 SOSトーチャー国際事務局は、ネパールにおける下記の状況に関して、引き続き皆様の働きかけをお願いします。

<新情報>

SOSトーチャー国際事務局は、SOSトーチャーのネットワークのメンバー団体であるインフォーマル・セクター・サービス・セクター(INSEC)より、ネパールのハリ・シャラン・マハルジャンさんの事件について情報を受けました。

情報によれば、ハリ・シャラン・マハルジャンさんは、逮捕のあと、チャウニのジャクダル大隊に拘留されました。このことは、2004年8月から9月にかけてチャウニでハリ・シャラン・マハルジャンさんと会ったという2人の証言者に確認されました。さらに、ハリ・シャラン・マハルジャンは2004年10月から11月にバラジュのマハビル大隊に移送されたと言われています。ハリ・シャラン・マハルジャンさんへの人身保護令状請求が、私服の軍人に逮捕されたという主張と共に、2004年11月、最高裁に提出されました。しかし、軍隊は彼が事件に巻き込まれたということを否定しており、彼の所在も不明のままです。

SOSトーチャー国際事務局は、ハリ・シャラン・マハルジャンさんの心身の安全を深く憂慮し、彼が行方不明のままになっているため、虐待や拷問を受けているかもしれないし、もしかすれば超法規的に処刑されているかもしれないと危惧しています。

<背景情報>

 情報によれば、カトゥマンドゥ地区サチュンガルVDC第3区に住む23歳のハリ・シャラン・マハルジャンさんは、2004年7月2日午後4時、カトゥマンドゥ地区サチュンガルVDC第4区のマシンドラ・ナス・ブリック工業の事務所にて、治安職員に逮捕されたようです。同じ工場で働く目撃者によれば、治安職員が工場に来て、ハリ・シャラン・マハルジャンさんを呼び出し、そのまま連れ去りました。彼の家族が国家人権委員会と国際赤十字に事件を通報しました。

 彼の行方と逮捕の理由は不明のままです。しかし、当局は彼にネパール共産党(マオイスト)のメンバーあるいは支持者の疑いをかけているという事実と関係しているかもしれません。

<行動要請>

 ネパール関係当局に以下の内容の要請をお願いします。

1.ハリ・シャラン・マハルジャンさんの所在を即時探しだし、彼の心身の安全を保障するために必要な措置をすべてとること。

2.国際法と国際基準に合致した嫌疑が不在の中、彼をすぐに釈放するよう命じること。もし、そのような嫌疑が存在するならば、彼を公正で資格のある法廷における裁判に付し、その間、彼の手続き上の権利を保障すること。

3.責任者を特定し、裁判に付し、法律に基づき民事、刑事あるいは行政罰を適用できるよう、この事件の情況について、綿密で公正な調査を命じること。

4.国内法と国際人権基準に従い、国内全体における人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the whereabouts of Mr. Hari Sharan Maharjan who was taken by a security officer from his workplace on July 2, 2004. As his whereabouts have remained unknown, I would like to urge you the followings:

1. To immediately locate the whereabouts of Mr Hari Sharan Maharjan and take all measures necessary to guarantee his physical and psychological integrity;

2. To order his immediate release in the absence of legal charges that are consistent with international law and standards, or, if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;

3. To order a thorough and impartial investigation into the circumstances of this event in order to identify those responsible, bring them to trial and apply the civil, penal and/or administrative sanctions as provided by law;

4. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

The International Secretariat of the World Organisation Against Torture (OMCT) has received new information on the following situation in Nepal.

New information

The International Secretariat of OMCT has been informed by the Informal Sector Service Centre (INSEC), a member of the OMCT network, of the case of Mr. Hari Sharan Maharjan in Nepal.

According to the information received, Mr. Hari Sharan Maharjan was detained at Jagdal Battalion, Chhauni, after his arrest. This was confirmed by two witnesses, who said to have met Mr. Hari Sharan Maharjan at Chhauni in August - September 2004. Furthermore, Mr. Hari Sharan Maharjan is said to have been transferred to Mahabir Battalion, Balaju in October-November 2004. It is said that a habeas corpus was filed in the Supreme Court in November 2004 with a claim that Mr. Hari Sharan Maharjan had been arrested by plain-clothes army personnel. However, the army has denied its involvement in the case and his whereabouts remain unknown.

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Mr Hari Sharan Maharjan, as his whereabouts remain unknown, giving rise to fears that he may be being subjected to ill-treatment, torture or potentially extra-judicial execution.

Reminder of the situation

According to the information received, Mr Hari Sharan Maharjan, aged 23, a resident of Bosigaun, ward no. 3 of Satungal VDC of Kathmandu district, was reportedly arrested by security personnel from the office of Machhindra Nath Brick Industry, ward no. 4, Satungal VDC, Kathmandu district on 2 July 2004 at 4 pm. According to a witness working at the same factory, a security person came, called Mr Hari Sharan Maharjan and took him away. His relatives have informed the National Human Rights Commission (NHRC) and the International Committee of the Red Cross (ICRC) about the case.

His whereabouts and reasons for his arrest are unknown. However, it may be related to the fact that the authorities suspect him of being a member or a supporter of the Communist Party of Nepal (CPN) (Maoist).

Action requested

Please write to the authorities in Nepal urging them to:

i. Immediately locate the whereabouts of Mr Hari Sharan Maharjan and take all measures necessary to guarantee his physical and psychological integrity;

ii. Order his immediate release in the absence of legal charges that are consistent with international law and standards, or, if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;

iii. Order a thorough and impartial investigation into the circumstances of this event in order to identify those responsible, bring them to trial and apply the civil, penal and/or administrative sanctions as provided by law;
