SOSトーチャー国際事務局はネパールにおける以下の状況に関して皆様の緊急の働きかけをお願いします。
<事件の概要>
SOS トーチャー国際事務局は信頼できる情報筋より、モヒット・ラムさんが警察で拘禁中に拷問を受け、現在も同じ警察の拘禁センターにいるので心身の安全が危惧されるという情報を入手しました。
情報によると、2007年10月29日午前3時頃、モラン郡在住のペンキ屋、モヒット・ラムさん(30歳、住所:Biratnagar sub-Metropolitan city-16, Majhuwa Tole)が友人のシラワン・チョードリーさんのモラン郡の家(住所:Biratnagara sub-Metropolitan city-7)で就寝中に逮捕されました。彼は、モラン地区警察のケダル・カドカ警部率いる警察チーム8、9人に、強盗の容疑で逮捕されました。警察はさらにシラワン・クマールさんの家を捜索し、自作のピストルと銃弾数発を押収しました。
モヒット・ラムさんはモラン地区警察で午前7時頃に尋問室に連れていかれ、私服警官5人に尋問されました。モヒット・ラムさんは、「5人の警官に尋問されました。名前は分かりません。彼らは、強盗に何人関わったのか、彼らの名前は、どのように強盗を行ったのか、などと質問しました」と記憶しています。
モヒット・ラムさんは強盗への関与を認めましたが、盗品は友人のところにあると尋問官に言ったということです。そうするとこの警官5人はモヒット・ラムさんを警棒でやたらと殴りはじめたということです。
モヒット・ラムさんによると以下の通りです。「警官らは怒って私を床に座らせました。彼らは私の手をロープで縛り、膝を曲げるよう命じました。棒が私の膝の下に通され、その棒で持ち上げられました。棒は2つの机の間に置かれ、私はそれに逆さまに吊り下げられました。警官は足裏を棒で叩き始めました。叩きながら、盗品や強盗仲間について尋問しました。半時間ほどにわたり、このような殴打と尋問が続きました。その後警官らは私の体を持ちあげ、足を離し、それから3、4分にわたってジャンプさせられました。それから拘禁室に戻されました。」
情報によると、モヒット・ラムさんは2007年10月30日午前7時頃、モラン地区警察の女性用の拘禁室に連れていかれたということです。彼は、「3人の警官が部屋の中から鍵をかけ、武器や盗んだものについて尋問しはじめました。私はスニル・チョードリーに武器を渡され、盗んだ金のありかについては分からないと答えました。警官らは再び私の手をビニールロープで縛り、膝を曲げさせました。また逆さ吊りにされ、5、6分間、棒で足裏を叩かれました。殴打が終わると今度は4、5分ジャンプを続けるよう命じられました。私はこの拷問で消耗し、ジャンプしている最中に倒れました。」と言いました。
モヒット・ラムさんは2007年10月31日、11月1日にも同じような身体的拷問を受けたことを暴露しています。彼はモラン郡地区警察の女性用の部屋で朝と夜の2回、名前のわからない警官3、4人に拷問されたということです。そして、2007年10月29日と30日と同じ質問を受けました。
モヒット・ラムさんはまた、尋問官らがこの拷問や虐待を人権活動家に話さないように忠告したと暴露しています。彼によると警官は、「人権活動家が訪ねてきたらすべて大丈夫だと言え。拷問のことをばらしたら、さらに2倍拷問されることになるぞ」と言ったということです。
情報によると、モヒット・ラムさんは2007年10月29日に8日間の再拘禁となり、11月4日にはさらに10日間の再拘禁となりました。そして11月14日に3回目の再拘禁が8日間と決められました。2007年11月15日の時点でモヒット・ラムさんはまだモラン地区警察で拘禁されています。彼はさらに拷問を受けているおそれがあり、当局は何の治療もしていません。彼は右肘を少しと、左足の甲を負傷しているといわれています。
国際事務局は、モヒット・ラムさんに対する拷問と、今も彼がモラン地区警察で拘禁されているために身の安全が懸念されることに憂慮を表明します。国際事務局は、加害者が制裁を受けないで済む風潮も非常に懸念します。ネパールは、拷問及びその他の残虐な、非人道的な又は品位を傷つける取り扱いを禁じる「国連拷問等禁止条約」と「市民的及び政治的権利に関する国際規約(ICCPR)」の締約国です。これらの条約のもとで負う責務に従い、ネパール当局は被害者による拷問と虐待の申し立てを真剣に考慮し、徹底的かつ公平な捜査を行わなければなりません。
<行動要請>
ネパール関係当局に以下の内容の要請をお願いします。
1. いかなる情況にあろうとも、モヒット・ラムさんの心身の安全を保障すること。
2. モヒット・ラムさんを別の拘禁施設に直ちに移送するよう命じること。
3. 弁護士、家族、そして必要な医療へのアクセスを無条件で保障すること。
4. 国際法と国際基準に合致する正当な嫌疑がない中、彼の即時釈放を命じること。もしそのような嫌疑が存在するならば、彼を公正で資格のある法廷に付し、その間の彼の手続き上の権利を保障すること。
5. 責任者すべてを特定し、裁判に付し、法に基づき刑事あるいは行政罰を課すために、これらすべての事件、とりわけモラン地区警察で警官から受けたと申し立てられている拷問について、綿密で中立な調査を命じること。
6. 被害者に適正な補償が提供されるよう保障すること。
7. 国内法および国際人権基準に沿って、国内全土における人権尊重と基本的自由を保障すること。

Dear Minister Sitaula,
I am writing you to express my concern at the alleged torture of Mr. Mohit Ram while in the police custody at the DPO, Morang. I would like to urge you the followings:
1. To guarantee, in all circumstances, the physical and psychological integrity of Mr. Mohit Ram;
2. To order the immediate transfer of Mr. Mohit Ram to another detention place;
3. To guarantee unconditional access to his lawyer, family and any medical treatment he may require;
4. To order his immediate release in the absence of valid legal charges that are consistent with international law and stanards, or if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;
5. To order a thorough and impartial investigation into these events, in particularly the alleged torture inflicted by police officers at DPO Morang, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
6. To guarantee that adequate compensation is awarded to the victim;
7. To ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Torture/ Fear for physical integrity/ Impunity
The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in Nepal.
Brief description of the situation
The International Secretariat of OMCT has been informed by a reliable source about the alleged acts of torture against Mr. Mohit Ram while in police custody and the fear for his psychological and physical integrity as he remains detained in the same police detention centre.
According to the information received, Mr. Mohit Ram, a 30 year-old house painter and permanent resident of Biratnagar sub-Metropolitan city-16, Majhuwa Tole, Morang district, was arrested at about 3:00 a.m. on 29 October 2007 while he was sleeping at his friend, Mr. Shrawan Chaudhari's home at Biratnagar sub-Metropolitan city - 7, Morang district. He was arrested on the charge of robbery by a team of eight-nine police personnel from the District Police Office (DPO), Morang, led by police inspector Mr. Kedar Khadka. The police also searched the house of Mr. Shrawan Kumar and seized a homemade pistol along with some bullets.
At the DPO, Morang, Mr. Mohit Ram was reportedly taken to an interrogation room at about 7 a.m. and interrogated by five plainclothes police personnel. Mr. Mohit Ram recalls, "some five unidentified plainclothes policemen interrogated me. They asked me questions like - how many people were involved in the robbery What were their names How did the robbery take place"
Mr. Mohit Ram reportedly admitted his involvement in the robbery but told the investigating officers that the stolen goods were with his friend. After which the five investigating officers allegedly started beating Mr. Mohit Ram indiscriminately with batons.
Mr. Mohit Ram added: "the policemen were angry and forced me to sit on the floor. They tied my hands in front of me with rope and asked me to bend my knees. A stick was then placed underneath my knees and I was lifted up by the stick. The stick was placed between two tables and I was made to swing upside down. The police started beating my feet with sticks. While beating me they interrogated me about the stolen goods and the other people involved in the robbery. I was beaten and interrogated in this way for about half an hour. Afterwards the police lifted my body, untied my legs, and forced me to jump up and down for about 3-4 minutes.I was then taken back to custody room."
According to the information, on 30 October 2007, Mr. Mohit Ram was taken to a room in the women cell of DPO Morang at about 7:00 a.m. Mr. Mohit Ram reportedly said, "three policemen bolted the room from the inside and started interrogating me about weapons and what was robbed. I replied that Sunil Chaudhari gave me the weapon and I didn't have any idea about the stolen money. The policemen again tied my hands with a synthetic rope and forced me to bend my knees. They made me hang upside down again and beat my feet with a stick continuously for about 5-6 minutes. After that the police stopped beating me but ordered me to jump up and down for about 4 - 5 minutes. I fell down on the floor while jumping because I was weak from the torture they had inflicted on me."
Mr. Mohit Ram reportedly disclosed that similar physical torture was inflicted on him again on 31 October 2007 and 1 November 2007. He was allegedly tortured in the women cell of DPO Morang twice a day, in the morning and evening by three-four unidentified police personnel who asked similar questions as those asked on 29 and 30 October 2007.
Mr. Mohit Ram also disclosed that the investigating officers reportedly told him not to mention any details of torture and other ill treatment to human rights activists. Mr. Mohit Ram quoted the investigating police as saying, "You have to say that everything was fine if you get a visit from human rights activists. If you complain about torture, you will get tortured twice as bad."
According to the information, Mr. Mohit Ram was remanded on 29 October 2007 for eight days and then again on 4 November 2007 for ten more days. He was remanded for the third time on 14 November 2007 for more eight days. As of 15 November 2007, Mr. Mohit Ram remains in detention at DPO Morang. He is afraid of suffering further torture and the police authority has not yet provided him with any medication. He has reportedly a small injury in the right elbow, and another injury in the upper part of the foot of the left leg.
The International Secretariat of OMCT expresses its deep concern about the alleged acts of torture against Mr. Mohit Ram and the particular risk for his safety as he remains detained at DPO Morang. OMCT is also very much concerned about the climate of impunity enjoyed by the perpetrators. OMCT recalls that Nepal is a State party to the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and the International Covenant on Civil and Political Rights (ICCPR), which both prohibit torture and cruel, inhuman or degrading treatment. In line with their obligations under these treaties, it is incumbent on the Nepalese authorities to consider seriously any allegations of torture and ill-treatment made by the victim, and to undertake a thorough and impartial investigation in this regard.
Action requested
Please write to the authorities in Nepal urging them to:
i Guarantee, in all circumstances, the physical and psychological integrity of Mr. Mohit Ram;
ii. Order the immediate transfer of Mr. Mohit Ram to another detention place;
iii. Guarantee unconditional access to his lawyer, family and any medical treatment he may require;
iv. Order his immediate release in the absence of valid legal charges that are consistent with international law and standards, or if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;
v. Order a thorough and impartial investigation into these events, in particularly the alleged torture inflicted by police officers at DPO Morang, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
vi. Guarantee that adequate compensation is awarded to the victim;
vii. Ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
