国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、シリアにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 人権擁護家のための監視機構は信頼できる情報筋より、シリアにおける民主主義と人権の促進に深く関わっていることで有名な、作家で大学教授のアリ・シャハビさんが恣意的に拘禁されているという情報を入手しました。

 情報によると、2006年8月10日にシャハビさんはダマスカスにある国家治安局に召喚されました。これは、ここ数ヶ月頻繁に起きていたことでした。シャハビさんが帰宅しなかったので、妻は同局に出かけ、彼について尋ねました。妻はそこで「1週間後に出直して来なさい」と言われました。その言葉は、彼が拘禁されていることを強く示唆するものでした。

 監視機構は、シャハビさんの拘禁について何も情報がないので、彼の心身の安全を危惧します。

 監視機構は、ここ数ヶ月の間に他にも人権活動家や知識人が多数逮捕され、拘禁されている中でこの事件が起きたことに留意します。

 この件について監視機構は、「ダマスカス・ベイルート宣言」に署名した多くの人が逮捕されていることを想起します。この陳情はシリアとレバノンの知識人と人権擁護家が、レバノンとシリアの関係正常化を求めて行ったもので、シャハビさんも署名しています。拘禁されている人々の中には、著名な民主活動家で「表現と報道の自由擁護機構」代表のミチェル・キロさん、シリア人権協会(ASDH)創設者で「良心の囚人擁護委員会(CDF)」委員のアノアール・ブンニさんなどがいます。(アピール番号SYR003/0506/OBS060、OBS060.1、2006年5月18日付FIDH/OMCT共同プレスリリース参照)

<行動要請>

 シリア関係当局に以下の内容の要請をお願いします。

1) いかなる情況にあろうとも、アリ・シャバビさんおよび恣意的に拘禁されているすべての人権擁護活動家の心身の安全を保障すること。

2) シャハビさん並びににその他恣意的に拘禁されているすべての人権擁護家を即時無条件で釈放すること。

3) シリアのすべての人権擁護家に対するすべての形態の嫌がらせに終止符を打つこと。

4) 1998年12月9日国連総会が採択した人権擁護家に関する宣言の条項、とりわけ、「すべての者は、個々にまた他の者と共同して、国内、国際レベルにおいて人権および基本的自由の保護ならびに実現を伸長、奨励する権利を有する」とした第1条と、「国家は、この宣言に掲げられた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するための、すべての必要な措置をとるべきである」とした第12.2条に従うこと。

5) いかなる情況にあろうとも、シリア全土における人権尊重と基本的自由を国際人基準に沿って守ること。

Dear President al-ASAD,

I would like to ask for your attention to the report of an arbitrary detention of Mr. Ali Shahabi, a famous writer and professor, in Damascus. It is also reported that other people who are involved in democratic activities have been also detained. I would like to urge the followings:

1) To guarantee, in all circumstances, the physical and psychological integrity of Mr. Ali Shahabi, and of all human rights defenders arbitrarily detained;

2) To release Mr. Shahabi immediately and unconditionally, as well as all other human rights defenders arbitrarily detained;

3) To put an end to all forms of harassment against all human rights defenders in Syria;

conform with the provisions of the Declaration on Humans Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, in particular article 1, which states that “everyone has the right, individually or in association with others, to promote the protection and realisation of human rights and fundamental freedoms at the national and international levels”, and article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;

4) To ensure in all circumstances respect for human rights and fundamental freedoms in Syria in accordance with international human rights standards.

The Observatory for the Protection of Human Rights Defenders, a joint programme between the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Syria.

Brief description of the situation :

The Observatory has been informed by reliable sources of the arbitrary detention of Mr. Ali Shahabi, a writer and a professor, known for his strong involvement in the promotion of democracy and human rights in Syria.

According to the information received, on August 10, 2006, Mr. Shahabi was summoned to the State security services in Damascus, as it has been regularly the case over the last past months. As Mr. Shahabi did not come back home, his wife went to the services in order to inquire into his situation. She was then told to “come back in a week”, strongly implying that he was being detained.

The Observatory fears for Mr. Shehadeh’s physical and psychological integrity, as there is no information on his conditions of detention.

The Observatory recalls that those acts follow the arrests and detention of many other human rights activists and intellectuals during the past few months.

In this regard, the Observatory recalls that many other persons were arrested after signing the Damascus-Beirut Declaration, a petition initiated by Syrian and Lebanese intellectuals and human rights defenders, calling for the normalisation of relations between Lebanon and Syria, of which Mr. Shahabi was also a signatory. Amongst these persons were Mr. Michel Kilo, a prominent pro-democracy activist and the president of the Organisation for the Defence of Freedom of Expression and the Press, and Mr. Anouar Bunni, founder of the Syrian Human Rights Association (ASDH) and member of the Committee for the Defence of Prisoners of Conscience (CDF), who still remain detained to date (cf. Observatory Urgent Appeals SYR 003/0506/OBS 060 and OBS 060.1, as well as FIDH/OMCT joint press release dated May 18, 2006).

Action requested :

Please write to the Syrian authorities and ask them to :

i. guarantee, in all circumstances, the physical and psychological integrity of Mr. Ali Shahabi, and of all human rights defenders arbitrarily detained;


ii. release Mr. Shahabi immediately and unconditionally, as well as all other human rights defenders arbitrarily detained;

iii. put an end to all forms of harassment against all human rights defenders in Syria;

  iv. conform with the provisions of the Declaration on Humans Rights Defenders, adopted by the

General Assembly of the United Nations on December 9, 1998, in particular article 1, which states

that “everyone has the right, individually or in association with others, to promote the protection and

realisation of human rights and fundamental freedoms at the national and international levels”, and

article 12.2, which provides that “the State shall take all necessary measures to ensure the protection

by the competent authorities of everyone, individually or in association with others, against any
