恣意的逮捕・拘禁および虐待の恐れ

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護活動家保護のための監視機構」は、ウズベキスタンにおける下記の状況に関して皆様の働きかけをお願いします。

<事件の概要>

 人権擁護家のための監視機構は「法律扶助協会(LAS)」より、2005年5月13日にウズベキスタンのアンディジャンで平和的なデモ活動に対し過剰な武力が行使され、女性や子どもを含む何百人もの人が殺害された事件を非難し調査していた人権擁護家たちが、恣意的に逮捕、拘禁され、身体的な暴行を受けたという情報を入手しました。

 入手した情報によると、2005年5月21日にアンディジャンの人権団体のメンバーであるサイジャホン・ザイナビディノフさんが逮捕されました。彼は現在隔離拘禁されており、2005年5月13日の暴力事件を海外報道機関に告発し、発表したことについて名誉毀損(刑法139条)で起訴されました。(FIDHとOMCTの記者発表参照)2005年5月22日には「人権擁護のためのナマンガン・グループ」のソビソン・ウスタバエフさんが逮捕され、上記のアンディジャンの事件の後に行われた平和的な抗議活動に参加した後、ウズベキスタンの行政法にもとづいて禁固15日の判決を受けました。

 その上、この逮捕事件の数日前、人権団体「エズグリック」のメンバーであるウルグベク・バキロフさんとファズレッディン・ガフロフさんの2人が、5月13日の事件の目撃者にインタビューをしに行こうとしていたところ、アンディジャンの法執行官に殴打され、嫌がらせを受けたということです。

 監視機構は、ザイナビディノフさんとウスタバエフさんの逮捕は彼らの人権擁護家としての活動を妨げ、彼らの表現の自由を制限することを目的としていると考え、ウズベキスタンの人権擁護家の状況に深い懸念を表明します。

 監視機構は、今回の逮捕や嫌がらせ行為は、ウズベキスタン政府の国際人権義務の深刻な違反であり、特に「人権擁護家保護のための宣言」第1条の「個々にまた他の者と共同して、国内、国際レベルにおいて人権および基本的自由の保護ならびに実現を伸長、奨励する」というすべての人の権利の侵害と考えます。

<要請行動>

 ウズベキスタン関係当局に以下の要請をお願いします。

  1. 恣意的に拘禁されているサイジャホン・ザイナビディノフさんとソビソン・ウスタバエフさんを即時、無条件に釈放すること。
  2. 二人の心身の健康を保障すること。
  3. ウルグベク・バキロフさんとファズレッディン・ガフロフさんを攻撃した者を調査して拘束し、法にもとづき適切な行政罰あるいは刑事罰が与えられるようにすること。
  4. 1998年12月9日国連総会で採択された人権擁護活動家の保護に関する宣言の条項、とりわけ「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条、並びに、「人権と基本的自由の促進と保護のために、すべての人は単独であれ他の人との協働であれ、平和的に会議をしたり集合する権利がある」そして、「すべての人は非政府組織、協会あるいは団体を結成し、加入して参加する権利を有する」とした第5条a項b項、さらに、「全ての人は、単独であれ他の人との協働であれ、すべての人権と基本的自由に関する他者の見解、情報および知識を、公表したり、知らせたり、あるいは配布する権利を有している」そして「すべての人権と基本的自由の法律上および実践上での遵守に関して、調査、議論、意見の形成あるいは保持を行い、これらおよびその他適切な手段を通して、こうした問題に一般の注意を惹く権利を有している」とした第6条(b)(c)項の実施を保障すること。
  5. より一般的には、世界人権宣言とウズベキスタンが批准したその他の国際人権文書に従うこと。

Dear President Karimov,

I am writing you to express my concern over the safety of Mr. Saidjahon Zaynabitdinov, a member of the Human Rights Group in Andijan, and Mr. Sobithon Ustabaev of the Namangan Group for Protection of Human Rights, both of who were arrested on May 21 and 22, 2005, respectively. I would like to urge you the followings:

  1. To release immediately and unconditionally Messrs. Saidjahon Zaynabitdinov and Sobithon Ustabaev, for their detention is arbitrary;
  2. To guarantee their physical and psychological integrity and procedural rights in all circumstances;
  3. To investigate into and hold those responsible accountable for the attack against Messrs. Ulugbek Bakirov and Fazleddin Gafurov, so as to ensure that the appropriate administrative and criminal sanctions provided by law be applied to them;
  4. To put an end to all acts of harassment against human rights defenders in the country in conformity with the Declaration on Human Rights Defenders, adopted by the United Nations' General Assembly on December 9, 1998, in particular its article 5 (a) which states that "For the purpose of promoting and protecting human rights and fundamental freedoms, everyone has the right, individually and in association with others, at the national and international levels: (a) To meet or assemble peacefully"; its article 6 which guarantees the rights: "(a) To know, seek, obtain, receive and hold information about all human rights and fundamental freedoms, including having access to information as to how those rights and freedoms are given effect in domestic legislative, judicial or administrative systems; (b) freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms; [and] (c) To study, discuss, form and hold opinions on the observance, both in law and practice, of all human rights and fundamental freedoms and, through these and other appropriate means, to draw public attention to these matters"; and the above-mentioned article 1;
  5. To more generally, conform with the provisions of the Universal Declaration on Human Rights, and with all other international human rights instruments binding Syria.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Uzbekistan.

Brief description of the situation:

The Observatory has been informed by the Legal Aid Society (LAS) of the arbitrary arrests, detentions and physical attack of human rights defenders who have been denouncing and investigating into the disproportionate use of force against civilians, on May 13, 2005, during peaceful demonstrations in Andijan, Uzbekistan, resulting in the killing of hundreds of them, including women and children.

According to the information received, on May 21, 2005, Mr. Saidjahon Zaynabitdinov, member of the Human Rights Group in Andijan, was arrested. He is currently detained incommunicado and charged with libel (article 139 of the Criminal Code) for his denunciation and declarations to the international media concerning the violent events of May 13, 2005 (See press releases by FIDH and OMCT). On May 22, 2005, Mr. Sobithon Ustabaev of the Namangan Group for Protection of Human Rights was arrested and sentenced to 15 days in detention on the basis of the administrative code of Uzbekistan after taking part in a peaceful protest against the above-mentioned events in Andijan.

Moreover, some days before these arrests, it has been reported that two members of the human rights organisation "Ezgullik", Messrs. Ulugbek Bakirov and Fazleddin Gafurov, were beaten up and harassed by law enforcement agents in Andijan as they were going to interview witnesses of the May 13 events.

The Observatory considers that the arrests of Messrs. Zaynabitdinov and Ustabaev are aimed at hindering their work as human rights defenders and curtailing their right to freedom expression, and expresses its deep concern for the situation of human rights defenders in Uzbekistan.

The Observatory recalls that these arrests and acts of harassment constitute serious violations of international human rights obligations of the Uzbek government and in particular of every person's right "to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels" guaranteed in article 1 of the UN Declaration on Human Rights Defenders.

Action requested:

Please write to the Uzbek authorities, urging them to:

  1. release immediately and unconditionally Messrs. Saidjahon Zaynabitdinov and Sobithon Ustabaev, for their detention is arbitrary;
  2. guarantee their physical and psychological integrity and procedural rights in all circumstances;
