土地の占有をめぐり女性が硫酸を浴びせられる事件が起きました

 SOSトーチャー国際事務局は、バングラデシュにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

SOSトーチャー国際事務局はSOSトーチャーネットワークメンバーである「人権連合(ODHIKAR)」より、バングラデシュのムンシガンジ県トンギバリ・ウパジラのオウシャヒ村でチャンダナ・ラニ・マンドルさん(32歳)が硫酸をかけられる事件が起きたという情報を入手しました。

情報によると、2006年2月11日深夜、手洗いに行こうとしていたチャンダナ・ラニ・マンドルさんの背中に、ギャングと思われる集団が硫酸をかけました。彼女は深刻な火傷を負い、ムンシガンジ病院に運ばれ、その後、もっと良い治療を受けるため、ダッカにある「硫酸火傷患者基金(ASF)」に移されました。

硫酸規制法にもとづき告発を受けたトンギバリ警察は、硫酸をかけた嫌疑で同じ村内に住むモニール・ホサインの妻と兄弟を逮捕しました。

情報によると、チャンダナ・ラニ・マンドルさんと家族は、ある土地をめぐってここ4年、モニール・ホサイン・シークを含む近隣住民ともめていました。とくに2006年2月11日の午後4時には、お互いを訴えた民事裁判(背景情報参照)をめぐって、チャンダナ・ラニ・マンドルさんとモニール・ホサインの妻と兄弟が口論しました。

国際事務局は、チャンダナ・ラニ・マンドルさんに対する硫酸事件の首謀者が逮捕されていないため、調査の進展について懸念しています。

国際事務局は「女性に対する暴力の撤廃に関する宣言」の第4条(c)項「国家によってなされるか私人によってなされるかを問わず、女性に対する暴力行為を防止し、調査し、および国内法に従って処罰するために相当の注意を払うこと」を想起します。

<背景情報>

2年前、チャンダナ・ラニ・マンドルさんの義父のラメシュ・クマール・マンドルさんが、家族と親戚の住む土地をモニール・ホサインとアミール・ホサインが占有しようとしているとして、彼らを訴えました。以来、彼らは訴えを取り下げるよう圧力をかけてきました。これまでに双方合わせて4件の裁判を起こしています。この4件の裁判のうち裁判はムンシガンジ県地裁で係争中であり、1件は最高裁判所の高等裁判所で係争中です。

<行動要請>

 バングラデシュ関係当局に以下の内容の要請をお願いいたします。

  1. 適切な医療へのアクセスを含め、チャンダナ・ラニ・マンドルさんの心身の安全を保障すること。
  2. 責任者すべての特定し、裁判に付し、法に基づき刑事あるいは行政罰を適用できるよう、チャンダナ・ラニ・マンドルさんへの硫酸攻撃事件の綿密で公正な調査を迅速に実施すること。
  3. さらに一般的には、国際法や国際基準に沿って、女性が暴力を含めた一切の差別を受けない権利を保障すること。
  4. 国内法および国際人権基準にそって国全体における人権尊重と基本的自由を保障すること。

    1. To ensure Ms. Chandana Rani Mandol’s physical and psychological integrity, including her access to adequate medical treatment;

    2. To carry out a prompt, thorough and impartial investigation into the acid attack on Ms. Chandana Rani Mandol, in order to identify all those responsible and to bring them to justice and apply the penal and/or administrative sanctions as provided by law;

    3. To ensure women the right to be free from discrimination, including violence, in line with the international laws and standards;

    4. To guarantee the respect for human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

    Acid Attack

    The International Secretariat of OMCT requests your URGENT intervention concerning the following situation in Bangladesh.

    Brief description of the situation:

    The International Secretariat of OMCT has been informed by ODHIKAR - A Coalition for Human Rights, member of the OMCT network, about the acid attack against Ms. Chandana Rani Mandol (32) at Outshahi village in Tongibari Upazila, Munshiganj district, Bangladesh.

    According to the information received, on 11 February 2006, around midnight, a group of individuals - supposedly a gang - threw acid on Ms. Chandana Rani Mandol’s back as she was going to the toilet. She was rushed to Munshiganj hospital with severe acid burn and subsequently was shifted to the Acid Survivors Foundation (ASF), Dhaka, for better treatment.

    After a case was filed with the Tongibari police station under the Acid Control Act, police arrested the wife and the brother of Mr. Monir Hossain, who lives in the same village, for their alleged involvement in the acid attack.

    According to the information, Ms. Chandana Rani Mandol and her family have disputes with some of her neighbours, including Mr. Monir Hossain Sheikh, over a piece of land for the past four years. In particular, on 11 February 2006 at around 4.00 pm, a quarrel took place between Ms. Chandana Rani Mandol and both Mr. Monir Hossain’s wife and his brother regarding ongoing civil suits filed against each other (See Background information).

    OMCT is concerned about the progress of the investigation into the acid attack against Ms. Chandana Rani Mando as the main accused persons are yet to be arrested.

    OMCT recalls that the Declaration on the Elimination of Violence against Women states in its article 4(c) that States should "exercise due diligence to prevent, investigate and, in accordance with national legislation, punish acts of violence against women, whether those acts are perpetrated by the State or by private persons."

    Background information:

    Two years ago, Ms. Chandana Rani Mando’s father-in-law Mr. Ramesh Kumar Mandol filed a case against Messrs. Monir Hossain and Amir Hossain who were trying to occupy the land where his family and relatives live. Since then they have been pressurising them to withdraw the case. The parties filed four cases so far over the land dispute. Out of these four cases three are pending in Munshiganj District Judge’s Court and one is pending in the High Court Division of the Supreme Court.

    Requested action:

    Please write to the authorities in Bangladesh urging them to:

    i. ensure Ms. Chandana Rani Mandol’s physical and psychological integrity, including her access to adequate medical treatment;

    ii. carry out a prompt, thorough and impartial investigation into the acid attack on Ms. Chandana Rani Mandol, in order to identify all those responsible and to bring them to justice and apply the penal and/or administrative sanctions as provided by law;

    iii. more generally, ensure women the right to be free from discrimination, including violence, in line with the international laws and standards;

    iv. guarantee the respect for human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
