拘禁中の市民が激しい拷問を受けている恐れがあります。

 SOSトーチャー国際事務局は、ウズベキスタンにおける下記の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局は、SOSトーチャー国際ネットワークの一員である法律扶助協会より、ウズベク国籍のアリエブ・ヤクジョンさんが、タシケントの市民軍部にいるときに拷問を受けたという情報を受けました。

 情報によれば、ヤクジョンさんはまず2004年9月4日に親戚の事件で証人として召還されました。2005年2月、ヤクジョンさんに対する刑事訴訟が始まりました。警察に対して家を離れないという約束をした後、ヤクジョンさんは裁判係争中、家に留まらなくてはなりませんでした。ヤクジョンさんは5月13日〜14日にかけてその約束を破りました。その結果、6月2日に拘束されました。6月3日か4日に、ヤクジョンさんは、棒で頭を50回殴られたと述べました。その結果、頭髪が2箇所抜け落ち、血圧が上昇しました。その後、国家安全局の隔離棟に拘留されました。

 2005年7月5日、ヤクジョンさんは親戚のマメドウ・マハムジョン・マハメダミノヴィッチさんの裁判に証人として連れていかれました。ヤクジョンさんの妹のマリアモン・ユスポヴァさんは裁判に出席し、兄の頭髪が2箇所抜け落ちているのを見ました。彼女はまた、兄が20キロ近く痩せ、法廷にいた親戚の人たちの顔も見分けることができず、さらには裁判官の質問に答えることすらままならないことに気づきました。ユスポヴァさんは、兄は出廷した時、薬物治療中であったと考えています。

 法律扶助協会の弁護士は、関係当局に申し立てを行いました。SOSトーチャー国際事務局は、ヤクジョンさんの心身の安全を深く憂慮しています。

<行動要請>

 ウズベキスタン関係当局に以下の要請をお願いします。

  1. ヤクジョンさんの心身の安全を保障するために必要な手段を全て講じること、そして、彼が医療を受けられるよう保障すること。
  2. 弁護士との接見の権利も含む裁判手続き上の権利を、あらゆる時点においてヤクジョンさんに保障すること。
  3. 責任者を特定し、裁判に付し、法律に基づき刑事罰あるいは行政罰を適用できるよう、これら事件の情況、とりわけ申し立てられている拷問の情況について、綿密で中立な調査を行うよう命じること。
  4. 国際人権基準に基づき、国内全体で人権尊重と基本的自由を保障すること。

I would urge you: to take all necessary measures to guarantee the physical and psychological integrity of Mr. Yakubjon and guarantee that he be provided with medical assistance; to ensure that the procedural rights of Mr. Yakubjon are guaranteed at all times, including his right to access to counsel; to order a thorough and impartial investigation into the circumstances of these events, notably the allegations of torture, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law; and to guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with international human rights standards.

Alleged torture

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Uzbekistan.

Brief description of the situation

The International Secretariat of OMCT has been informed by the Legal Aid Society, a member of the OMCT network, of the torture of Mr. Aliev Yakubjon, an Uzbek national, while in the City Militia Department Taskent, Uzbekistan.

According to information received, Mr. Yakubjon was first called as a witness to the case of his relative on 4th September 2004. In February 2005, a criminal case was opened against Mr. Yakubjon. After giving an undertaking to police that he would not leave his house, Mr. Yakubjon was allowed to remain at home pending the trial. Mr. Yakubjon breached the undertaking on May 13-14 and as a result was taken into custody on June 2nd. On the June 3rd or 4th, Mr. Yakubjon stated that he was beaten 50 times with a baton on his head. As a result of the beating, he developed two bald spots and high blood pressure. He was then kept in an isolation ward at the National Security Services.

On 5th July 2005, Mr. Yakubjon was brought to court to be a witness at a trial for a relative by the name of Mr. Mamedov Mahmudjon Mahamedaminovich. Mr. Yakubjon's sister, Ms. Maryamhon Yusupova, was in attendance at the court and observed bald spots on her brother's head. She also noted that he had lost 20 kilos, that he was unable to recognise his relatives and had great difficulty in answering the judge's questions. Ms. Yusupova believes that her brother was on medication during his court attendance.

A lawyer for the Legal Aid Society has filed a complaint to the relevant authorities. The International Secretariat of OMCT is gravely concerned about the physical and psychological integrity of Mr. Yakubjon.

Action requested

Please write to the authorities in Uzbekistan urging them to:

  1. Take all necessary measures to guarantee the physical and psychological integrity of Mr. Yakubjon and guarantee that he be provided with medical assistance;
  2. Ensure that the procedural rights of Mr. Yakubjon are guaranteed at all times, including his right to access to counsel;
  3. Order a thorough and impartial investigation into the circumstances of these events, notably the allegations of torture, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
  4. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with international human rights standards.
