No. 3852  グルジア:裁判所の外でデモをしていたNGOのメンバー5人が逮捕され、拘禁されています。

国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、グルジアにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は「人権情報記録センター(HRIDC)」と「グルジア青年弁護士協会」より、グルジアのNGO「平等研究所」のメンバー5人が、トビリシ控訴裁判所前でデモを行っていたところ恣意的に逮捕され、その後拘禁されているという情報を入手しました。

情報によると、2006年6月29日、グルジアのNGO「平等研究所」1のメンバーであるイラクリ・カカバゼさん、ズラブ・ルトヴェリアシヴィリさん、ラシャ・チュカルティシヴィリさん、ジャバ・ジシュカリアニさん、ダビト・ダラキシヴィリさんが、トビリシ控訴裁判所前でデモを行っていたところ、同裁判所長官の命令で逮捕されたということです。彼らは独立テレビ局TV202の共同創設者で株主のシャルヴァ・ラミシヴィリさんとデビッド・コクレイゼさんの釈放を呼びかけていました。このテレビ局は、政府の腐敗や、民主主義のための改革の不備などをテーマとする討論番組などを放送しています。この2名は捏造された嫌疑2で2006年3月29日にそれぞれ4年と3年の禁固刑の判決を受けています。この2名は2005年8月27日に逮捕されました。

この5名は裁判所での審理のないまま、エカ・トケシェラシヴィリ裁判所長官より「裁判所内で秩序を乱す」(刑事手続法第208条)嫌疑により、30日間の行政拘禁の判決を言い渡されました。彼らは内務省の予備拘禁センターに連行され、そこで拘禁されたままです。

監視機構は、刑事手続法第208条は裁判所の建物内における秩序を乱す行為に対する責任のみを想定しているものであり、デモ参加者たちはずっと裁判所の外にいたことを指摘します。その上、グルジア刑事手続法第208条に準じて、口頭の審理もなく、控訴もできないこの判決は、グルジア憲法および欧州人権条約にはなはだしく違反しています。

                                                                                     

1 「平等研究所」は作家や人権擁護家、詩人、知識人がメンバーのグルジアの新しいNGO。

2 当局はこの2名がコバ・ベカウーリ国会議員をインタビュー中に脅迫し、15万ドル奪ったという嫌疑で起訴しました。嫌疑は、同国会議員が民間の通関業者を疑わしい状況で買収したという、同議員の評判を傷つける情報を得たとして、この2名のジャーナリストが口止め料を要求したというものでした。


<行動要請>

 グルジア関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、イラクリ・カカバゼさん、ズラブ・ルトヴェリアシヴィリさん、ラシャ・チュカルティシヴィリさん、ジャバ・ジシュカリアニさん、ダビト・ダラキシヴィリさんの心身の安全を保障すること。

2.イラクリ・カカバゼさんが適切な医療を受けられるよう保障すること。

3.彼らの即時無条件釈放を命じること、そして、彼らに対する嫌疑は、表現の自由を行使したことへの制裁であり、恣意的であるため、それらが取り下げられるよう、公正で中立の裁判に付すよう保障すること。

4.グルジアの人権擁護活動家すべてに対する嫌がらせ行為を止めること。

5.人権擁護家に関する宣言、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条、「非政府組織あるいは政府間組織と連絡をとる権利」を定めた第5条c、そして「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

6.さらには、あらゆる情況において、グルジアが批准した国際人権文書に従って、人権尊重と基本的自由を保障すること。

3. To order their immediate and unconditional release and ensure that they be granted a fair and impartial trial so that the charges against them be dropped, as they aim at sanctioning their freedom of expression and are as such arbitrary;

4. To put an end to acts of harassment against all human rights defenders in Georgia;

5. To comply with the Declaration on Human Rights Defenders, in particular article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels”, article 5c, which provides the right “to communicate with non-governmental or intergovernmental organisations”, and article 12.2, which declares that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;

6. To ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with international human rights instruments ratified by Georgia.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Georgia.

Brief description of the situation:

The Observatory has been informed by the Human Rights Information and Documentation Centre (HRIDC) and the Georgian Young Lawyers’ Association about the arbitrary arrest and subsequent detention of five members of the “Equality Institute”, a Georgian NGO, while they were demonstrating outside the Court of Appeal of Tbilisi.

According to the information received, on June 29, 2006, Mr. Irakli Kakabadze, Mr. Zurab Rtveliashvili, Mr. Lasha Chkhartishvili, Mr. Jaba Jishkariani and Mr. Davit Dalakishvili, all members of the “Equality Institute” , were arrested upon order of the Head of the Appellate Court of Tbilisi, while demonstrating outside the Court building. They were calling for the release of Mr. Shalva Ramishvili and Mr. David Kokhreidze, co-founders and shareholders of the independent TV company TV 202, which, in particular, broadcasts a programme called “Debatebi” (debates), dealing with issues like government corruption or lack of reform in favour of democracy. The two men were respectively sentenced to four and three years of prison for “extortion” on March 29, 2006, on the basis of fabricated charges . They had been arrested on August 27, 2005.

The five men were immediately sentenced to 30 days of administrative imprisonment, without any Court hearing, by the Head of the Court of Appeals Ms. Eka Tkeshelashvili, for “staging disorders in a court”(Article 208 of the Criminal Procedural Code), and brought to the pre-trial detention centre of the Ministry of Interior, where they remain detained.

The Observatory points out that Article 208 of the Criminal Procedure Code only envisages responsibility for disorders in the Court building, though the demonstrators were staying outside. In addition, this sentence blatantly contradicts the Constitution of Georgia as well as the European Convention on Human Rights as, pursuant to Article 208 of Criminal Code Procedure of Georgia, it was taken without any oral hearing and cannot be appealed.

Furthermore, the Observatory fears for Mr. Irakli Kakabadze’s health, who suffers from severe form of diabetes.

Actions requested:

Please write to the authorities in Georgia urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Mr. Irakli Kakabadze, Mr. Zurab Rtveliashvili, Mr. Lasha Chkhartishvili, Mr. Jaba Jishkariani and Mr. Davit Dalakishvili;

ii. Ensure that Mr. Irakli Kakabadze has access to appropriate medical treatment;

iii. Order their immediate and unconditional release and ensure that they be granted a fair and impartial trial so that the charges against them be dropped, as they aim at sanctioning their freedom of expression and are as such arbitrary;

iv. Put an end to acts of harassment against all human rights defenders in Georgia;

v.
