No.3866    マレーシア:民間の人権協会の会長を務める弁護士の殺害をよびかける電子メールが広範に流されました。

「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、マレーシアにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構はマレーシアの人権団体「SUARAM」より、弁護士でマレーシア全国人権協会(HAKAM)会長のマリク・イムティアズ・サルワルさんが深刻な殺害の脅迫を受けているという情報を入手しました。

入手した情報によると、2006年8月中旬、オンライン・ニュースサイトの「Malaysiakini」を含む様々なアドレス宛に、「殺害求む」という言葉つきのイムティアズ・サルワルさんの写真が電子メールで送られてきました。その電子メールにはさらに「この裏切り者のことを皆なが分かるよう、たくさんの兄弟にこのメールを送れ。路上で彼が死んでいたら、そのままにせよ。助けるな!」と書かれていました。このメッセージは携帯電話のショートメールでも広く送られています。

マレーシア・イスラム教徒青年運動(ABIM)やジェマー・イスラー・マレーシア(JIM)、ムスリム・プロフェッショナル・フォーラムはこの行為を非難しています。

情報によれば、この脅迫はイムティアズ・サルワルさんがマレーシア弁護士協会を代表して、リナ・ジョイさんの裁判を傍聴していることに直接関係があると思われるということです。リナ・ジョイさんはイスラム教からキリスト教に改宗し、身分証明書からイスラムの文字を削除するよう国家登録局に申請したものの却下され、訴訟を起こしました。この申し立ては高裁と控訴裁判所で却下され、今は連邦裁判所で係争中です。

また、イムティアズ・サルワルさんは宗教的自由の権利擁護活動に深く関わっており、とくに弁護士協会が議論している「宗教間評議会」の設立の提案に関わっています。また、NGO13団体の連合である「第11条」が主催した、憲法で保障された自由と宗教の自由に関する連続フォーラムで講演しています。

監視機構はイムティアズ・サルワルさんに対する脅迫を懸念するとともに、マレーシアにおける宗教の自由の促進活動にたずさわる人権擁護家の状況全般を懸念します。これに関して、人権NGOの連合と「第11条」の主催で、宗教の自由とマレーシア憲法の非宗教性の保護をテーマとした「連邦憲法 すべての人を保護する」という2006年5月14日に予定されていたフォーラムに、100人ほどのデモ隊がポスターを掲げて押しかけ、「アッラーの法は人権に勝る」といったスローガンを叫びながら開催場所のホテルを襲おうとしたため、キャンセルされたことを監視機構は想起します。(2006年5月22日付マレーシア当局宛公開書簡参照)

<行動要請>

 マレーシア関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、マリク・イムティアズ・サルワルさんおよびマレーシアのすべての人権擁護家の心身の安全を保障すること。

2.サルワルさんに対する殺しの脅しを行なっている人々すべてを特定し、裁判に付し、法に基づいて判決を適用するために、独立した事実調査を即時行なうこと。

3.1998年12月9日に国連総会が採択した国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を順守すること。

4.国際人権基準およびマレーシアが批准した国際人権文書にしたがい、いかなる情況にあろうとも、人権尊重と基本的自由を保障すること。

Dear Prime Minister,

I would like to express my concern over the situation of Mr. Malik Imtiza Sarwar, a lawyer and the president of HAKAM, who has been targeted for the death threat on the Internet since middle of August. I would like to urge you the followings:


1) To guarantee in all circumstances the physical and psychological integrity of Mr. Malik Imtiaz Sarwar and all human rights defenders in Malaysia;

2) To conduct an immediate and independent investigation into these facts in order to identify the authors of the death threats against him, bring them to justice and sentence them according to law;

3) To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels”, and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;

4) To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the People’s Republic of Malaysia

Death threats

Malaysia

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Malaysia.


Brief description of the facts:

The Observatory has been informed by SUARAM, a Malaysian human rights organisation, of serious death threats received by Mr. Malik Imtiaz Sarwar, a lawyer and the President of the National Human Rights Society of Malaysia (HAKAM).

According to the information received, in mid-August 2006, an electronic message was widely circulated to several addresses, including the online news portal Malaysiakini, presenting a photograph of Mr. Imtiaz Sarwar with the following message above the picture: “Wanted dead”. The following text was written below : “Spread this to our brothers so that they recognise this traitor. If he is found dead on the roadside, let him be. Do not help !”. This message was also circulated in the form of SMS (short messaging service).

These acts were denounced by the Malaysian Islamic Youth Movement (ABIM), the Jemaah Islah Malaysia (JIM) and the Muslim Professional Forum.

According to the information received, these threats would be directly linked to his holding of a watching brief on behalf of the Malaysian Bar in the case of Ms. Lina Joy, who converted from Islam to Christianity and who lodged a complaint against the National Registration Department, after this Department rejected her application in order to have the word Islam deleted from her identity card. The case is now pending at the Federal Court after her appeal was dismissed by the High Court and the Court of Appeal.

More generally, Mr. Malik Imtiaz Sarwar has been very involved in defending the right to freedom of religion, in particular by participating in the proposal of the setting up of the Inter Faith Council (IFC) mooted by the Bar Council and by speaking in a series of public forum on constitutional rights and freedom of religion organised by Article 11, a coalition of 13 NGOs.

The Observatory is very concerned about the threats against Mr. Imtiaz Sarwar, and more generally about the situation of human rights defenders involved in the promotion of freedom of religion in Malaysia. In this regard, the Observatory recalls that on May 14, 2006, a forum entitled “A Federal Constitution - Protection for All”, organised by the human rights NGO Aliran and Article 11, in order to discuss issues such as freedom of religion and the safeguard of the secular nature of the Malaysian Constitution, had to be cancelled after around 100 demonstrators, who were holding posters and shouting slogans such as “Allah’s law prevails over human rights”, tried to assault the hotel where the forum was to take place (see Observatory Open Letter of the to the Malaysian authorities, dated May 22, 2006).

Actions requested:

Please write to the Malaysian authorities asking them to :

i. guarantee in all circumstances the physical and psychological integrity of Mr. Malik Imtiaz Sarwar and all human rights defenders in Malaysia;

ii. conduct an immediate and independent investigation into these facts in order to identify the authors of the death threats against him, bring them to justice and sentence them according to law;
