No. 3880 ロシア:平和的な集会を主催した団体の理事が恣意的に逮捕拘禁されました
(ジュネーブ・パリ発  9月28日)

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ロシアにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は「メモリアル人権センター」より、「フォー・ヒューマン・ライツ」という全国的な市民運動団体の理事であるレヴ・ポノマレフさんがモスクワで拘禁されたという情報を入手しました。

入手した情報によると、レヴ・ポノマレフさんは正式な許可なく2006年9月3日にベスランの虐殺事件の2周年を記念するイベントを主催したことにより、2006年9月26日にモスクワ第370裁判所で禁固3日間の判決を受けました。しかし、2004年6月に採択された「集会、会合、デモ、行進、ピケに関する連邦法」によれば、集会をする団体は当局に通知するだけでよく、許可をとる必要はありません。

監視機構は、2006年8月29日にモスクワ中央区が、この集会をルビヤンカ広場で開催したいという人権団体数団体の通知を却下し、別の祝賀行事が予定されているということを理由に、別の日程か別の場所で開催するよう提案したことを想起します。しかし、この人権団体の数団体は当局のあげた理由は偽りだとして、ルビヤンカ広場で集会を決行し、プラカードを掲げることにしました。この集会で参加者たちはベスランの虐殺事件に責任のある政治当局と警察当局、そして特に連邦保安庁(FSB)の職員を裁判にかける必要性を訴えました。

2006年9月3日、参加者たちがルビヤンカ広場に到着すると、警察が金属のバリケードで広場を封鎖し、集会の許可は出ていないと参加者たちに言いました。そして人権擁護家や活動家20人が特別部隊に逮捕され、近くの警察署に連行されました。彼らはすぐに釈放されました。

監視機構はポノマレフさんの拘禁は平和的集会の自由を制限する目的であるため、恣意的だと考えます。そして、ロシア連邦において人権擁護家に対する敵意が増しており、その中でこのような弾圧行為が起こっているとして、懸念を表明します。監視機構は、今回のポノマレフさんに対する判決が司法的な前例となって、当局が他の人権集会の主催者を起訴するよりどころになるのではないかと危惧します。

<行動要請>

 ロシア関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、レヴ・ポノマレフさん並びにロシアの人権擁護家の心身の安全を保障すること。

2.恣意的な拘禁を強いられているレヴ・ポノマレフさんを即時無条件で釈放し、彼並びにロシア連邦のすべての人権擁護家に対するあらゆる形態の嫌がらせを止めること。

3.どのような情況であれ、結社および平和的集会の自由を保障すること。

4.1998年12月10日に国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条、「すべての人は、個人的にあるいは他の人々と共に、国内および国際レベルにおいて、非政府組織、協会あるいは団体を結成したり、加入してりあるいは参加する権利を有する」とした第5条b、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項、そして、「すべての人は、個人的にまた他の人々と共に、平和的手段を通して、不作為によるものを含み、人権や基本的自由の侵害を招くような政府に起因する活動や行為に対して、また、人権や基本的自由の享有に悪影響を及ぼす集団あるいは個人による暴力行為に対して、反対する際に、国内法のもと有効的に保護される権利がある」とした第12条3項に従うこと。

5.さらには、世界人権宣言の内容およびロシア連邦が関係している人権に関する国際および地域メカニズムを順守すること。

To comply with the provisions of the UN Declaration on Human Rights Defenders, adopted by the UN General Assembly on December 9, 1998, in particular article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels”, article 5.a stating that “for the purpose of promoting and protecting human rights and fundamental freedoms, everyone has the right, individually and in association with others, at the national and international levels, to meet or assemble peacefully”, article 12.2, which declares that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration” and article 12.3, which provides that “everyone is entitled, individually and in association with others, to be protected effectively under national law in reacting against or opposing, through peaceful means, activities and acts, including those by omission, attributable to States that result in violations of human rights and fundamental freedoms, as well as acts of violence perpetrated by groups or individuals that affect the enjoyment of human rights and fundamental freedoms";

5. More generally, to comply with the terms of the Universal Declaration of Human Rights and regional and international mechanisms concerning human rights, to which the Russian Federation is a party.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in the Russian Federation.

Brief description of the situation:

The Observatory has been informed by Memorial Human Rights Center of the detention of Mr. Lev Ponomarev, executive director of the organisation All-Russian Public Movement "For Human Rights", in Moscow.

According to the information received, on September 26, 2006, Mr. Lev Ponomarev was condemned by the Tribunal n°370 of Moscow to a three-day prison term for having organized a commemoration of the second anniversary of the Beslan massacre on September 3, 2006, without any official authorization. However, according to the “Federal Law on Assemblies, Meetings, Demonstrations, Processions and Pickets”, adopted in June 2004, organisations do not need to obtain an authorization to gather but only to inform the authorities.

The Observatory recalls that, on August 29, 2006, the central district of Moscow prefecture had rejected the notification presented by human rights organisations to hold this gathering on Lubyanka Square, proposing organisers to gather in another place or at another date under the pretext that other celebrations were planned. However, the human rights organisations decided to uphold the gathering in Lubyanka Square with placards, considering that the reason given by the authorities was not valid. During the meeting, the participants called for the need to try those responsible of the Beslan massacre, including political and police authorities, in particular FSB officers.

On September 3, 2006, as the participants were arriving at Lubyanka Square, they found the place barricaded by police officers with metallic roadblocks, who told them that they had no authorization to gather. Twenty human rights defenders and activists were then arrested by members of the special forces and taken to the nearest police station. They were released soon afterwards.

The Observatory considers Mr. Ponomarev’s detention as arbitrary, since it aims at restricting freedom of peaceful assembly and expresses its concern about these new acts of repression, which occur in the context of an increasing climate of hostility against human rights defenders in the Russian Federation. The Observatory fears that the decision against M. Ponomarev could create a judicial precedent, as the authorities could invoke it to proceed other human rights gatherings organizers.

Action requested:

Please write to the Russian authorities urging them to:

i. guarantee in all circumstances the physical and psychological integrity of Mr. Lev Ponomarev, as well as all Russian human rights defenders;

ii. release Mr. Ponomarev immediately and unconditionally since his detention is arbitrary and put an end to any kind of harassment against him, as well as against all human rights defenders in the Russian Federation;

iii. guarantee in all circumstances freedom of assembly and peaceful gathering:
