No.3953　バングラデシュ：アワミ同盟の関係者4人が恣意的に逮捕されて拷問を受け、内2人が死亡しました。

　 SOSトーチャー国際事務局は、バングラデシュにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

＜事件の概要＞

SOSトーチャー国際事務局はSOSトーチャーのネットワークのメンバー団体であるODHIKARより、チッタゴンのコックス・バザールでジャハンギール・アラムさん（28歳）が海軍で拘禁中に拷問を受けて死亡し、ザカリアさんという人（40歳）が警察で拘禁中に拷問を受けて死亡したという情報を入手しました。

情報によると、バングラデシュ・アワミ同盟の青年部であるジュボ・リーグのテクナフ支部の地元リーダーだったジャハンギール・アラムさんが2007年5月3日に海軍のコックス・バザールのテクナフ地方隊に逮捕されました。彼は私服を着た4、5人の男に蹴られたり殴られたりし、ジープに引きずり込まれました。アラムさんが病院に連れていかれたのはその日の午後7時45分でした。その後、彼はテクナフ警察に移送されました。2007年5月4日、アラムさんの状態は悪化したため病院に再び運び込まれましたが、間もなく死亡しました。

ODHIKARによれば、電気ショックか熱湯による火傷のあとが彼の手首、かかと、腕にあり、また、蹴られたことによるあざや負傷のあとが手のひら、足裏、膝、大腿部、首、腕、腰にありました。

テクナフ警察では2007年5月4日付で変死事件の扱いとなったということですが、捜査官のランジット・ボルア警部補は検死によってアラムさんが拷問されて死亡したということが証明されなければ調査しないということです。

さらに、2007年3月28日午前1時頃、故イブラヒム・シクデルの息子であり、ポホルチャンダのビビルキリ村の住民であるザカリアさんがチョコリア警察のアブル・カラム警部補率いる警官らに逮捕されました。この逮捕は、バンダルバンのラマ警察が彼にかけた嫌疑に基づいていました。この時、ザカリアさんは土地争議をめぐるある事件で保釈中でした。彼の妻のマシュカ・ベグムさんによると、夫婦は保釈命令書を見せましたが、役に立ちませんでした。ザカリアさんと同じ事件で保釈中だったヘラル・ウッディンさん（36歳）とアブル・ホッソンさん（30歳）も逮捕されました。

マシュカ・ベグムさんがその日の午前7時に夫に面会するためチョコリア警察に行きました。夫の依頼もあり彼女が一人の警官に釈放を願い出たところ、その警官は550タカを出せば、カラム警部補が後からザカリアさんを釈放すると請け合いました。しかし、ザカリアさんはヘラル・ウッディンさん、アブル・ホッソンさんと共に正午頃、裁判所に出頭させられました。裁判所は彼らの保釈命令書を調べ、この3人の釈放を命じました。しかし、彼らは午後7時頃に警察に連れ戻されました。

午後8時半頃、2人の警官がザカリアさんを警察の外に連れだし、人力車に乗せました。警官の1人が彼の首を支え、もう1人が足を持っていました。この警官2人はザカリアさんの妻に、夫は病気なので病院に連れていくよう言いました。ザカリアさんはチョコリア・ウパジラ保健施設に到着した時、死亡を宣告されました。

ヘラル・ウッディンさんによると、彼ら3人は警察で殴打され、裁判所から警察に戻った時も殴打されたということです。警察は彼らをロープできつく縛り上げたということです。房に連れていかれる時も、ひどくこづかれたため格子にぶつかり、肋骨を負傷したということです。ヘラル・ウッディンさんによると、ザカリアさんは思い切り床に蹴り倒されて深刻な傷を負ったということです。彼によると、コップ１杯の水を飲んだ後、ザカリアさんは身もだえし、そして死亡したということです。警官は彼を房から連れだし、意識がなくなるまで殴打しました。

アブル・ホッソンさんはつま先を警官に靴で踏まれ、あざができました。また警察の殴打により背中が痛み、またこのことを誰にも言うなと脅迫されたということです。

ヘラル・ウッディンさんとアブル・ホッソンさんは後に警察から釈放されました。

マシュカ・ベグムさんが地元の軍の基地に助けを求めると、ある将校が彼女に、警察を告訴することはできるが、それは「あなたに何もいいことをもたらさない」し「あなたと警察の両方にとってやっかいなことになる」と言いました。マシュカ・ベグムさんは夫の遺体を検死も受けずに自宅に連れ帰りました。周囲の誰もそのようなことについて知識がないため、誰も彼女を助けることはありませでした。さらに、警察に殺人事件として届けようとすると、警察はその申し立てを受理するのを拒否しました。

2007年4月5日、マシュカ・ベグムさんはアクタルザマン治安裁判所に、刑法第109/302/34節に基づき殺人事件を記録するよう、陳情書第400/2007号を提出しました。この陳情書にもとづき、同裁判所はチョコリア警察に事件を再調査するよう命じました。

ODHIKARがインタビューしたチョコリア警察のシディキ署長はそのような事件は自分の警察署では起きていないと主張し、ザカリアさん、ヘラル・ウッディンさん、アブル・ホッソンさんが2007年3月18日に保釈されていたにもかかわらず、警察にはその命令書のコピーは3月27日まで届かなかったと言いました。

SOSトーチャー国際事務局は、ジャハンギール・アラムさん、ザカリアさん、ヘラル・ウッディンさん、アブル・ホッソンさんが拷問を受けたこと、そしてジャハンギール・アラムさんとザカリアさんがその結果死亡したことを非常に憂慮します。また、国際事務局はバングラデシュが拷問等禁止条約を批准しているにもかかわらず、その義務を遵守していないことを非常に懸念します。またバングラデシュに対し、「市民的及び政治的権利に関する国際規約(ICCPR)」の第7条と9(1)条が加盟国に対し、「何人も、拷問又は残虐な、非人道的な若しくは品位を傷つける取扱い若しくは刑罰を受けない。」「何人も、恣意的に逮捕され又は抑留されない。」としていることを指摘します。

国際事務局はジャハンギール・アラムさんとザカリアさんの死亡状況について責任ある者を特定するために徹底的かつ公平な調査に着手し、加害者を裁判に付し、法律に基づいて刑法上と行政法上の制裁を適用するよう、当局に要請します。

　バングラデシュ関係当局に以下の内容の要請をお願いします。

1．ヘラル・ウッディンさんとアブル・ホッソンさん並びに被害者の家族の心身の安全を保障すること。

2．責任者をすべて特定し、裁判に付し、法に基づき民事および行政罰を適用できるよう、これら事件およびジャハンギール・アラムさんとザカリアさんの死亡について、綿密で公正な調査を命じること。

3．被害者の家族に適切な補償が届くよう保障すること。

4．国内法および国際人権基準に沿って、国内全土における人権尊重と基本的自由を保障すること。

Arbitrary arrests / Acts of torture and ill-treatments / Death in custody

Geneva, 31 May 2007.

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in Bangladesh.

Brief description of the situation:

The International Secretariat of OMCT has been informed by ODHIKAR, a member the SOS-Torture network, about the alleged torture and subsequent death of Mr. Jahangir Alam, 28 years old, while in Naval custody, and of Mr. Zakaria (identified as such), 40 years old, while in police custody, in the District of Cox’s Bazaar, Chittagong.

According to the information received, Mr. Jahangir Alam, a local leader of the Jubo League in Teknaf, the youth wing of the Bangladesh Awami League, was arrested by the Navy in Teknaf, Cox’s Bazaar, on 3 May 2007. He was reportedly punched, kicked and beaten by four or five people, dressed as civilians, who then dragged him into a Jeep. He was brought to the hospital for the first time on 3 May at 7:45 pm, before being transferred to the Teknaf Police Station. On 4 May 2007, Mr. Alam was brought back to the hospital for a second time, after his condition had worsened, where he died almost immediately.

According to ODHIKAR, marks, probably due to burns by electric shock or pouring hot water, were found on Mr. Jahangir Alam’s body above the wrists and heels and in the arms as well as bruises and injuries in the palms and soles, below and on the knees, on the thighs, neck, arms and waist, due to kicks.

There was reportedly an unnatural death case filed in the Teknaf Police Station, dated of 4 May 2007, but the Investigation Officer Sub Inspector Ranjit Borua will investigate the case only if the post mortem report certifies that Mr. Alam was tortured to death.

Furthermore, on 28 March 2007, around 1 am, Mr. Zakaria, the son of late Ibrahim Shikder, was arrested at his residence in the village Bibirkhil, Pohorchanda, by members of the Chokoria Police Station, led by Sub-Inspector Abul kalam, on the basis of a case lodged against him at the Lama Police Station of Bandarban District. At that time, Mr. Zakaria was out on bail in another case against him over a land dispute. According to his wife, Mrs. Mashuka Begum, they would have showed the policemen the bail order, to no avail. Mr. Helal Uddin, 36 years old, and Mr. Abul Hosson, 30 years old, were also arrested, while out of bail in the same case as Mr. Zakaria.

When Mrs. Mashuka Begum went to the Chokoria Police Station at around 7 am the same day, her husband requested her to organise his release, for which she went to the police, who took 550 taka from her while assuring that her husband would be released after Sub-Inspector Kalam woke up. Instead, her husband was taken to court around noon, along with Messrs. Helal Uddin and Abul Hosson. The court, when checking their bail order, ordered that the three men be released. However, they were brought back to the police station around 7 pm.

At around 8.30 pm, two policemen brought Mr. Zakaria out of the police station and put him on a rickshaw. One policemen was supporting his neck and the other was holding his legs. The two policemen then asked his wife to take him to a doctor, claiming he was sick. Mr. Zakaria was declared dead at his arrival at the Chokoria Upazila Health Complex.

According to Mr. Helal Uddin, the policemen would have beaten the three of them while they were taken to the police station, and again when they were taken back from the court hearing. The police would indeed have used ropes to tie him up so firmly that he was in severe pain. When being taken to the lock up, he was pushed ahead so forcefully that he bumped against a grille and injured a rib. Mr. Helal Uddin further mentioned that Mr. Zakaria would have been pushed down on the floor while in prison, getting seriously hurt. After drinking a glass of water, his body started to convulse - according to Mr. Uddin, Mr. Zakaria was then dead. As the policemen took him of the lock-up, they went on beating him unconscious.

As for Mr. Abul Hosson, the police would have bruised his toes by stomping on them with their boots. He further reported that his back was aching due to the police beatings and that he had received threats not to disclose the incident.

Mr. Helal Uddin and Mr. Abul Hosson were released later from the police station.

When Mrs. Mashuka Begum went to the local army camp for help, an army officer told her that although she might be able to lodge a case against the police station, the case would “not bring any good to her” and would be “an unnecessary harassment to both her and the police”. Mrs. Mashuka Begum then took her husband’s body home without any post mortem being conducted: being ignorant of such matters, nobody had helped her in this respect. Furthermore, when Mrs. Begum went to the police station to file a murder case, the police station would have refused to accept her case.

On 5 April 2007, Mrs. Mashuka Begum submitted a petition numbered 400/2007 to the Court of Magistrate Akhtaruzzaman to record a murder case under the sections 109/302/34 of the Penal Code. With reference to her petition, the Magistrate ordered the Chokoria police station to re-investigate the case.

During his interview with Odhikar, the officer-in-charge of the Chokoria police station, named Siddiqi, claimed that no such incident had occurred in his police station and that although Mr. Zakaria, Mr. Helal Uddin and Mr. Abul Hosson had been granted bail on 18 March 2007, the police station received the copy of the order only on 27 March.

The International Secretariat of OMCT expresses its deep concern about the alleged acts of torture against Mr. Jahangir Alam, Mr. Zakaria, Mr. Helal Uddin and Mr. Abul Hosson, as well as about the subsequent death in custoy of Mr. Jahangir Alam and Mr. Zakaria,. Besides, OMCT is highly concerned that, although Bangladesh has ratified the UN Convention Against Torture, it has failed to comply with its obligations. Moreover, OMCT recalls to Bangladesh that according to article 7 and 9 1) of the International Covenant on Civil and Political Rights (ICCPR) to which it is a State party, “no one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment” and “no one shall be subjected to arbitrary arrest or detention”.

OMCT calls on the authorities to order a thorough and impartial investigation into the circumstances of the death of Mr. Jahangir Alam and Mr. Zakaria, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law.

Action requested:

Please write to the authorities in Bangladesh urging them to:

i. Guarantee the physical and psychological integrity of Mr. Helal Uddin and Mr. Abul Hosson as well as of the victims’ family;
ii. Order a thorough and impartial investigation into these events and into the circumstances of the death of Mr. Jahangir Alam and Mr. Zakaria, in order to identify all those responsible, bring them to trial and apply the civil penal and/or administrative sanctions as provided by law;
iii. Guarantee that adequate compensation is awarded to the victims’ family;
iv. Ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
