　国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、イエメンにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

＜事件の概要＞

　人権擁護家のための監視機構はパレスチナのNGO「アル・ハク（Al-Haq）」や「エジプト人権機構(EOHR)」、「囚人支援人権センター(HRCAP)」など複数の信頼できる情報筋より、「イエメン人権・民主的自由擁護センター」の常任理事であるアリ・アルダイラミさんが恣意的に拘禁されているという情報を入手しました。

　情報によると、アリ・アルダイラミさんは2006年10月9日に首都サヌアの空港でイエメン治安部隊に恣意的に逮捕されました。彼は、デンマーク人権研究所がイエメンのNGOとの協力事業について話し合うために開催する会議に出席するためにコペンハーゲン市（デンマーク）に向かうところでした。

　このアピール発表時点でもアルダイラミさんは隔離拘禁のままであり、政治的な治安部隊（アル・アーム・アル・セヤシ）は彼の拘禁場所と逮捕理由の公表を拒んでいます。

　監視機構はアリ・アルダイラミさんの隔離拘禁を強く非難し、拷問や虐待を危惧し、彼の心身の安全を憂慮します。

＜行動要請＞

　イエメン関係当局に以下の内容の要請をお願いします。

1．いかなる情況にあろうとも、アリ・アルダイラミさんの心身の安全を保障すること。とりわけ、拘禁中に彼が残虐、非人道的あるいは品位を貶める扱いや処罰を受けないよう保障すること。

2．アルダイラミさんの消息および拘禁状況に関する情報を最大限明確に提供すること。

3．正当な嫌疑が不在の中、アルダイミラさんを即時無条件で釈放すること。もし正当な嫌疑があるならば、彼を遅れることなく直ちに公正な裁判に付し、その間、法律家の助言へのアクセスを含み、あらゆる手続き上の権利を保障すること。

4．イエメンの人権擁護活動家すべてに対する嫌がらせをやめること。

5．国連の人権擁護家に関する宣言の条文、とりわけ、「すべての者は、個々にまた他の者と共同して、国内、国際レベルにおいて人権および基本的自由の保護ならびに実現を伸長、奨励する権利を有する」とした第1条、「NGOおよび政府系組織と連絡をとりあう権利」を認めた第5条(c)、そして、「国家は、この宣言に掲げられた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するための、すべての必要な措置をとるべきである」とした第12.2条に従うこと。

7．国際基準およびイエメンが批准した国際人権文書に従い、人権尊重と基本的自由を保障すること。

URGENT APPEAL - THE OBSERVATORY

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Yemen.

Brief description of the situation:

The Observatory has been informed by several reliable sources, including the Palestinian NGO Al-Haq, the Egyptian Organisation for Human Rights (EOHR), and the Human Rights Centre for the Assistance of Prisoners (HRCAP), about the arbitrary detention of Mr. Ali Al-Dailami, Executive Director of the Yemeni Organisation for the Defence of Human Rights and Democratic Freedoms.

According to the information received, on October 9, 2006, Mr. Ali Al-Dailami was arbitrarily arrested at the airport of Sana’a, the capital, by the Yemeni security forces, while he was heading to Copenhagen (Denmark), in order to participate in a conference organised by the Danish Institute for Human Rights about its programme of cooperation with some Yemeni NGOs.

As of the date of issuing this urgent appeal, Mr. Al-Dailami remains detained incommunicado, the political security forces (al-Amn al-Seyasi) refusing to say where he is detained and the reasons for his arrest.

The Observatory strongly condemns the incommunicado detention of Mr. Al-Dailami, and expresses its deep concern about his physical and psychological integrity, fearing that Mr. Al-Dailami may be at risk of torture and ill-treatment.

Actions required:

Please write to the Yemeni authorities urging them to:

i.         Guarantee in all circumstances the physical and psychological integrity of Mr. Ali Al-Dailami, and in particular ensure that he be not subjected to torture or other cruel, inhuman or degrading treatment or punishment during his detention;

ii.       Provide, with the greatest celerity, information on his whereabouts as well as on his conditions of detention;

iii.      Order the immediate and unconditional release of Mr Ali Al-Dailami in the absence of any valid charges against them, or in the case of valid charges against them, bring them before an impartial tribunal without delay and guarantee procedural rights at all times, ensuring, among others, that they have access to legal advice;

iv.     Put an end to any kind of harassment against all Yemeni human rights defenders;

v.       Conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels”, “to communicate with non-governmental or intergovernmental organisations” (article 5c), and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;

vi.     Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the Republic of Yemen.
