 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、イランにおける下記の状況に関して、皆様の働きかけをお願いします。

<事件の概要>

 人権擁護家のための監視機構は「人権擁護のためのイラン同盟(LDDHI)」から、2005年7月30日にテヘラン弁護士会のアブドルファッター・ソルタニさんが逮捕されたという情報を入手しました。

 入手した情報によると、アブドルファッター・ソルタニ弁護士は、「イラン刑法に基づけば違法」であると彼がみなす彼に対する逮捕状と、2005年7月27日にテヘランのサイード・モルタザヴィ検事の命令で彼の個人的な持ち物や仕事関係のものが捜索され、押収されたことに抗議してテヘラン弁護士会で座り込みをしていたところ、2005年7月30日に逮捕されたということです。(背景情報参照)

 ソルタニさんは「スパイ活動」の容疑で起訴されましたが、それ以上の詳細は分かりません。彼は現在テヘランのエビン刑務所で拘禁されています。

 その上、同じ日に2003年度ノーベル平和賞受賞者で「人権擁護活動家センター」事務局長のシリン・エバディさんの留守電に、「我々はソルタニを捕まえた。次はお前だ。」というメッセージが2回入っていました。彼女は1週間にわたって保守系のメディア、特にケイハン新聞から中傷と威嚇を受けていました。特に、「アクバル・ガンジ(エビン刑務所で5年以上拘禁されている著名なジャーナリストであり人権擁護家。2005年6月16日にハンガーストライキを始めた。監視機構のアピールIRN001/0004/OBS030.7参照)にハンガーストライキをするよう焚きつけた」と非難されました。彼女と人権擁護家センターのメンバーの弁護士たちは、サイード・モルタザヴィをはじめとする超保守派から嫌がらせを受けるようになっています。

 監視機構は、ソルタニさんの恣意的逮捕とエバディさんに対する脅迫を深く懸念し、これらは1998年12月9日に国連総会が採択した「人権擁護家保護のための宣言」の条項に甚だしく違反していると考えます。特に第9条(3a)の、全ての人びとは、「不当な遅滞なく不服申し立てについての決定を提出するべき国内の権限ある司法、行政、あるいは不法当局、もしくは国家の司法制度によって規定された権限あるほかのあらゆる当局に対し、請願あるいはその他の適切な方法により、人権と基本的自由の侵害に関する公務員個人や政府機関による政策あるいは行動について不服申し立てを行なう」権利を有するという規定に違反し、第12条(2)の「国家は、この宣言に掲げられた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するための、すべての必要な措置をとるべきである」に違反しています。

<背景情報>

 2005年7月27日、テヘランのサイード・モルタザヴィ検事がテヘラン革命裁判所にソルタニさんの逮捕状と自宅の捜査令状を出すよう要請しました。しかし彼が不在だったので逮捕状は妻に渡され、自宅の捜査が行われました。彼の書類、ファイル、ビデオテープ、本、写真などすべてのものが押収され、革命検察局に送られました。

 これらの事件が起きたのは、2003年7月にイラン系カナダ人の写真家、ザフラ・カゼミさんがイランで拘禁中に拷問と虐待で死亡した件に関し、死因と加害者を特定するためにテヘラン控訴裁判所に訴えが起こされていた最中でした。2005年7月25日に行われた控訴裁判所の裁判官室での審理で、ザフラ・カゼミさんの遺族を代理するソルタニさんは、サイード・モルタザヴィ検事など事件に関わったと言われる主だった公務員が起訴されていないと指摘し、裁判の独立性と公平性に疑問を呈しました。

 さらに監視機構は、2002年7月にソルタニさんが自分の依頼人が尋問中に虐待を受けたことを弁護弁論で強調したことを理由に起訴されたことを想起します。彼はテヘラン裁判所で4ヶ月の禁固刑になり、2004年6月に釈放されました。(監視機構2003年度年次報告参照)

<行動要請>

 イラン関係当局に以下の要請をお願いします。

  1. あらゆる情況において、アブドルファッター・ソルタニさんとシリン・エバディさん、およびイランのすべての人権擁護活動家の心身の安全を保障すること。
  2. アブドルファッター・ソルタニさんの即時無条件釈放を保障すること。
  3. 犯人を特定し、裁判に付し、罪の重さに応じた判決を言い渡せるよう、ザハラ・カゼミさんの死亡に関して公正、中立および独立した裁判を行うこと。;
  4. 人権擁護家のための宣言の条文、とりわけ、「すべての者は、個々にまた他の者と共同して、国内、国際レベルにおいて人権および基本的自由の保護ならびに実現を伸長、奨励する権利を有する」として第1条と、前述の9条3(a)項および12条2項に従うこと。
  5. 5.あらゆる情況において、国際人権基準およびイランが締結した国際人権文書に従って、人権尊重と基本的自由を保障すること。

I am writing you to express my concern about Mr. Abdolfattah Soltani, lawyer at the Bar of Tehran, who was arrested on July 30, 2005, and currently being held in Evin Prison in Tehran. I am also concerned about the report that Mrs. Shirin Ebadi, 2003 Nobel Peace Prize and Secretary General of the Defenders of Human Rights Centre, received a message twice on her answering machine, stating that "We have Soltani, you are next" on the day Mr. Soltani was arrested.

I would like to urge you the followings:

  1. To guarantee under all circumstances the physical and psychological integrity of Mr. Abdolfattah Soltani, Mrs. Shirin Ebadi and all human rights defenders in Iran;
  2. To ensure the immediate and unconditional release of Mr. Abdolfattah Soltani;
  3. To conduct a fair, impartial and independent trial about Zahra Kazemi's death, in order to identify the perpetrators, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
  4. To comply with the provisions of the Declaration on Human Rights Defenders, in particular its article 1, which states that "everyone has the right, individually or in association with others, to promote the protection and realisation of human rights and fundamental freedoms at the national and international levels", and the above-mentioned articles 9.3(a) and 12.2;
  5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Iran.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Iran.

Brief description of the situation:

The Observatory has been informed by the Iranian League for the Defence of Human Rights (Ligue iranienne de defense des droits de l'Homme - LDDHI) that Mr. Abdolfattah Soltani, lawyer at the Bar of Tehran, was arrested on July 30, 2005.

According to the information received, on July 30, 2005, Mr. Abdolfattah Soltani was arrested while he was taking part in a sit-in at the Bar of Tehran in order to protest against his warrant of arrest, which Mr. Soltani considered as "illegal with respect to the Iranian Penal Code", as well as against the search and seizure of his personal and professional belongings on order of Mr. Said Mortazavi, Tehran Prosecutor, on July 27, 2005 (See background information).

Mr. Soltani has been accused of "espionage", without any other precisions. He is currently detained at the prison of Evin, in Tehran.

Moreover, on the same day, Mrs. Shirin Ebadi, 2003 Nobel Peace Prize and Secretary General of the Defenders of Human Rights Centre, received a message twice on her answering machine, stating that "We have Soltani, you are next". For one week, Mrs. Ebadi has been subjected to a campaign of defamation and intimidation in the die-hard press, in particular the daily newspaper Keyhan. She is accused, among other things, of "inciting Mr. Akbar Ganji [a prominent journalist and human rights defender who has been imprisoned for more than five years in Evin prison, and who started a new hunger strike on June 16, 2005 - See Observatory Urgent Appeal IRN 001/0004/OBS 030.7] to be on hunger strike". Finally, along with the other lawyers who are members of the Defenders of Human Rights Centre, she is subjected to acts of harassment from ultra conservatives, including Mr. Said Mortazavi.

The Observatory is deeply concerned about Mr. Soltani's arbitrary arrest and the subsequent threats against Mrs. Ebadi, and considers that these events blatantly violate the provisions of the Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, in particular article 9.3(a), which provides that everyone has the right "to complain about the policies and actions of individual officials and governmental bodies with regard to violations of human rights and fundamental freedoms, by petition or other appropriate means, to competent domestic judicial, administrative or legislative authorities or any other competent authority provided for by the legal system of the State, which should render their decision on the complaint without undue delay", and article 12.2, which states that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration".

Background information:

On July 27, 2005, Mr. Said Mortazavi, Tehran Prosecutor, requested the Revolution's Court of Tehran to issue a warrant for the arrest of Mr. Soltani along with a search warrant for his home. As he was absent, the warrants were delivered to his wife and his house was searched. All his documents, files, video-tapes, books, pictures etc. were seized and transferred to the Revolutionary Public Prosecutor's Office.

These events took place while Ms. Zahra Kazemi's case, an Iranian-Canadian photographer who died in July 2003 from torture and ill-treatment during her detention in Iranian custody, was brought before Tehran Court of Appeal to establish the circumstances of her death and the responsible parties. On July 25, 2005, during a hearing in camera of the Court of Appeal, Mr. Soltani, lawyer of Ms. Zahra Kazemi's family, put into question the independence and fairness of the trial, pointing out that the main officials allegedly involved in the case had not been indicted by the court, including Mr. Said Mortazavi.

Moreover, the Observatory recalls that in July 2002, Mr. Soltani had already been convicted for having underlined in his defence pleadings the fact that his clients had been subjected to ill-treatment during their interrogation. He was sentenced to four months in jail by the Court of Tehran and released in June 2003 (See Observatory Annual Report 2003).

Actions requested:

Please write to the Iranian authorities and ask them to:

  1. Guarantee under all circumstances the physical and psychological integrity of Mr. Abdolfattah Soltani, Mrs. Shirin Ebadi and all human rights defenders in Iran;
  2. Ensure the immediate and unconditional release of Mr. Abdolfattah Soltani;
  3. Conduct a fair, impartial and independent trial about Zahra Kazemi's death, in order to identify the perpetrators, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
  4.
