拘禁中に出産した女性の政治囚と
その子どもの健康が懸念されます。

 SOSトーチャー国際事務局は、フィリピンにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<新情報>

 SOSトーチャー国際事務局はSOSトーチャーのネットワークのメンバー団体である「民衆の進歩のためのアジアセンター(ACPP)」より、ミンドロ西州のマンブラオ地方刑務所にいるルイサ・N・エンコミオさんと10ヶ月の子どもが、医療手当てが不十分なために健康を害しているという情報を入手しました。その上、エンコミオさんの裁判は何も進展していません。

<事件の概要>

 入手した情報によると、ルイサ・N・エンコミオさんは、新人民軍(NPA)のメンバーであると疑われ、また失敗に終わった2000年5月のミンドロ西州カリンタアンのキリロン・バランガイでの警察と兵士の車列の待ち伏せ攻撃に関わったとして、2004年5月6日に令状なく逮捕されました。逮捕された時、彼女は妊娠中で、2004年9月22日に出産しました。SOSトーチャーのネットワークのメンバー団体である「フィリピン被拘禁者救援組織(TFDP)」によると、彼女は出産前後に必要な医療を受けることができませんでした。彼女は拘禁されて以来、健康が悪化しており、生まれた子どもは風邪と高熱を繰り返しています。2004年5月13日、彼女は殺人未遂で正式に起訴されました。

 国際事務局は、ルイサ・N・エンコミオさんと子どもの心身の安全について、また、裁判が進展していないことについて非常に懸念しています。

<行動要請>

 フィリピン関係当局に以下の内容の要請をお願いします。

  1. ルイサ・N・エンコミオさんと子どもの心身の安全を保障するために必要な措置をすべてとり、緊急のこととして適切な医療が確実に施されるよう、関係当局に介入すること。
  2. 国際法および国際基準に準拠した嫌疑のないため、ルイサ・N・エンコミオさんを即時釈放するよう命じること、仮にそのような嫌疑が存在するなら、彼女を中立で資格のある法廷に付し、その間、彼女の訴訟上の権利を保障すること。
  3. 国内法および国際人権基準にしたがい、国内全体において人権尊重と基本的自由を保障るすこと。

I am writing you to express my concern at the information of ill treatment of Ms. Luisa N. Encomio and her baby now being detained in the provincial jail of Occidental Mindoro. I would like to urge you to take all necessary measures to guarantee their physical and psychological integrity of Ms. Luisa N. Encomio and her child and intervene with the proper authorities to ensure that adequate medical assistance is provided as a matter of urgency; to order the immediate release of Ms Luisa N. Encomio in the absence of legal charges that are consistent with international law and standards, or, if such charges exist, bring her before an impartial and competent tribunal and guarantee her procedural rights at all times; and to guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

The International Secretariat of OMCT requests your URGENT intervention in the following situation in the Philippines.

New Information

The International Secretariat of OMCT has been informed by the Asian Centre for the Progress of Peoples (ACPP), a member of the OMCT network, that the health of Ms. Luisa N. Encomio and her 10 month old baby is deteriorating due to the poor health facilities in Mambaurao Provincial Jail in Occidental Mindoror, Luzon. Furthermore, the court case against Ms. Encomio has not progressed.

Brief description of the situation

According to information received, Ms. Luisa N. Encomio was arrested without a warrant on May 6th 2004 for being an alleged New People's Army (NPA) member and for her involvement in a failed attempt to ambush a convoy of police officers and soldiers in Brgy Quiriron, Calintaan, Occidental Mindoro in May 2000. At the time of her arrest, she was five months pregnant and gave birth on September 22nd 2004. According to the Task Force Detainees of the Philippines (TFDP), a member of the OMCT network , she was not granted access to medical facilities in order to have her pre and post-natal needs addressed. Her health has reportedly deteriorated since she was detained and her child has suffered from intermittent cold and fever. She was formally charged with attempted murder on May 13th 2004.

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Ms. Luisa N. Encomio and her child and the lack of progression in her court case.

Action requested

Please write to the authorities in the Philippines urging them to:

  1. Take all necessary measures to guarantee their physical and psychological integrity of Ms. Luisa N. Encomio and her child and intervene with the proper authorities to ensure that adequate medical assistance is provided as a matter of urgency;
  2. order the immediate release of Ms Luisa N. Encomio in the absence of legal charges that are consistent with international law and standards, or, if such charges exist, bring her before an impartial and competent tribunal and guarantee her procedural rights at all times;
  3. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
