが脅迫を受けているという情報を入手しました。

入手した情報によると、2007年5月21日午後6時15分頃、バスネットさんのところにカトマンズのスワヤンブにある公衆電話から電話がかかり、彼がネパールの免責の問題に取り組んでいることに対して「どのようなことになろうと覚悟しろ」と脅迫されました。

バスネットさんは数年にわたって内紛の被害者のために活動してきました。2006年9月に彼は最高裁判所に対して職務執行令状の発令を申し立て、ネパールで最近起きている人権侵害と、2005年5月に国連人権高等弁務官ネパール事務所(OHCHR-Nepal)が政府に提出した失踪事件を調査するハイレベル委員会の設置を要求しました。彼はまた、ギャネンドラ国王と軍幹部が最高裁判所に虚偽の情報を提供したと訴えました。ギャネンドラ国王はネパール王国軍の最高指揮官であるため、指揮の責任があるとしてこれらの事件で言及されました。

2007年3月、バスネットさんはアドボカシー・フォーラム・ネパールとアジア人権委員会(AHRC)の支援を受けてバイラブナト歩兵大隊の施設に長期間拘禁された経験を「258日の闇の日々」という本にまとめ、出版しました。この本はバイラブナト駐屯地の兵士に拷問を受けたり、レイプされたり、殺害されたり、失踪させられたりした他の被拘禁者についても書かれており、少し前の混乱して血塗られたネパールの状況について伝えるとともに、免責が今も蔓延していることに懸念を表しています。

2004年2月4日にバスネットさんはカトマンズのバイラブナト歩兵大隊のメンバーに逮捕され、258日間にわたって恣意的に拘禁され、拷問を受けました。釈放後もバスネットさんは繰り返し軍から嫌がらせを受け、その結果カトマンズを離れなければなりませんでした。彼はネパールに帰るまでインドで約17ヶ月過ごしました。

監視機構はバスネットさんが受けた威嚇と脅迫に深い憂慮を表明します。最近、ネパールにおける人権擁護家の状況は改善されているように見えますが、この脅迫事件は、同国でまた人権擁護家が攻撃を受けていることを示しているのかもしれません。

<行動要請>

 ネパール関係当局に以下の内容の要請をお願いします。

1. いかなる情況にあろうともジットマン・バスネットさんの心身の安全を保障すること。

2.実行者を裁判に付し、罪の重さに比例した判決を言い渡せるよう、これら事件について公平、中立、独立した調査を実施すること。

3.ジットマン・バスネットさんおよび国内のすべての人権擁護家に対するあらゆる形態の嫌がらせおよび脅迫を止めること。

4.1998年12月9日に国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

5.いかなる情況にあろうとも、国際人権基準とネパールが批准した国際文書に沿って、国内全土における人権尊重と基本的自由を保障すること。

2. To conduct a fair, impartial and independent inquiry into the events above-mentioned, in order to bring the authors to justice and pronounce sentences proportional to the gravity of their crimes;
3. To put an end to any act of harassment and threat against Mr. Jitman Basnet as well as against all human rights defenders in the country;
4. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Nepal.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Nepal.

Brief description of the situation:

The Observatory has been informed by reliable sources about threats against Mr. Jitman Basnet, a lawyer, a journalist and a human rights activist in Nepal.

According to the information received, on May 21, 2007, Mr. Basnet received an anonymous call at around 6.15 pm, from a public telephone booth in Swayambhu, Kathmandu, in which he was threatened to “bear the results” of his engagement in the struggle against impunity in Nepal.

Indeed, Mr. Basnet has been working in favour of conflict victims for several years. In September 2006, he filed a writ of mandamus before the Supreme Court, demanding that a High Level Committee be formed to investigate into human rights violations that took place during the recent conflicts in Nepal, as well as into the cases of disappearances that UN Office of High Commissioner for Human Rights-Nepal (OHCHR-Nepal) submitted to the government in May 2005. He also accused King Gyanendra and army officials for supplying false information to the Supreme Court. King Gyanendra is cited in these cases as he was the Chief of the Royal Nepal Army and therefore bears command responsibility.

In March 2007, Mr. Basnet also published a book entitled 258 Dark Days, with the help of Advocacy Forum Nepal and the Asian Human Rights Commission (AHRC), relating to his prolonged custody in Bhairabnath Battalion’s facilities. Indeed, the book also covers the stories of many other detainees who were tortured, raped, killed and/or disappeared at the hands of the Bhairabnath Barracks’ personnel, giving an insight into Nepal’s turbulent and bloody recent past, concerning which impunity still prevails.

On February 4, 2004, Mr. Basnet was arrested by members of the Bhairabnath Army Battalion, Kathmandu, and then arbitrarily detained incommunicado for 258 days and tortured[1]. After his release, Mr. Basnet was repeatedly harassed by members of the army and, as a result, finally left Kathmandu. He spent some 17 months in India before returning to Nepal.

The Observatory expresses its deep concern on the intimidation and threats to which Mr. Basnet has been subjected to. Even though the situation of human rights defenders in Nepal seems to have improved recently, this case of intimidation may announce further attacks on human rights defenders in the country.

Actions required:

Please write to the Nepalese authorities urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Mr. Jitman Basnet;

ii. Conduct a fair, impartial and independent inquiry into the events above-mentioned, in order to bring the authors to justice and pronounce sentences proportional to the gravity of their crimes;

iii. Put an end to any act of harassment and threat against Mr. Jitman Basnet as well as against all human rights defenders in the country;

iv.
