No.3882 シリア:恣意的に逮捕された学識者の行方が判明しましたが、正式な理由もないまま拘禁されつづけています。

「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、シリアにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は、信頼ある情報筋より、2006年8月10日に拘束された作家であり大学教授のアリ・シャハビさんの居所が分かったという知らせを受けました。

その情報によれば、シャハビさんはアドゥラ刑務所に拘禁されていて、家族は10月16日に面会できたそうです。家族はまた、毎週火曜日に面会してよいと言われましたし、シャハビさんの健康状態は良かったそうです。

しかし、監視機構は、シャハビさんは「非合法政党を結党」したことと、レバノンとシリアの関係正常化を求めたベイルート・ダマスカス宣言に2006年5月署名したことで告訴されたと聞いています。正式な起訴理由はないものの、彼は間もなく裁判に出廷させられるようです。

シャハビさんは執筆活動を通して、シリアにおける基本的自由と民主主義の促進に深く関ってきました。また、公開討論や、人権擁護のための座り込みあるいは会合に積極的に参加してきました。1年前、彼は「すべての人のシリア」と呼ばれる「運動」を開始し、民主主義や基本的自由に関する記事を掲載したホームページを開設しましたが、これはすぐに当局が破壊させました。

監視機構は、拘禁はシャハビさんの表現と結社の自由を奪う目的だけで行なわれているため、恣意的であると考えます。

<行動要請>

 シリア当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、シャハビさんおよび恣意的に拘禁されているすべての人権擁護家の心身の安全を保障すること。

2.シャハビさんの拘禁は恣意的なため、即時の釈放を保障すること。

3.シリアのすべての人権擁護家に対するあらゆる形態の嫌がらせに終止符を打つこと。

4.1998年12月8日に国連総会で採択された人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

5.国際人権基準に沿って、シリア国内における人権尊重と基本的自由を保障すること。

Dear President ASAD,

I am writing you to express my concern over the report of Mr. Ali Shahabi, a writer and a professor, who has recently been found to be detained in the Adra prison.? As his detention is arbitrary, I would like to urge you the followings?:

1. To guarantee, in all circumstances, the physical and psychological integrity of Mr. Ali Shahabi, and of all human rights defenders arbitrarily detained;
2. To ensure Mr. Shahabi’s immediate release, since his detention is arbitrary;
3. To put an end to all forms of harassment against all human rights defenders in Syria;
4. To conform with the provisions of the Declaration on Humans Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, in particular article 1, which states that “everyone has the right, individually or in association with others, to promote the protection and realisation of human rights and fundamental freedoms at the national and international levels”, and article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”, and with the provisions of the above-mentioned International Convention for the Protection of all Persons from Enforced Disappearance;
5. More generally, to ensure in all circumstances respect for human rights and fundamental freedoms in Syria in accordance with international human rights standards.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Syria.

New information:

The Observatory has been informed by reliable sources that the whereabouts of Mr. Ali Shahabi, a writer and a professor, who has been detained since August 10, 2006, have been found.

According to the information received, Mr. Shahabi is detained at the Adra prison, where his relatives were able to visit him on October 16, 2006. His relatives were also informed that they would be allowed to visit him every Tuesday and found him in good health.

However, the Observatory was informed that Mr. Shahabi was accused of “creation of an illegal party” and of having signed the Beirut-Damascus Declaration in May 2006, which called for the normalisation of relations between Lebanon and Syria. There is no official charges against him but Mr. Shahabi should appear before a judge soon.

Mr. Shahabi has been very involved in promoting fundamental freedoms and democracy in Syria through his writings and by taking part in public discussions forums, sit-ins and meetings dedicated to the defence of human rights. One year ago, he began to launch a “movement” called “Syria for all” and created a website, with articles on democracy and fundamental freedoms, which was then destroyed by the authorities.

The Observatory considers that Mr. Shahabi’s detention is arbitrary as it only aims at sanctioning his freedom of expression and of association.

Background information:

On August 10, 2006, Mr. Shahabi was summoned to the State Security Services in Damascus, as it had been regularly the case over the last past months. As Mr. Shahabi did not come back home, his wife went to the services in order to inquire into his situation. She was then told to “come back in a week”, strongly implying that he was being detained. Although his relatives tried to visit him on numerous occasions at the State Security Services office, they were denied the right to see him, under the pretext that he would still be “interrogated”, and were not informed of his whereabouts.

Action requested :
Please write to the Syrian authorities and ask them to :

i. guarantee, in all circumstances, the physical and psychological integrity of Mr. Ali Shahabi, and of all human rights defenders arbitrarily detained;
ii. ensure Mr. Shahabi’s immediate release, since his detention is arbitrary;
iii. put an end to all forms of harassment against all human rights defenders in Syria;
