女性の法学部学生が大学職員たちから性暴力を受けました

 SOSトーチャー国際事務局は、パキスタンにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

SOSトーチャー国際事務局は信頼できる情報筋1より、2006年7月28日にカラチ大学の女子学生が、イスラム学部の職員3人と物理学部の学生1人からなる4人の男にレイプされそうになったという情報を入手しました。

数週間たっても、大学当局が事件を警察に通報していないことを国際事務局は強く非難します。これまでのところ、副学長のピルザダ・カシム博士が容疑者を数日間停職にしただけです。事件が新聞で大きく報じられたにもかかわらず、副学長は被害者が警察に事件を告訴するのを妨げているということです。

情報によると、容疑者たちは今も毎日大学に来ることを許され、学生たちの事件に対する抗議活動をやめさせようと圧力をかけているということです。容疑者たちはまた、「パキスタン・レンジャーズ」というグループのメンバーの何人かから、支援を受けているということです。被害者とその家族は見つかりにくい場所に避難することを余儀なくされたということです。

国際事務局は、容疑者たちが、大学当局が設置した調査委員会に対して、書面で罪を認めたという事実を懸念します。このことは、NGOの事実究明チームに対して、大学の主要な当局者が認めています。また、NGO事実究明チームは事件の容疑者のうち2人が、カラチ大学内にあるシーク・ザイド・イスラミック大学で起きた同じような事件でも一度捕まったことがあることを発見しました。しかし、パキスタン・レンジャーズの影響力によってその事件はうやむやにされ、2人は懲罰的な処分を受けた後、カラチ大学イスラム学部に異動になったということです。

国際事務局は、このような暴力と、多くの事件で加害者が免責になっており、性的暴力の被害者である女性が逆にいわゆる「フドゥード法」によって姦淫で起訴され被告の立場されている状況を断固として非難します。

国際事務局は、「女性に対する暴力の撤廃に関する宣言」の第4条(c)項「国家によってなされるか私人によってなされるかを問わず、女性に対する暴力行為を防止し、調査し、および国内法に従って処罰するために相当の注意を払うこと」に従い、パキスタン当局が相当の注意を払って加害者を調査、起訴、処罰するよう要請します。

<行動要請>

 パキスタン関係当局に以下の内容の要請をお願いします。

1.被害者の学生とその家族の心身の安全を保障すること。

2.責任者すべてを特定し、裁判に付し、法律に基づき刑事あるいは行政罰を適用すること。

3.国際法および国際基準に沿って、暴力を含む差別を女性および少女がうけない権利を保障すること。

4.国内法および国際人権基準に沿って国内全体における人権尊重と基本的自由を保障すること。

VIOLENCE AGAINST WOMEN
Attempted rape/ Impunity

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Pakistan.

Brief description of the situation:

The International Secretariat of OMCT has been informed by a reliable source of the rape attempt on a female law student at Karachi University by four men involving three staff members of the Islamic Learning Department and one student of the Physics Department on 28 July 2006.

OMCT strongly condemns the fact that several weeks later, the authorities of the University have still not reported the case to the police. So far the Vice Chancellor of the University of Karachi, Dr. Pirzada Qasim, only suspended the alleged perpetrators a few days. Even though the incident was widely publicised in the newspapers, he also allegedly prevented the victim from lodging a complaint to the police station.

According to the information received, the alleged perpetrators are still allowed to visit the University campus daily and have pressurised students to stop protesting against the incident. They are also allegedly supported by some members of a group called the Pakistan Rangers. The victim and her family have been left with no other option but to take refuge in an anonymous location.

OMCT is concerned by the fact that the four alleged perpetrators reportedly confessed to their crime in writing before the inquiry committee set up by the University’s authorities to investigate the case. This fact was confirmed by key University authorities before a fact-finding team sent by an NGO. The team has also discovered that the two main perpetrators of this incident had been caught once before for a similar incident at Sheikh Zaid Islamic University which is located within the premises of the Karachi University. However, the alleged influence of the Rangers led to the incident being hushed up and after a disciplinary action they were transferred to the Islamic Learning Department of the Karachi University.

OMCT firmly condemns this kind of violence and the impunity enjoyed by the authors in many cases, sometimes placing women victims of sexual assault in a position of defendants charged with fornication pursuant to the so-called Hudood Laws.


OMCT calls upon the government of Pakistan to investigate, prosecute and punish the perpetrators with due diligence, in compliance with the Declaration on the Elimination of Violence against Women, which in article 4(c) affirms that States should “exercise due diligence to prevent, investigate and, in accordance with national legislation, punish acts of violence against women, whether those acts are perpetrated by the State or by private persons.”


Requested action:

Please write to the authorities in Pakistan urging them to:

i. Guarantee the physical and psychological integrity of the victim and her family;

ii. Order a thorough and impartial investigation into these events, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;

iii. Ensure women and girls the right to be free from discrimination, including violence, in line with the international laws and standards;

iv. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
