憲法改正要求のデモ中にNGOメンバー10人が恣意的に逮捕されました。

SOSトーチャー国際事務局は、ジンバブエにおける下記の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

SOSトーチャー国際事務局は信頼できる消息筋から、ジンバブエで民主主義と法の支配の促進を目指すNGOの連合体である「全国憲法会議(NCA)」のメンバー数人が恣意的に逮捕され、司法手続きがとられているという情報を入手しました。

情報によれば、2006年7月13日にムタレで、憲法改正を求めてデモを行っていたNCAのメンバーであるフューチャー・マトンドさん(男性)、アリンマー・T・ムナフィレイ・ラジャボさん(男性)、フロレンス・ブンドさん(女性)、タプワ・ムンダンゲププさん(男性)、シェルター・ジムンフさん(男性)、アルバート・ムヘツさん(男性)、ルイス・チザカさん(男性)、シェリー・サブリさん(女性)、スチュワート・ムザンビさん(男性)、ルース・カツァンデさん(女性)の10人が逮捕されました。この活動家たちは、公共の秩序に危険を及ぼすデモを犯罪と定める刑法第9章23の37節にもとづいて起訴されました。全員がそれぞれ50万ジンバブエドルの保釈金を支払って保釈されました。審理は2006年7月31日に予定されています。

さらに、2006年7月12日に、幼児を抱えた女性4人を含む128人のNCAメンバーがハラレで逮捕され、ハラレ中央警察で拘禁されました。この人々は刑法(9:23)第46節と別表3の段落2(a)にもとづいて起訴されましたが、この条項はMOA(公共の秩序を乱す行為・迷惑行為取り締まりの法律)を思い出させるようなものであり、また道路交通の妨害に関連しています。第46節は「別表3に規定のある行為をした者は、迷惑行為で有罪となり、罰金もしくは罰金と6ヶ月の禁固となる」 と定めています。活動家のうち、エヴィデンス・ジョンさん(女性)は、ハラレ中央警察のたえがたい拘禁条件と飢えで倒れました。さらに、治療は受けられず、法定代理人に自由に会うこともできず、食事も与えられませんでした。2006年7月15日にNCAメンバーは全員保釈金なしで釈放されました。

このNCAメンバー128人は2006年7月20日にロッテン・ロー治安裁判所に出廷する予定でしたが、同裁判所の検察官が亡くなったので、審理は8月4日に延期されました。

<行動要請>

 ジンバブエ関係当局に以下の内容の要請をお願いします。

1.  フューチャー・マトンドさん、アリンマー・T・ムナフィレイ・ラジャボさん、フロレンス・ブンドさん、タプワ・ムンダンゲププさん、シェルター・ジムンフさん、アルバート・ムヘツさん、ルイス・チザカさん、シェリー・サブリさん、スチュワート・ムザンビさん、ルース・カツァンデさん、およびその他128人のNCAメンバーの心身の安全を保障すること。

2.正当な嫌疑があるならば、彼らを迅速で公正な裁判に付すよう保障すると共に、その間の手続き上の権利はすべて保障すること。

3.責任者を特定し、裁判に付し、法律の規定にしたがって民事、刑事あるいは行政罰を適用するために、これら事件に綿密で公平な調査を行うよう命じること。

4.上記に述べた人々すべてに適正な補償が提供されるよう保障すること。

5.国内法および国際人権基準に沿って、国内全体において人権尊重と基本的自由を保障すること。

1. To guarantee the physical and psychological integrity of Mr. Future Matondo, Mr. Alinmah T. Munafireyi Rajabo, Ms. Florence Bundo, Mr. Tapuwa Mundangepfupfu, Mr. Shelter Zimunhu, Mr. Albert Mhetu, Mr. Louis Chizaka, Ms. Shelly Saburi, Mr. Stewart Muzhambi, Ms. Ruth Katsande and Ms. Evidence John and the other 128 NCA members;

2. To ensure that, in case of valid legal charges, they are given a prompt and fair trial, in which their procedural rights are guaranteed at all times;

3. To order a thorough and impartial investigation into all these events, in order to identify all those responsible, bring them to trial and apply the civil, penal and/or administrative sanctions as provided by law;

4. To guarantee that adequate compensation is awarded to all above-mentioned persons;

5. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Zimbabwe: Arrests and judicial proceedings of NCA members

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in Zimbabwe.

Brief description of the situation

The International Secretariat of OMCT has been informed by a reliable source about the arbitrary arrest and subsequent judicial proceedings of several members of the National Constitutional Assembly (NCA), a grouping of independent NGOs, dedicated to the promotion of democracy and the rule of law in Zimbabwe.

According to the information received, on 13 July 2006, Mr. Future Matondo, Mr. Alinmah T. Munafireyi Rajabo, Ms. Florence Bundo, Mr. Tapuwa Mundangepfupfu, Mr. Shelter Zimunhu, Mr. Albert Mhetu, Mr. Louis Chizaka, Ms. Shelly Saburi, Mr. Stewart Muzhambi and Ms. Ruth Katsande, 10 members of the National Constitutional Assembly (NCA), were arrested in Mutare, while protesting in favour of a constitutional reform. The activists were the charged under Section 37 of the Criminal Law Act Chapter 9:23, which criminalises a demonstration that poses a realised risk to public disorder. They were all released on bail for an amount of ZW$ 500 000 each. The hearing is scheduled on 31 July 2006.

Moreover, on 12 July 2006, 128 NCA members, including four women with infants, were arrested in Harare and detained at the Harare Central police station. They were charged under Section 46 of the Criminal Law Act (9:23) as read with paragraph 2(a) of the Third Schedule to that Act, which is reminiscent of the Miscellaneous Offences Act (MOA) and relates to obstruction of streets and traffic. Section 46 itself states that “any person who does any act specified in the 3rd Schedule shall be guilty of nuisance and liable to a fine or a fine together with six months imprisonment”. One of the activists, Ms. Evidence John, collapsed due to hunger and inhabitable conditions of detention at the Harare Central Police Station cells and was further denied access to medical treatment, unimpeded access to legal representation and food. On 15 July 2006, all NCA members were released on free bail.

The 128 NCA activists were supposed to appear at the Rotten Row Magistrates Court on 20 July 2006, but the hearing was postponed to 4 August 2006, because a public prosecutor who served at the Magistrates Court died.

Action Requested

Please write to the authorities in Zimbabwe urging them to:

1. Guarantee the physical and psychological integrity of Mr. Future Matondo, Mr. Alinmah T. Munafireyi Rajabo, Ms. Florence Bundo, Mr. Tapuwa Mundangepfupfu, Mr. Shelter Zimunhu, Mr. Albert Mhetu, Mr. Louis Chizaka, Ms. Shelly Saburi, Mr. Stewart Muzhambi, Ms. Ruth Katsande and Ms. Evidence John and the other 128 NCA members;

2. Ensure that, in case of valid legal charges, they are given a prompt and fair trial, in which their procedural rights are guaranteed at all times;

3. Order a thorough and impartial investigation into all these events, in order to identify all those responsible, bring them to trial and apply the civil, penal and/or administrative sanctions as provided by law;
