No.4011 シリア:人権擁護家で民主活動家が集会参加を理由に多数逮捕されています。

「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、シリアにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構はシリア人権・民主的自由擁護協会(CDF)より、CDF執行理事のジャベル・アル・シューフィーさん、著名な人権擁護家でシリア市民社会再活性化委員会設立者兼メンバー、さらに2006年5月以来拘禁されている「良心の囚人擁護委員会」メンバーでシリア人権協会設立者のアンワル・アル・ブンニさんの兄弟であるアクラム・アル・ブンニさん、シリア市民社会再活性化委員会メンバーのアリ・アル・アブドゥラさんが恣意的に拘禁されているという情報を入手しました。

情報によると、シリア治安部隊が、ダマスカス郊外で開催されたダマスカス宣言(1)の集会に参加した163人を2007年12月9日から逮捕し始めました。この集会ではムスリム同胞団や人権擁護家など、反政府派の政治活動家が集合し、ダマスカス宣言全国評議会を設立しました。この評議会には17人のメンバーが選出され、CDF代表もその中に入っています。

この集会の後、2007年12月9日に治安部隊が37人の人を逮捕し、数時間後に釈放しました。しかし、ジャベル・アル・シューフィーさんはダマスカス郊外の国家治安センターで拘禁されたままです。

2007年12月11日、アクラム・アル・ブンニさんが集会への参加を理由として逮捕されました。彼は現在、ダマスカス市内の国家治安刑務所で拘禁されています。

12月17日、アリ・アル・アブドゥラさんも同じ理由で逮捕されました。

監視機構は、ジャベル・アル・シューフィーさん、アクラム・アル・ブンニさん、アリ・アル・アブドゥラさんの人権活動に制裁を与える狙いがあると思われる恣意的な逮捕に憂慮を表明します。監視機構はさらに、ここ数年にわたり、人権擁護家が当局から拷問や虐待を受けることが増えているため、ジャベル・アル・シューフィーさん、アクラム・アル・ブンニさん、アリ・アル・アブドゥラさんの心身の安全を懸念します。

(1) 「民主的かつ全国的な変化のためのダマスカス宣言」は、2005年10月16日に政治改革運動家や市民運動の幅広い連合により発表された。この宣言は、市民権を尊重する民主制度の確立、表現と結社の自由の確保、宗教および政治的信条にもとづいた差別の撤廃を呼びかけている。

<行動要請>

 シリア関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、アクラム・アル・ブンニさん、ジャベル・アル・シューフィーさん、アリ・アル・アブドゥラさんの心身の安全を保障すること。

2.ダマスカス宣言全国評議会の後に恣意的に逮捕、拘禁されている人びと、とりわけ、アクラム・アル・ブンニさん、ジャベル・アル・シューフィーさん、アリ・アル・アブドゥラさんを即時釈放すること。

3.いかなる情況にあろうとも、シリアの人権擁護家が平和的な集会の自由を享有できるよう保障すること。

4.シリアアラブ共和国のすべての人権擁護家に対する嫌がらせに終止符を打つこと。

5.1998年12月9日国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

6.国際人権基準およびシリアが批准した国際文書に沿って、国内全土における人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the arbitrary detention of Messrs. Akram Al Bunni, Jaber Al Shoufie and Ali Al-Abdullah as the aftermaths of the meeting of the National Council of the Damascus Declaration. I would like to urge you the followings:

1. To guarantee in all circumstances the physical and psychological integrity of Messrs. Akram Al Bunni, Jaber Al Shoufie and Ali Al-Abdullah;
2. To release immediately the people arrested and arbitrarily detained in the aftermaths of the meeting of the National Council of the Damascus Declaration, among which Messrs. Akram Al Bunni, Jaber Al Shoufie and Ali Al-Abdullah;
3. To ensure in all circumstances that Syrian human rights defenders can enjoy their freedom of peaceful gathering ;
4. To put an end to the harassment against all human rights defenders in the Syrian Arab Republic;
5. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels", and Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
6. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the Syrian Arab Republic.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Syria.

Brief description of the situation:

The Observatory has been informed by the Committees for the Defence of Freedoms and Human Rights in Syria (Comite pour la defense des droits de l'Homme en Syrie - CDF) about the arbitrary detention of Mr. Jaber Al Shoufie, member of the executive board of the CFD, Mr. Akram Al Bunni, a well known human rights defender, member and founder of the Committee for the Revitalization of Civil Society in Syria and brother of Mr. Anwar al-Bunni, member and founder of the Syrian Human Rights Association and member of the Committees for the Defence of Prisoners of Conscience who is detained since may 2006, and Mr. Ali Al-Abdullah, also a member of the Committee for the Revitalisation of Civil Society in Syria.

According to the information received, on December 9, 2007, Syrian security services began a series of arrests that followed the gathering, outside of Damascus, of 163 persons who have been part to the Damascus Declaration[1]. This meeting resulted in the creation of the National Council of the Damascus Declaration, a collective movement of political opposition gathering political activists, including the Muslim Brotherhood, as well as human rights defenders. The Council is composed of 17 elected members, among which CDF representatives.

On December 9, 2007, in the aftermaths of the meeting, the security services arrested 37 people who were released few hours later. But Mr. Jaber Al Shoufie remains in detention in State Security centres outside of Damascus.

On December 11, 2007, Mr Akram Al Bunni was arrested for his participation in the meeting. He is currently detained in the State Security prison in Damascus.

On December 17, Mr Ali Al-Abdullah was arrested for the same reason.

The Observatory expresses its deepest concern about the arbitrary detention of Messrs. Akram Al Bunni, Jaber Al Shoufie and Ali Al-Abdullah, which seems to merely aim at sanctioning their activities in favour of human rights in Syria. The Observatory also fears for Messrs. Akram Al Bunni, Jaber Al Shoufie and Ali Al-Abdullah's physical and psychological integrity as an increasing number of human rights defenders have been subjected to torture or ill-treatments by the authorities over the past years.

Actions requested:

Please write to the Syrian authorities, urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Messrs. Akram Al Bunni, Jaber Al Shoufie and Ali Al-Abdullah;

ii. Eelease immediately the people arrested and arbitrarily detained in the aftermaths of the meeting of the National Council of the Damascus Declaration, among which Messrs. Akram Al Bunni, Jaber Al Shoufie and Ali Al-Abdullah;

iii. Ensure in all circumstances that Syrian human rights defenders can enjoy their freedom of peaceful gathering ;

iv. Put an end to the harassment against all human rights defenders in the Syrian Arab Republic;

v. [1] The "Damascus Declaration for Democratic and National Change" was issued on October 16, 2005 by a wide coalition of political reform activists and members of civil society, and calls for establishing a democratic system that respects citizens' rights, ensures freedom of speech and association, and ends discrimination based on religious or political beliefs.
