拘禁中に病状悪化にもかかわらず、
医療を拒否されています。

 SOSトーチャー国際事務局は、ネパールにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局は、SOSトーチャーのネットワークのメンバー団体であるインフォーマル・セクター・サービス・センター(INSEC)より、リラ・マミ・ポクレルさんが2005年2月1日に恣意的に逮捕され、現在もカトマンズのマハラジュグンにある軍警察Gan No2に収監されているという情報をうけました。

 情報によれば、リラ・マミ・ポクレルさんはネパール人民前線の副委員長であり、下院の議員でもあります。逮捕されて以来、ポクレルさんは家族以外の人との面会を許されていません。家族との面会さえも、厳しい監視のもと行われています。拘禁中、ポクレルさんの健康状態は悪くなりましたが、当局は彼が適切な医療を受けることを認めていません。現在、彼は腎臓病、右手足麻痺、ヘルニアそして糖尿病を患っています。治療を受けさせてほしいという繰り返しの願いや、医療費は家族が支払うという申し出にも関わらず、当局はそれを拒否しています。

 SOSトーチャーは、ポクレルさんの心身の安全を深く憂慮し、直ちに医療手当てを受けられるよう求めます。

<要請行動>

 ネパール当局に以下の要請をお願いいたします。

  1. ポクレルさんの心身の安全を保障すること。
  2. 正当な嫌疑がないまま拘禁されているポクレルさんの即時釈放を命じること。もし正当な嫌疑があるならば、彼を迅速で中立な裁判に付し、常に彼の訴訟上の権利を保障すること。
  3. 国内法および国際人権基準に準じ、国全体において人権尊重と基本的自由を保障すること。

Arbitrary Arrest / Detention / Ill-Treatment

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Nepal.

Brief Description of the Situation

The International Secretariat of OMCT has been informed by the Informal Sector Service Center (INSEC), a member of the OMCT network, that Mr. Lila Mani Pokhrel was arbitrarily arrested on 1st February 2005 and he remains in custody at the Armed Police Gan No. 2, which is located in Maharajgunj, Kathmandu.

According to the information received, Mr. Lila Mani Pokhrel is the Vice-Chairman of the Peoples Front Nepal and is also a member of the lower house of Parliament. Throughout his time in custody, Mr. Pokhrel has been prohibited from having visits with anyone other than his family and even then they are only allowed to meet him in restricted circumstances. While in custody, Mr. Pokhrel's health has deteriorated and the authorities have refused to allow him access to proper medical care. He is currently suffering from kidney problems, RHS-paralysis, hernia and diabetes. Despite repeated requests for medical treatment, and offers from him and his family to pay for treatment, the authorities have refused to comply with these requests.

OMCT is gravely concerned for the physical and psychological integrity of Mr. Pokhrel and ask that he be given immediate medical treatment.

Action Requested:

Please write a letter to the authorities in Nepal urging them to:

  1. Guarantee Mr. Pokhrel's physical and psychological integrity;
  2. Order the immediate release of Mr. Pokhrel in the absence of valid legal charges, and if such charges exist, to ensure that he is given a prompt and fair trial, in which his procedural rights are guaranteed at all times;
  3. Ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
