５月下旬より逮捕、拘禁されています。

　「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ウズベキスタンにおける下記の状況に関して皆様の働きかけをお願いします。

＜新情報＞

　人権擁護家のための監視機構はロシアに拠点を置く人権センター「メモリアル」とウズベキスタンの人権NGO「エズグリック」より、アンディジャン州で活動する複数の人権擁護家が2005年5月28日以降逮捕されているという情報を入手しました。

　入手した情報によると、2005年5月21日にアンディジャンの人権団体のメンバーであるサイジャホン・ザイナビディノフさんが逮捕されました。彼は現在隔離拘禁されており、2005年5月13日の暴力事件を海外報道機関に告発し、発表したことについて誹謗（刑法139条）として起訴されました。（FIDHとOMCTの記者発表参照）彼は2005年5月29日と30日に自宅に電話をかけることを許され、数日以内に釈放されるだろうと話していましたが、2005年6月3日時点でまだ拘禁されています。

　さらに、2005年5月28日マルハマット地区（アンディジャン州）で、エズグリックのマルハマット地区支部長ディルムラッド・ムヒディノフさん、「国際人権学会(the International Society of Human Rights)」のアンディジャン支部長ムハマドコディル・オタホノフさん、エズグリックのメンバーで「ビルリク」という政党の地元組織の代表であるムッサジョン・ボボジャノフさんが逮捕されました。マルハマット地区の行政長官は彼らを2005年5月30日の夜に解放すると約束しましたが、2005年6月3日時点でまだ彼らは拘禁されています。その上、彼らのコンピューターやCD、その他の書類も押収されました。

　さらに、2005年5月29日から30日にかけての夜、タシケントのホテル･オリンピアに宿泊していたエズグリックのメンバー12人が警察に逮捕されました。彼らは、エズグリックが主催したセミナー「立法とその原則」に参加するためにウズベキスタン各地から集まってきていました。ホテルで警官に挑発された彼らは、エズグリックのメンバーのハッサン・ユスポフさんの家に泊まることにしました。彼らはそこで30人の武装した警官に逮捕され、その中には自宅に強制的に送り返される前に殴打された人もいました。

　これらの事件の後、エズグリックの代表であるヴァシラ・イノイアトヴァさんと彼女の夫、およびハッサン・ユスポフさんが午前2時頃にイノイアトヴァさんの家で逮捕され、内務省のソビル−ラキモフスキー地域センターで拘禁されました。彼らは2005年5月30日の昼間に釈放されました。その後、ハッサン・ユスポフさんの家に戻ったヴァシラ・イノイアトヴァさんは、内務省の職員が、「容疑者」の人々がユスポフさんの家で定期的に会合を持ち、事件の前夜にはアンディジャンから来た「ワッハーブ派テロリスト」との会合が開かれていたということを証明するための偽の証言に近隣の人々に強制的に署名させているのを見ました。

　2005年5月30日、「人道法センター」メンバーのヴァキード・カリモフさんとイルコム・アシュロフさんがブハラで3時間拘禁されました。彼らは書類を押収され、市内から出ないという誓約書に署名させられました。さらに、フェルガナ盆地で活動する人権擁護家は定期的に偵察され、「ちょっとした会話」のためと言って警察に呼ばれ、デモに参加しないよう警告を受けているということです。

　また、2005年6月2日の夜、エズグリックのアンディジャン支部長ムザファルミルジ・イシュハコフさん、「ウズベキスタン人権協会」の会長アジゾフ・ヌルムハマドさんが、ビルリク党のアンディジャン支部長アクバラリ・オリポフさんと共にアンディジャンで逮捕されました。彼らは内務省マルハマット地区分室の職員による事務所の捜索を受け、逮捕されました。イシュハコフさんの家で人権擁護家に関する書類、ビルリク党のプログラムと憲章、エズグリックのアンディジャン支部のコンピューターが押収されました。彼らは2005年6月3日時点でまだ拘禁されているということです。

　監視機構は、アンディジャンにおける人権擁護家の逮捕を深く憂慮します。これらの逮捕事件は、彼らの人権侵害監視活動、特に2005年5月13日に起きたアンディジャンの悲劇に対する活動を制裁しようとする動きの１つと思われます。

＜背景情報＞

　監視機構は「法律扶助協会(LAS)」より、2005年5月13日にウズベキスタンのアンディジャンで平和的なデモ活動に対し過剰な武力が行使され、女性や子どもを含む何百人もの人が殺害された事件を非難し、調査していた人権擁護家たちが恣意的に逮捕、拘禁され、身体的な暴行を受けたという情報を入手しました。

　その後、人権団体「エズグリック」のメンバーであるウルグベク・バキロフさんとファズレッディン・ガフロフさんの2人が、5月13日の事件の目撃者にインタビューしに行こうとしていたところ、アンディジャンの法執行官に殴打され、嫌がらせを受けたということです。2005年5月21日にはアンディジャンの人権団体のメンバーであるサイジャホン・ザイナビディノフさんが逮捕されました。2005年5月22日には「人権擁護のためのナマンガン・グループ」のソビソン・ウスタバエフさんが逮捕され、アンディジャンの事件の後に行われた平和的な抗議活動に参加した後、ウズベキスタンの行政法にもとづいて禁固15日の判決を受けました。

＜要請行動＞

　ウズベキスタン当局関係者に対して以下の要請をお願いいたします。

  1. いかなる情況にあろうとも、ウズベキスタンの人権擁護活動家の心身の安全を保障すること。
  2. 拘禁されている人権擁護活動家を全員、即時に無条件で釈放すること。
  3. 1998年12月9日国連総会で採択された人権擁護活動家の保護に関する宣言の条項、とりわけ「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした上記の第１条、並びに、「人権および基本的自由の促進と保護の目的のために、すべての人は、単独であれ他の人との協働であれ、国内および国際レベルで、平和的に集まる権利を有する」とした第5条a項、さらに、「いかにして、すべての人権および基本的自由が、国内の法律、司法、行政システムの中で効果をもちうるかということも含め、それら人権および自由に関する情報を、知り、求め、取得し、受領し、そして保持する権利」「すべての人は、単独であれ他の人との協働であれ、すべての人権と基本的自由に関する他者の見解、情報および知識を、公表したり、知らせたり、あるいは配布する権利を有している」そして「すべての人権と基本的自由の法律上および実践上での遵守に関して、調査、議論、意見の形成あるいは保持を行い、これらおよびその他適切な手段を通して、こうした問題に一般の注意を惹く権利を有している」とした第6条(a)(b)(c)項を保障すること。
  4. さらに全般的には、世界人権宣言の条項と、ウズベキスタンを拘束するすべての国際人権文書に準拠すること。

I am writing you to express my concern over the safety of several human rights defenders working in Andijan region who have been arrested since May 28, 2005.

I would like to urge you the followings:

  1. To guarantee physical and psychological integrity of Uzbek human rights defenders in all circumstances;
  2. To release immediately and unconditionally all human rights defenders detained;
  3. To put an end to all acts of harassment against human rights defenders in the country in conformity with the Declaration on Human Rights Defenders, adopted by the United Nations General Assembly on December 9, 1998, in particular above-mentioned article 1, article 5 (a) which states that "For the purpose of promoting and protecting human rights and fundamental freedoms, everyone has the right, individually and in association with others, at the national and international levels: (a) To meet or assemble peacefully"; and article 6 which guarantees the rights: "(a) To know, seek, obtain, receive and hold information about all human rights and fundamental freedoms, including having access to information as to how those rights and freedoms are given effect in domestic legislative, judicial or administrative systems; (b) (…) freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms; [and] (c) To study, discuss, form and hold opinions on the observance, both in law and practice, of all human rights and fundamental freedoms and, through these and other appropriate means, to draw public attention to these matters";
  4. More generally, to conform with the provisions of the Universal Declaration on Human Rights, and with all other international human rights instruments binding Uzbekistan.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Uzbekistan.

New information:

The Observatory has been informed by the Russia-based Human Rights Center Memorial and the Uzbek human rights NGO Ezgulik that several human rights defenders working in Andijan region have been arrested since May 28, 2005.

According to the information received, on May 21, 2005, Mr. Saidjahon Zaynabitdinov, member of the Human Rights Group in Andijan, was arrested. He is currently detained incommunicado and charged with libel (article 139 of the Criminal Code) for his denunciation and declarations to the international media concerning the violent events of May 13, 2005 that took place in Andijan (See press releases by FIDH and OMCT, and below). Mr. Zaynabitdinov was authorised to call at his home on May 29 and 30, 2005 and said he would probably be released within a few days. However, he still remains detained as of June 3, 2005.

Moreover, on May 28, 2005 in Markhamat (region of Andijan), Mr. Dilmurad Muhitdinov, President of the Markhamat section of Ezgulik, Mr. Muhammadkodir Otahonov, President of the local section of Andijan of the International Society of Human Rights and Mr. Mussajon Bobojanov, a member of Ezgulik and chief of the local organisation of the political party "Birlik", were arrested. The Markhamat chief of Administration promised to release them on May 30, 2005 in the evening, but they still remain detained as of June 3, 2005. In addition, their computers, CDs and other documents were confiscated.

Moreover, during the night of May 29-30, 2005, the police arrested 12 members of Ezgulik, who were staying at the Hotel Olympia in Tashkent. They had come from several regions of Uzbekistan, including Fergana and Djizak, in order to participate in a seminar organised by Ezgulik, titled "Legislation and its principles". After being provocated at the hotel by police members, they decided to spend the night at the house of Mr. Hussan Yussupov, a member of Ezgulik. They were arrested there by 30 armed policemen, and some of them were beaten, before being forcibly sent back to their residence places.

Following these events, Mrs. Vassila Inoiatova, President of Ezgulik, her husband and Mr. Hussan Yussupov were arrested at Mrs. Inoiatova's house at around 2 a.m. and detained in Sobir-Rakhimovskii Regional Center of the Ministry of Internal Affairs. They were released on May 30, 2005 at mid-day. Afterwards, Mrs. Vassila Inoiatova went back to Mr. Hussan Yussupov's house, where she saw members of the Ministry of Internal Affairs forcing his neighbours to sign false testimonies, in order to prove that "suspect" people meet regularly at Mr. Yussopov's house and that on the eve of the event there was a meeting of "terrorists-wahhabits" from Andijan.

On May 30, 2005, Messrs. Vakhid Karimov and Ilkhom Ashurov, members of the Center of Humanitarian Law, were detained during three hours in Bukhar. Their papers were confiscated and they had to sign a document indicating that they would not leave the city. Moreover, human rights defenders working in the Valley of Ferghana reported to be regularly spied, called for "a conversation" with the police and warned not to participate in demonstrations.

Finally, on June 2, 2005, in the evening, Mr. Muzaffarmirzi Iskhakov, Chairman of Ezgulik for Andijan region, Mr. Azizov Nurmuhammad, Chairman of the section of the Human Rights Society of Uzbekistan (HRSU), were arrested in Andijan along with Mr. Akbarali Oripov, Chairman of Birlik for Andijan region. Their arrests took place during searches at their houses conducted by some of officers of the Ministry of Internal Affairs of Markhamat. Some documents about human rights defenders, the program and charter of the political party "Birlik" and computers of the section of Ezgulik of Andijan were confiscated at Mr. Iskhakov's house. They were allegedly still detained as of June 3, 2005.

The Observatory is deeply concerned at the arrests of those human rights defenders in Andijan region, which seem to be part of an attempt to sanction their monitoring activities in human rights abuses, in particular in the Andijan tragedy that occurred on May 13, 2005.

Background information:

The Observatory had been informed by the Legal Aid Society (LAS) of the arbitrary arrests, detentions and physical attack of human rights defenders who have been denouncing and investigating into the disproportionate use of force against civilians, on May 13, 2005, during peaceful demonstrations in Andijan, resulting in the killing of hundreds of them, including women and children.

Following these events, two members of the human rights organisation Ezgulik, Messrs. Ulugbek Bakirov and Fazleddin Gafurov, were beaten up and harassed by law enforcement agents in Andijan as they were going to interview witnesses of the May 13 events. On May 21, 2005 Mr. Saidjahon Zaynabitdinov, member of the Human Rights Group in Andijan was arrested. On May 22, 2005, Mr. Sobitkhon Ustabaev of the Namangan Group for Protection of Human Rights was arrested and sentenced to 15 days in detention on the basis of the administrative code of Uzbekistan after taking part in a peaceful protest against the above-mentioned events in Andijan.

Action requested:

Please write to the Uzbek authorities, urging them to:

  1. guarantee physical and psychological integrity of Uzbek human rights defenders in all circumstances;
  2. release immediately and unconditionally all human rights defenders detained;
