女性に対する暴力

 SOSトーチャー国際事務局は、エジプトにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局は、SOSトーチャーのネットワークのメンバー団体である「独立した司法と法曹家のためのアラブ・センター(ACIJLP)」より、憲法第76条改正に関する国民投票に関して、デモが2005年5月25日に行われ、その際に女性3人が性的暴行を受け、男性1人が身体的暴行を受けたという情報を入手しました。

 入手した情報によると、複数のデモ参加者がデモ中に性的暴行を受けたということです。検察が捜査を始めましたが、被害者や目撃者は今も治安部隊から脅迫や威嚇を受けているということです。ACIJLPは、以下の女性3人から、「デモ中に性的に暴行された」という訴えを聞いています。

  1. アビール・アハメド・ハッサン
  2. ハニイ・イシャック・スマーン
  3. シャイマ・アブエル・ヘイル・スレイマン

 さらに、イマン・タハさんという男性がデモ中に身体的暴行を受け、腕に切り傷を負いました。

 治安部隊員はこの女性たちと彼女たちの家族の動きを追跡し、嫌がらせし、監視しています。治安部隊は、彼女たちが供述を変えるよう圧力をかけています。

 SOSトーチャー国際事務局は、この人々への治安部隊員の虐待に対して、深い懸念を表明します。さらに国際事務局は、治安当局による脅迫は「犯罪と権力濫用の被害者の正義に関する基本原則宣言」、とくに第6条「被害者のニーズに対する司法および行政の対応は、次のような方法によって促進されなければならない:被害者の個人的利益が影響を受ける場合には、被告人に不利益を与えることなく、また該当する国内の刑事司法制度に従って、彼らの意思や関心事を訴訟手続の適切な段階で表明させたり考慮したりする」の侵害であるというACIJLPの懸念をここで繰り返したいと思います。

<行動要請>

 エジプト関係当局に対して以下の要請をお願いします。

  1. 責任者を探りあて、裁判に付し、法に基づき刑事/行政制裁を与えるために、性的暴行およびそれに続く治安部隊員による脅しや威嚇について、綿密で中立の調査を行うよう命ずること。
  2. 被害者に適切な補償が行われるよう保障すること。
  3. 国内法および国際人権基準に従い、国内全体において人権尊重と基本的自由を保障すること。

I am very disturbed by the information of the sexual assaults committed by the security forces on three women during their participants in the demonstration on May 23, 2005 in Cairo.

As I am concerned about the continued threats and intimidation imposed by the security forces on them, I urge you to order a thorough and impartial investigation into the circumstances of the sexual assaults and subsequent threats and intimidation from security officials, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law; to guarantee that adequate reparation is provided to the victims; and to guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Sexual Assault and Intimidation

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Egypt.

Brief Description of the Situation

The International Secretariat of OMCT has been informed by the Arab Center for the Independence of the Judiciary and the Legal Profession (ACIJLP), a member of the OMCT network, of the sexual assault of three women, and the physical assault of one man, while they were at a demonstration about the Article 76 Amendment Referendum, which was held in Cairo on May 25, 2005.

According to information received, some protestors were sexually assaulted during the demonstration. Although the prosecution office has initiated investigations, victims and witnesses continue to be threatened and intimidated by security forces. ACIJLP has received complaints from the following three women whom were sexually assaulted during the demonstrations:

  1. Abeer Ahmed Hassan
  2. Hany Isshaq Sumaan
  3. Shaymaa Abu el Kheir Suleiman

In addition, a man named Iman Taha was physically assaulted during the demonstrations and he sustained a cut to his arm.

Members of the security forces have followed, harassed and monitored the movements of these women and their families. The security forces are pressuring these women to change their statements.

The International Secretariat of OMCT expresses its deep concern over the ill-treatment of these persons by members of the security forces. Furthermore, OMCT echoes ACIJLP's concern that threats by security authorities is a violation of the Declaration on Basic Priniciples of Justice for the Victims of Crime and Abuse of Power, especially Article 6: "The responsiveness of judicial and administrative processes to the needs of victims should be facilitated by…allowing the views and concerns of victims to be presented and considered at appropriate stages of the proceedings where their personal interest are affected, without prejudice to the accused and concisstent wwith the relevant inational criminal justice system".

Please write to the authorities in Egypt urging them to:

  1. Order a thorough and impartial investigation into the circumstances of the sexual assaults and subsequent threats and intimidation from security officials, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
  2. Guarantee that adequate reparation is provided to the victims;
  3. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
