No.3998 イラン:女性の権利の活動家が恣意的に逮捕、拘禁されています。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、イランにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は信頼できる情報筋より、女性文化センターのメンバーであり、女性の人権に悪影響を及ぼしている法律の撤回を議員に求める運動である「百万人の署名」を行っている女性の人権の活動家であり、この運動のウェブサイトの編集者であるマルヤム・ホセインカーさんが逮捕され、拘禁されたという情報を入手しました。

情報によると、2007年11月17日、マルヤム・ホセインカーさんは革命裁判所の治安支部に召喚されました。この召喚は、文化・イスラム指導・司法省が女性NGOの筆頭である女性文化センターのウェブサイトの閉鎖命令を出した数日後でした。彼女は2時間以上尋問された後、「世論の妨害」、「反国家的プロパガンダ」、女性文化センターと「百万人の署名」キャンペーンサイトに真実でない記事を掲載したことによる「嘘の発表」の罪状で起訴されました。彼女は翌日午前9時に尋問のために革命裁判所に戻るよう命じられました。

2007年11月18日にホセインカーさんが裁判所に赴くと、逮捕状が出されてすぐに逮捕され、午後2時にエビン刑務所に送られました。

監視機構は、ここ2年の間に121人の女性の権利活動家が逮捕、尋問、有罪判決を受けており、この活動家たちを拘禁し、保釈することにより、政府は百万ユーロ以上の保釈金を獲得していることを想起します。

監視機構は、イラン当局による人権擁護家、とくに「百万人の署名」キャンペーンに関わっている女性の権利活動家に対する弾圧が強まっていることに憂慮を表明します。監視機構は、イラン当局がここ数ヶ月、平和的な集会の弾圧や人権擁護家の逮捕に暴力を使うことが増えていることを強く非難します。

監視機構は、イランが2006年に国連人権理事会のメンバー国に立候補することにより、「人権の促進と擁護において最高水準を支持する(1)」ことを言明し、この点に関してイランはずっと「人のステータスと人が本来的に持つ尊厳を守ること、および人権と基本的自由の促進と擁護に継続的に尽力してきた(2)」と主張したことを強調します。このような努力を継続するためイランは国際人権基準を遵守するよう、監視機構は要請します。

<行動要請>

 イラン関係当局に以下の内容の要請をお願いいたします。

1.いかなる情況にあろうとも、マルヤム・ホセインカーさんおよび「百万人の署名」運動に参加しているすべての活動家の心身の安全を保障すること。

2.マルヤム・ホセインカーさん拘禁は女性の権利のための彼女の活動に対する制裁であり、恣意的にしか思えないため、即時無条件で彼女を釈放すること。

3.「百万人の署名」運動に参加しているすべての女性活動家に対する恣意的な嫌疑をすべて取り下げること。

4.司法のレベルを含み、イランの人権擁護家に対するあらゆる形態の嫌がらせを停止すること。

5.1998年12月9日に国連総会が採択した国連人権擁護家に関する宣の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条、「すべての人は、個々にまた他の者と共同して、すべての人権と基本的自由に関する意見、情報、知識を出版、発表もしくは他の者に伝える権利を有している」とした第6条(b)、そして、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

6.世界人権宣言およびイランが批准した地域および国際文書に従って、国内全土における人権尊重と基本的自由を守ること。

I am writing you to express my concern over the arbitrary detention of Ms. Maryam Hosseinkhah, who is the campaigner for the "One Million Signatures." I would like to urge you the followings:

1. To guarantee in all circumstances the physical and psychological integrity of Ms. Maryam Hosseinkhah as well as all activists engaged in the "One Million Signatures" campaign;
2. To release Ms. Maryam Hosseinkhah immediately and unconditionally since her detention is arbitrary as it merely aims at sanctioning her activities in favour of women's human rights;
3. To drop all arbitrary charges against all women's rights defenders involved in the "One million signatures" campaign;
4. To put an end to all acts of harassment, including at the judicial level, against Iranian human rights defenders;
5. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", Article 6.b, which provides that "everyone has the right, individually and in association with others [...] freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms", and Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
6. More generally, to ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with the Universal Declaration of Human Rights and with international and regional human rights instruments ratified by Iran.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Iran.

Brief description of the situation:

The Observatory has been informed by reliable sources of the arrest and subsequent detention of Ms. Maryam Hosseinkhah, a member of the Women's Cultural Center and women's rights activist involved in the "One Million Signatures" petition campaign as well as editor of the site of the campaign, which seeks to put pressure on the Iranian legislators in order to withdraw provisions that have adverse effects on women's human rights.

According to the information received, on November 17, 2007, Ms. Maryam Hosseinkhah was summoned to the Security Branch of the Revolutionary Courts. This summoning intervened a few days after an order issued by the Ministry of Culture and Islamic Guidance and the Judiciary shut down the site of Women's Cultural Centre, a leading women's NGO. After having been interrogated for over two hours, Ms. Hosseinkhah was charged with "disruption of public opinion", "propaganda against the state", and "publication of lies" through the publication of untrue new items on the sites of the Women's Cultural Centre and of the "One Million Signatures" petition campaign. Ms. Hosseinkhah was ordered to return to the Revolutionary Courts for further interrogation on the following day at 9.00 am.

On November 18, 2007, when Ms. Hosseinkhah arrived in Court, an arrest order was issued against her and she was immediately arrested and transferred to Evin Prison at 2.00 pm.

The Observatory recalls that 121 women's rights activists have been arrested, interrogated, or sentenced in the past two years and the government has raised over one million euros by imprisoning the activists and releasing them on high bail.

The Observatory expresses its deep concern about the increasing repression of the Iranian authorities against human rights defenders, in particular women's rights activists involved in the "One Million Signatures" Campaign. The Observatory strongly condemns the increasing use of violence by the Iranian authorities over the past months in order to repress peaceful gatherings and to arrest defenders.

The Observatory further wishes to insist on the fact that Iran had committed to "uphold the highest standards in the promotion and protection of human rights"[1] by presenting its candidacy to the Human Rights Council 2006 election and had insisted in this regard on the fact that the country had "continuously put great efforts into safeguarding the status and inherent dignity of the human person as well as the promotion and protection of human rights and fundamental freedoms"[2]. In order to ensure the continuation of these efforts, the Observatory urges the Islamic Republic of Iran to conform with international human rights standards.

Actions requested:

Please write to the authorities in Iran urging them to:
i. Guarantee in all circumstances the physical and psychological integrity of Ms. Maryam Hosseinkhah as well as all activists engaged in the "One Million Signatures" campaign;
ii. Release Ms. Maryam Hosseinkhah immediately and unconditionally since her detention is arbitrary as it merely aims at sanctioning her activities in favour of women's human rights;
iii. Drop all arbitrary charges against all women's rights defenders involved in the "One million signatures" campaign;
iv. Put an end to all acts of harassment, including at the judicial level, against Iranian human rights defenders;
v.
