No.3970 インド：人権擁護家が恣意的に逮捕され起訴されました

「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、インドにおける下記の状況に関して皆様の緊急の働きかけをお願いします。
＜事件の概要＞
人権擁護家のための監視機構は信頼できる情報筋より、チャッティースガル州ライプール市の人権監視団体、「事実究明、記録、啓発フォーラム(FFDA)」のディレクターであるスバシ・モハパトラさんが恣意的に逮捕され、起訴されたという情報を入手しました。
情報によると、2007年7月17日午後3時50分頃、スバシ・モハパトラさんはライプール市にあるチャッティースガル州人権委員会の事務所で、チャッティースガル州のゴル・バザール警察に逮捕されたということです。逮捕された時、モハパトラさんは以前FFDAがこの委員会に通報したダリットの学生の事件（事件番号HRC/DRG/132/2007）(1)について、委員会の要請に応じて彼の回答（調査報告に対する彼の意見）を提出しようとしていました。モハパトラさんは、委員会の事務員のビノド・アグルワルさんが、この書類の提出の際に賄賂を要求したと主張しています。賄賂を拒否したモハパトラさんは暴行を受け、7人により事務所に監禁されたということです。具体的には、首の後ろを殴られ、汚い言葉でののしられたということです。
モハパトラさんは最初、委員会の共同書記の事務所に30分間拘禁されました。それから警官が2人来て、逮捕状や起訴状を提示せずに彼をゴル・バザール警察に連行し、拘禁しました。また、警官らは彼から携帯電話と財布を取り上げました。彼は同僚や家族に連絡をとることを許されませんでした。3時間ほど拘禁された後、彼はシティ・コットワリ警察に移送され、午後9時までナクサル党との関連について尋問されました。そしてゴル・バザール警察に連れ戻され、午後10時半に保釈されました。
モハパトラさんは、ビノドさんが提出した一次通報書(FIR)にもとづいたインド刑法の第186節（公務執行妨害）、第353節（公務員の職務遂行を暴行または脅迫により妨害する）、第294節（わいせつな行為や歌）、第506条（脅迫に対する罰）で起訴されました。これらの4つの罪は保釈が認められています。彼は2007年8月6日にライプール裁判所で開かれる裁判に出廷しなければなりません。
情報によると、モハパトラさんはゴル・バザール警察に苦情を申し立てましたが、同警察は供述調書をとらず、彼に対する虐待行為について捜査を開始しなかったということです。
モハパトラさんはFFDAのディレクターとして2001年から2007年の間にチャッティースガル州で起きた人権侵害事件を300件以上チャッティースガル州人権委員会に申し立てていました。チャッティースガル州では、マオイスト・グループ、治安部隊、準軍事組織による暴力が蔓延しています。もっとも最近では、2007年4月28日に同州ビジャプール地区のパンジェール村とサントシプール村で12人の少数民族の人々が州警察に超法規的に処刑された事件を、2007年5月15日付けの公開書簡で州人権委員会委員長代理宛に申し立てています。また彼は、申し立てられた訴えを毎月検討している同委員会の役割について質問し、同委員会が役に立っておらず、腐敗していると糾弾しました。
監視機構は、モハパトラさんの恣意的な逮捕と彼に対する司法手続きは、彼の人権活動に制裁を与えるだけのものと考えられるため深く憂慮します。ゆえに、監視機構はインド政府に対し、彼に対するすべての嫌がらせをやめるよう要請します。
(1) 2003年、ドゥディヤ村のイスワール・ダシさんはドゥルグ・ラジナンドゴーン・グラミン銀行から借りたお金を経済的理由から返せなくなりました。後に、彼の娘のサホダラさんがダリットの学生を支援するチャッティースガル州政府の奨学金を受けられることになりました。政府の奨学金はドゥルグ・ラジナンドゴーン・グラミン銀行を通じて支給されることになっていましたが、銀行は奨学金を全額支給することを拒否しました。銀行は、政府が教育のために支給しているこの奨学金から彼女の父親の借金分を差し引いたのです。FFDAは、チャッティースガル州人権委員会に陳情書を提出し、第三者機関による事実の徹底調査を求め、この調査期間中は銀行職員による違法行為をやめさせること、そしてサホダラさんへの奨学金をただちに支給することを要請しました。またFFDAはこれが珍しい事件ではなく、銀行が奨学金を親の借金の返済にあてるため、多くの学生が奨学金を失っていることを知りました。
＜行動要請＞
インド関係当局に以下の内容の要請をお願いします。
1．いかなる情況にあろうともスバシ・モハパトラさんの心身の安全のためにすべて必要な措置をとること。
2．実行者を特定し、裁判に付し、犯罪の重大性に応じた処罰を課すために、スバシ・モハパトラさん虐待の申し立てについて、公正・中立で独立した調査を実施すること。
3．スバシ・モハパトラさん並びにすべてのインドの人権擁護家に対する司法上の嫌がらせも含むすべての形態の嫌がらせ行為に終止符を打つこと。
4．1998年12月9日に国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第１条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。
5．世界人権宣言およびインドが批准した国際人権文書に沿って、人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the arbitrary arrest and proceedings against Mr. Subash Mohapatra, the director of the Forum for Fact-finding Documentation and Advocacy (FFDA), a human rights monitoring organisation in Raipur, Chhattisgarh. I would like to urge you the following:
1. To take all necessary measures to guarantee, in all circumstances, the physical and psychological integrity of Mr. Subash Mohapatra;
2. To conduct a fair, impartial and independent investigation into the allegations of ill-treatment against Mr. Mohapatra in order to identify the authors, bring them to trial and pronounce sentences proportional to the gravity of their crimes;
3. To put an end to any act of harassment, including judicial harassment, against Mr. Subash Mohapatra, as well as against all human rights defenders in India;
4. To comply with the provisions of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, in particular article 1, which states that “everyone has the right, individually or collectively, to promote the protection and fulfilment of human rights and fundamental freedoms at the national and international levels”, as well as article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
5. To guarantee the respect of human rights and fundamental freedoms in accordance with the Universal Declaration on Human Rights and other international human rights instruments ratified by India.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in India.
Brief description of the situation:
The Observatory has been informed by a reliable source about the arbitrary arrest and judicial proceedings against Mr. Subash Mohapatra, the director of the Forum for Fact-finding Documentation and Advocacy (FFDA), a human rights monitoring organisation in Raipur, Chhattisgarh..
According to the information received, on July 17, 2007, at around 15:50 pm, Mr. Subash Mohapatra was arrested in the office of Chhatisgarh State Human Rights Commission, in Raipur, by the Gol Bazar Police of Chhattisgarh. At the time of his arrest, Mr. Mohapatra was filing a reply (i.e. to submit his comments on the investigation report) upon request of the Commission, regarding a case of a Dalit student , FFDA had previously transmitted to the Commission (case no. HRC/DRG/132/2007). Mr. Mohapatra alleged that Mr. Binod Agrwal, a clerck for the Commission, asked him for money in order to file his comments. When he refused to pay the bribe, he was physically abused and prevented from leaving the office by a group of seven persons. In particular, they beat him on the back side of his neck, and abused him with flithy languages.
Mr. Mohapatra was first detained in the office of the Joint Secretary of the Commission for half an hour. Then, two police officers came and forcefully brought him into the Gol Bazar Police Station and put him into the hawalat (police custody), without showing any arrest warrant and/or any charge. They also took away his cell phone and his purse. Mr. Mohapatra was not allowed to inform to his colleagues and/or relatives. After being detained for three hours, Mr. Mohapatra was brought to the City Kotwali police station, where he was interrogated for his alleged connections to the armed Naxalite movement till 9:00 p.m. Mr. Mohapatra was then brought back to the Gol Bazar police station, before being released on bail at 10.30 pm.
Mr. Subash Mohapatra was charged under Sections 186 (“obstructing public servant in discharge of public functions”), 353 (“assault or criminal force to deter public servant from discharge of his duty”), 294 (“obscene acts and songs”) and 506 (“punishment for criminal intimidation”) of the Indian Penal Code on the basis of the First Investigation Report (FIR) submitted by Mr. Binod. All these four sections are offences that can receive bail. Mr. Mohapatra is expected to appear before the Judicial Magistrate Court of Raipur on August 6, 2007.
According to the information received, although Mr. Mohapatra lodged a complaint to the Gol Bazar Police, they did not lodge a FIR and thus did not open any investigation into the acts of ill-treatments against him.
As the Director of FFDA, Mr. Mohapatra has filed over 300 complaints to Chhattisgarh State Human Rights Commission on issues of human rights violations that occurred in the State during 2001-2007. Violence by Maoist groups, security forces and paramilitaries is indeed common in Chhattisgarh. Most recently, on May 15, 2007, Mr. Mohapatra wrote an open letter to the acting Chairperson of the State Human Rights Commission on extrajudicial killings in which 12 tribals of Panjer and Santoshpur village of Bijapur District of Chhattisgarh would have been killed by the State police on April 28, 2007. Mr. Mohapatra also questioned the role of the Commission in its monthly human rights review regarding the complaints filed with them, accusing the Commission of being ineffective and corrupt.
The Observatory is deeply concerned about the arbitrary arrest of Mr. Mohapatra as well as about the judicial proceedings against him, as they seem to merely sanction his human rights activities. As a consequence, the Observatory urges the Indian authorities to put an end to any kind of harassment against him.
Action requested:
Please write to the Indian authorities and ask them to:
i. Take all necessary measures to guarantee, in all circumstances, the physical and psychological integrity of Mr. Subash Mohapatra;
ii. Conduct a fair, impartial and independent investigation into the allegations of ill-treatment against Mr. Mohapatra in order to identify the authors, bring them to trial and pronounce sentences proportional to the gravity of their crimes;
iii. Put an end to any act of harassment, including judicial harassment, against Mr. Subash Mohapatra, as well as against all human rights defenders in India;
iv.
