No.3853   スーダン:武装グループにより避難民キャンプで男性一人が殺害、二人が傷を負いました。

 SOSトーチャー国際事務局は、スーダンにおける下記の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

SOSトーチャー国際事務局は、SOSトーチャーのネットワークのメンバー団体である「スーダン拷問反対協会(SOAT)」より、2006年6月29日早朝、何者かがカルマ国内避難民(IDP)キャンプを襲撃し、フール人のハルーン・サルマニさん(50歳)を殺害し、アダム・ムサ・アダムさん(65歳)、ラマダン・アブデル・カルミア・モフドさん(22歳)を負傷させたという情報を入手しました。

情報によると、JM3マシンガンやカラシニコフ銃で武装した複数の男性が午前2時頃にカルマIDPキャンプを襲撃しました。第7セクターのケア・インターナショナルの井戸の警備員として雇われていたハルーン・サルマニさんは、寝ていたところを撃たれて殺害されました。さらに、アダム・ムサ・アダムさんは自転車を奪われ、左足を撃たれました。これらの銃撃の後、同キャンプの第7セクターでは空の薬莢3個と弾薬の入った弾薬筒が2つ見つかり、AMIS(アフリカ連合スーダンミッション)に引き渡されました。また、ラマダン・アブデル・カルミア・モフドさんは左肩を撃たれ、左手を負傷しました。この2人は現在ニャラ病院で治療を受けています。

国際事務局はスーダン当局に対し、ダルフール和平協定(DPA)で合意した責務をただちに遂行するよう要請します。国際事務局は、武装グループが今もなおダルフール市民を標的にしていることに対して、SOATとともに憂慮を表明します。このことは、和平協定の基本原則のひとつ、具体的には第23条(217)「文民が暴力、威嚇、脅迫を受けず、強制移住させられないことを確保する」に抵触します。

和平協定の第27条(315)は「すべてのジャンジャウィード/武装民兵とPDFを、各本部、駐屯地、宿営地、地元地域に封じ込め、これらの軍隊が及ぼしている脅威を封じ込め、削減し、最終的に排除するための措置を講じる」ことをスーダン政府に求めています。また同協定第27条(317)は「スーダン政府はアフリカ連合スーダンミッション(AMIS)の支援のもと、ジャンジャウィード/武装民兵による市民への脅威を完全に取り除くために必要なあらゆる措置を講じなければならない」と定めています。

さらに国際事務局はSOATとともに、和平協定やヌジャメナ停戦協定、国連安全保障理事会決議に反して不安定な状態が続き、市民が襲撃されていることに照らし、AMISが国連への委譲前の暫定期間における任務として以下のような保護の任務を実効力をもって果たせるように、同ミッションに対して政治的および財政的支援を行うよう、要請します。

i IDPキャンプ外に出る女性や少女に対する武装警護の再開などの、十分な保護措置の提供

ii DPAに定められている機能を果たすこと。特に、ジャンジャウィード民兵やその他の民兵の武装解除を監視し、確認すること。

iii 様々な武装グループにDPAおよび「DPAに対するコミットメント宣言」に署名するよう圧力をかけ続けること。

<行動要請>

 スーダン関係当局に以下の内容の要請をお願いします。

1.  アダム・ムサ・アダムさんとラマダン・アブデル・カルミア・モフドさんの心身の安全を保障し、必要な医療をすべて受けられるよう保障すること。

2.責任者を特定し、裁判に付し、法にもとづき民事、刑事あるいは行政罰を適用できるよう、これらすべての事件に綿密で公正な調査を命じること。

3.ハルーン・サルマニさんの家族とアダム・ムサ・アダムさんおよびラマダン・アブデル・カルミア・モフドさんに、適切な補償が与えられるよう保障すること。

4.国内法および国際人権基準に沿って、スーダン国内全体における人権尊重と基本的自由を保障すること。

2. To order a thorough and impartial investigation into all these events, in order to identify all those responsible, bring them to trial and apply the civil, penal and/or administrative sanctions as provided by law;

3. To guarantee that adequate compensation is awarded to the family of Mr. Haroun Salmani and to Mr. Adam Musa Adam and Mr. Ramadan Abdel Karmia Mohd;

4. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards;

Extrajudicial execution / Injury / Impunity

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Sudan.

Brief description of the situation

The International Secretariat of OMCT has been informed by the Sudan Organisation Against Torture (SOAT), a member of the OMCT network, that in the early morning of 29 June 2006 unknonwn men attacked Kalma internally dispalced persons camp in Nyala, killing Mr. Haroun Salmani (50) and injuring Mr. Adam Musa Adam (65) and Ramadan Abdel Karmia Mohd (22). All men belong to the Fur tribe.

According to the information received, unknown men armed with JM3 machine guns and Kalashnikovs attacked the IDP camp at around 2.00 am. Mr. Haroun Salmani, employed as a watchman for the Care International Water Pump in sector 7 was shot dead whilst he was sleeping. Furthermore, the bicycle of Mr. Adam Musa Adam was stolen and he was shot was in the left foot. Following the gunshot, IDP’s in sector 7 found three empty shells and two full cartridges which have been handed over to AMIS. Moreover, Mr. Ramadan Abdel Karmia Mohd was shot in his left shoulder and received injuries to his left hand. Both men are currently receiving medical treatment at Nyala hospital.

The International Secretariat of OMCT urges the Sudanese authorities to immediately implement its obligations as agreed in the Darfur Peace Agreement (DPA). The International Secretariat of OMCT together with SOAT expresses its grave concern over the continued targeting of the civilian population in Darfur by armed groups which undermines one of the fundamental principles of the DPA namely article 23 (217): “To ensure that civilians are not subjected to violence, intimidation, threats and forced displacement”.

It should be recalled that article 27(315) of the DPA requires the Government of Sudan to “restrict all Janjaweed/armed militia and PDF to their headquarters, garrisons, cantonment sites or communities and take other steps to contain, reduce and ultimately eliminate the threat posed by such forces”. Furthermore, article 27 (317) states that “Government of Sudan, with support from AMIS, shall take all other steps required to completely eliminate the threat posed by Janjaweed/armed militia to the civilian population....”.

Furthermore the International Secretariat of OMCT together with SOAT urges the Sudanese Government in the light of the continuing instability and attacks on civilians despite the DPA, the N’djamena Ceasefire agreement and the UNSC resolutions, to immediately provide both political and financial support to AMIS to ensure the mission is capable and able to effectively fulfil the protection role of its mandate in the transitional period before the UN takeover through the provision of:

i. Satisfactory protection provisions including resuming the provision of armed escort for women and girls venturing outside IDP camps;

ii. Fulfil its functions as stipulated in the DPA particularly verifying and monitoring the disarmament of the Janjaweed militias and other militias;

iii. Continue to place pressure on the various armed groups to sign the DPA and the Declaration of Commitment to the DPA to sign the peace agreement.

Requested Action

Please write to the Justice and Equality Movement urging them to:

1. Ensure the physical and psychological integrity of Mr. Adam Musa Adam and Mr. Ramadan Abdel Karmia Mohd and ensure that they are provided with all required medical assistance;

2. Order a thorough and impartial investigation into all these events, in order to identify all those responsible, bring them to trial and apply the civil, penal and/or administrative sanctions as provided by law;
