No.3984 キルギス共和国:キルギス人権委員会の委員長が襲撃されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、キルギスにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構はキルギス人権委員会(KCHR)より、KCHR委員長のラマザン・ディリルダエフさんが襲撃されたという情報を入手しました。

情報によると、2007年9月13日、ディリルダエフさんはビシュケク市にある事務所兼住居が焼けているのを発見しました。事務所に入ると煙が充満しており、炭酸ガスと他の化学物質のにおいがしました。

2007年9月12日、このアパートの改修工事が終わった後、何人かの隣人が午後7時頃に部屋の中で何かが爆発するのを聞きました。後に、焼け焦げた物体が二つトイレで見つかりました。それらはトイレの排気口から中に投げ込まれたようです。

監視機構は、ディリルダエフさんが上海協力機構のいくつかの活動やキルギス市民に対するロシアの移民政策、ウイグル人少数民族に対する中国当局の迫害などを熱心に告発していたことを想起します。

また監視機構は、ここ数年ディリルダエフさんが嫌がらせを受けていたことを想起します。もっとも最近では2007年4月6日に見知らぬ人々に石を投げつけられました。それは、クルマンベック・バキーエフ大統領と野党党首のフェリックス・クロフ前首相が汚職に関わったことをはじめ、キルギス当局の政策をテレビ番組で批判した後のことです。またこの番組で彼は、2006年12月に採択された憲法草案が2005年5月の「チューリップ革命」で示された民主化への希望を考慮に入れていないと指摘しました(1)

さらに監視機構はKCHRが2003年11月に法的地位を剥奪されたことを想起します。これはKCHR内の政府に近い人びとが自主独立のKCHRの活動の信用を落とそうとして、同じ名前の団体を設立したからです。KCHRが再登録するためにはこの団体の登録を無効にしなければなりませんが、まだそれは実現できていません。また、ディリルダエフさんの家族も彼の人権活動のためにずっと標的になっています(2)

監視機構は、KCHR委員長に対する嫌がらせを強く非難し、キルギスは欧州安全保障・協力機構(OSCE)加盟国として「国連人権擁護家の保護のための宣言は、国内および国際レベルでの人権と基本的自由の保護と実現を人権擁護家が促進および取り組むことができるような環境を提供するような適切な法的および行政的手続きを採択し、実施する義務を国家に(課している)」を認め、「OSCE、その組織、フィールド・オペレーションおよび加盟国による人権擁護家に対する特別な注意、支援、保護の必要」を認識していることを指摘します(3)

<行動要請>

キルギス共和国関係当局に以下の内容の要請をお願いします。

1.ラマザン・ディリルダエフさんおよびキルギスのすべての人権擁護家の心身の安全を保障すること。

2.責任者を特定し、裁判に付し、法に基づき刑事罰を適用できるよう、これら事件について公正で中立な調査を実施すること。

3.キルギス人権委員会およびラマザン・ディリルダエフさん、さらにはキルギスのすべての人権擁護家に対するあらゆる形態の嫌がらせ行為を即時停止すること。

4.1998年12月9日国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条、「すべての人は、個々にまた他の者と共同して、すべての人権と基本的自由に関する意見、情報、知識を出版、発表もしくは他の者に伝える権利を有している」とした第6条(b)、そして「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

5.世界人権宣言およびキルギス共和国が批准した国際文書に従うこと。

Dear President Slievich,

I am writing you to express my concern about the reported attack on Mr. Ramazan Dyryldaev, the chairman of Kyrgyz Committee for Human Rights (KCHR) on September 13, 2007. I would like to urge you the followings:

1. To guarantee the physical and psychological integrity of Mr. Dyryldaev and of human rights defenders in Kyrgyzstan;
2. To conduct a fair and impartial investigation into the above-mentioned events in order to identify those responsible, bring them to trial and apply the penal sanctions as provided by law;
3. To put an immediate end to all acts of harassment against the KCHR and Mr. Dyryldaev and, more generally, against Kyrgyz human rights defenders or their families;
4. To conform with the provisions of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, in particular its article 1 which provides that "every person has the right, individually or collectively, to promote the protection and fulfilment of human rights and fundamental liberties at the national and international levels", 6.b, which reads that "everyone has the right, individually and in association with others [...] freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms" and 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the [...] Declaration";
5. To conform more generally with the provisions of the Universal Declaration of Human Rights and with the international instruments ratified by Kyrgyzstan.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the international Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in Kyrgyzstan.

Description of the situation:
The Observatory has been informed by the Kyrgyz Committee for Human Rights (KCHR) of an attack on its chairman, Mr. Ramazan Dyryldaev.

According to the information received, on September 13, 2007, Mr. Dyryldaev found that the KCHR office where he lives in Bishkek had been burnt out. Indeed, on entering the office, he noticed smoke all over the place as well as a smell of carbon dioxide and of other chemicals.

On September 12, 2007, as workers had just finished the renovation of the apartment, some neighbours heard a detonation from inside the flat around 7 p.m. Later, two unidentified and burnt-out items were found in the bathroom. They were apparently thrown out through the ventilation duct of the bathroom.

The Observatory recalls that Mr. Dyryldaev has been active in the denunciation of some of the activities of the Shanghai Organisation for Cooperation, of Russian migrant policy towards Kyrgyz nationals as well as of the persecution of the Uyghur minority by the Chinese authorities.

The Observatory further recalls that over the past years, Mr. Dyryldaev has been subjected to acts of harassment. Most recently, on April 6, 2007, he was violently attacked by unknown persons who threw stones at him, after taking part in a TV show in which he criticised the policy led by the Kyrgyz authorities, in particular the President of the Republic, Mr.Kourmanbek Bakiev, as well as the opposition leader and former Prime Minister, Mr.Felix Koulov, accusing them of being involved in cases of corruption. During this event, he had also insisted on the fact that the draft Constitution adopted in December 2006 had not taken into account the democratic aspirations of the May 2005 "Tulip revolution"[1].

Moreover, the Observatory recalls that KCHR has been deprived of its legal status since November 2003, after members of the Committee close to the government established an organisation bearing the same name and aimed at discrediting the activities of the independent KCHR. The organisation has still not been able to annul the registration of the surrogate organisation, which is a prerequisite to the re-registration of the organisation. Further, Mr. Dyryldaev's family members have regularly been targeted due to his human rights activities[2].

The Observatory strongly condemns this new act of harassment against the chairman of KCHR and recalls that as a member-State of the Organisation for Security and Cooperation in Europe (OSCE), Kyrgyzstan acknowledges that "the [...] UN Declaration on Human Rights Defenders [... places] a responsibility [...] on states to adopt and implement adequate legislation and administrative procedures that would provide for a conducive environment for human rights defenders to promote and strive for the protection and realization of human rights and fundamental freedoms at the national and international levels", and recognises "the need for particular attention, support and protection for human rights defenders by the OSCE, its Institutions and field operations, as well as by participating States"[3].

Action requested :
Please write Kyrgyz authorities urging them to:
i. guarantee the physical and psychological integrity of Mr. Dyryldaev and of human rights defenders in Kyrgyzstan;

ii. conduct a fair and impartial investigation into the above-mentioned events in order to identify those responsible, bring them to trial and apply the penal sanctions as provided by law;

iii. put an immediate end to all acts of harassment against the KCHR and Mr. Dyryldaev and, more generally, against Kyrgyz human rights defenders or their families;
