SOSトーチャー国際事務局は、モルディブにおける下記の状況に関して皆様の緊急の働きかけをお願いします。
＜事件の概要＞
SOSトーチャー国際事務局は信頼できる情報筋より、モルディブ民主党（MDP）が迅速な憲法改正を求めて2006年11月10日に全国的なデモを予定し、呼びかけたところ、10月末から11月はじめにかけて、ガーフ・ダール環礁南部と首都マレで複数のMDP党員が警察に恣意的に逮捕され、虐待を受けたという情報を入手しました。
情報によると、2006年11月1日の12時頃、完全武装した機動隊員約70人が高速艇でガーフ・ダール環礁南部のティナドゥー島に上陸しました。機動隊は島に着くとまっすぐMDPの事務所に向かいました。その途中、機動隊はMDPのガーフ・ダール選挙区副支部長、モハメド・ガサムさんを逮捕し、そのままMDPの事務所に無理やり同行させました。
機動隊は捜索令状や逮捕令状なしでMDPの事務所に入りました。当時、事務所ではMDPの党員6人が勤務中でした。機動隊は彼らに対し、すぐ退去しなければ逮捕すると言って脅しました。そして事務所中を捜索し、横断幕やポスター、その他の資料を押収しました。その後、モハメド・ガサムさんは事務所からまっすぐティナドゥー島にある拘禁施設に連行されました。
同じ日、別の機動隊のグループがMDPのガーフ・ダール選挙区の執行委員会書記のモハメド・ナジムさんに近づきました。その時、彼は自分の店で働いていました。機動隊は彼に警察署への同行を求めました。
モハメド・ナジムさんとモハメド・ガサムさんの2人はティナドゥー島にある拘禁施設で隔離拘禁され、拘禁中に催涙スプレーを顔面にかけられたということです。
さらに国際事務局は以下の4人がティナドゥー島で拘禁されているという情報を入手しました。同島の当局者が島中を車でまわり、この4人をかくまえば犯罪とみなすとふれまわったということです。
１ モハメド・サリーム・アリさん 男性、ティナドゥー島ナルギス・ヴィラ在住、MDPガーフ・ダール選挙区支部長。2006年11月1日に自宅で機動隊に逮捕される。
２ ヤミン・モハメドさん 男性、ティナドゥー島アバリージ在住、MDP党員
機動隊が自分を捜していると知り、出頭。
３ モハメド・ワヒードさん 男性、ティナドゥー島スクーナー在住、MDP党員
2006年11月1日に自宅で機動隊に逮捕される。
４ モハメド・ニヤズさん 男性、ティナドゥー島ブルーフィッシュ在住、MDP党員
2006年11月1日に逮捕されたということ以外は不明
モハメド・ワヒードさんとモハメド・サリーム・アリさんは逮捕された時にひどい虐待を受けたということです。モハメド・ワヒードさんは顔がはれあがるほど殴打され、モハメド・サリーム・アリさんは手の骨を折りました。情報によると、モハメド・サリーム・アリさんは手当てを求めましたが拒否され、11月2日にガーフ・アリフ環礁ヴィリンジリ島に連れていかれて治療を受けるまで何もしてもらえませんでした。その上、入手した情報によると、2時頃にヤミン・モハメドさんは房から出され、手錠をかけられ首をひきずられ、機動隊にひどく殴打されました。また、被拘禁者が房の中で大きい音を立てたところ、部屋の中に催涙スプレーをまかれたということです。
2006年11月3日に150人の人が島政府に機動隊の沈静化を求めてデモを行ったところ、このデモは暴力的に解散させられ、以下の6人のMDP党員が逮捕されたということです。
１ アハメド・フッサイさん（男性）
２ モハメド・ニヤズさん（男性、11月1日に逮捕されたモハメド・ニヤズとは別人）
３ キナアナト・モハメドさん（男性）
４ ムトタキム・ラティーフさん（男性）
５ イブラヒム・アリーフさん（男性）
６ アハメド・シャウカットさん（男性）
また、首都マレでも以下の人々が逮捕されたという情報を国際事務局は入手しました。
１ モハメド・ジヤドさん(男性) MDP全国委員会委員であり活発な改革論者。2006年10月30日にカフェでコーヒーを飲んでいたところを逮捕される。約8人の機動隊員がカフェに来て逮捕した。逮捕の理由は「マレの幹線道路で車の運転手を脅迫したこと」だと彼は聞かされた。
２ モハメド・ファラさん(男性) MDPマレ選挙区副支部長。2006年10月30日に逮捕されたと言われているが、逮捕の理由についての説明はない。
３ アブドゥル・マジード・シャミームさん(男性) MDP支部長。2006年10月31日に逮捕されたが、逮捕の理由についての説明はない。
４ シェヘナズ・アブドゥラさん(女性) 2006年11月10日の集会の調整をMDPに依頼された人物。彼女は2006年11月6日に逮捕された。彼女は手錠をかけられ、機動隊の車に乗せられた。
SOSトーチャー国際事務局は、上記の人々の心身の安全を憂慮します。国際事務局は、これらの事件はモルディブ政府が2006年9月に加盟した「市民的及び政治的権利に関する国際規約(ICCPR)」の第7条と9条(1)、(5)項に規定されている「何人も、拷問又は残虐な、非人道的な若しくは品位を傷つける取扱い若しくは刑罰を受けない。何人も、恣意的に逮捕され又は抑留されない。」および「違法に逮捕され又は抑留された者は、賠償を受ける権利を有する。」の明白な違反であると指摘します。国際事務局は、この人権侵害に責任ある者を特定するために、警察による恣意的拘禁と虐待に関する公平な調査に着手し、加害者を裁判に付すよう、当局に要請します。
＜行動要請＞
モルディブ関係当局に以下の内容の要請をお願いします。
1.いかなる情況にあろうとも、上に述べた人々の心身の安全を保障すること。
2．国際法および国際基準に合致した正当な嫌疑不在の中、上記の人々を即時釈放するよう命じること。もしそのような嫌疑があるならば、彼らを公正で資格のある法廷に付し、その間、彼らの手続き上の権利を保障すること。
3．責任者を特定し、裁判に付し、法に基づいて刑事あるいは行政罰を適用するために、これら事件、とりわけ、虐待の申し立てについて綿密で公正な調査を命じること。
4．必要に応じて、上記の人々に対し適切な医療支援を保障すること。
5．上記の人々に対する適切な補償を保障すること。
6．国際人権基準に従って国内全体における人権尊重と基本的自由を保障すること。

Arbitrary detention/ Ill-treatment/ Harassment

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in the Republic of Maldives.
Brief description of the situation:
The International Secretariat of OMCT has been informed by a reliable source about the arbitrary detention and ill-treatment of various members of the Maldivian Democratic Party (MDP) in the Southern Atolls of Gaaf Dhaal and Male by policemen between end of October and beginning of November 2006 following a call from the MDP for a country wide demonstration to be originally held on 10 November 2006 to urge for faster constitutional reform.
According to the information received, on 1 November 2006, at approximately 12:00, about 70 riot force police, in full riot gear, arrived by speedboats to Thinadhoo Island in the Southern Atoll of Gaaf Dhaal. Upon arrival, the riot police proceeded straight to the office building of the MDP. While on their way, they apprehended Mr. Mohamed Gasam, Deputy President of the Gaaf Dhaal Constituency of MDP, and forced him to accompany them to the MDP office.
The riot police then reportedly invaded without any search or arrest warrant the MDP office building, where six members of MDP were working. The riot police threatened these individuals by telling them that if they did not leave the office immediately, they would be arrested. The riot force then proceeded to ransack the office and confiscated banners, posters and other material. Following these events, Mr. Mohamed Gasam was taken to a holding cell on Thinadhoo Island straight from MDP office.
On the same day, a group of riot police approached Mr. Mohamed Nazim, Secretary of the Executive Committee for Gaaf Dhaal Constituency of MDP, while he was working in his shop. He was asked to accompany the riot police to the Police station.
It is reported that Mr. Mohamed Gasam and Mr. Mohamed Nazim, both held in solitary cells on Thinadhoo Island, were both pepper sprayed to their face while in detention.
Furthermore, OMCT has been informed that four additional persons are being detained on Thinadhoo Island after island officials reportedly drove around the island announcing that if any protection was given to the hereunder mentioned people, it would be considered an offense.
Mr. Mohamed Saleem Ali (Narugis Villa, Thinadhoo) President of the Gaaf Dhaal Constituency of MDP, arrested on 1 November 2006 at his house by riot police.
Mr. Yamin Mohamed (Abhareege, Thinadhoo), MDP member, handed himself over to the riot police knowing that they were looking for him.
Mr. Mohamed Waheed (Skooner, Thinadhoo), MDP member, arrested on 1 November 2006 at his house by riot police.
Mr. Mohamed Niyaz (Blue Fish, Thinadhoo), MDP member, arrested on 1 November 2006 but no further details on his arrest are known.
It is reported that Mr. Mohamed Waheed and Mr. Mohamed Saleem Ali were severely ill-treated during their arrests. While Mr. Mohamed Waheed was brutally hit on the face causing his face to swell up, Mr. Mohamed Saleem Ali’s hand was broken. According to the information, Mr. Mohamed Saleem Ali asked for medical attention but had been denied any medical treatment until 2 November when he was taken to Gaaf Alif Atoll Villingili Island to receive medical assistance. Moreover, according to the information received, around 02:00, Mr. Yamin Mohamed was taken out of his cell, handcuffed and dragged by the neck and severely beaten up by the riot police. Tear gas was also reportedly used inside holding cells allegedly due to excessive noise made by the detainees.
On 3 November 2006, following a demonstration of over 150 people requesting the island Office to calm down the riot police, demonstration which was violently dispersed, additional six MDP members were arrested.

5. Mr. Ibrahim Areef

OMCT has also been informed that arrests took place in the capital Male.
Mr. Mohamed Ziyad, National Council Member of MDP and active reformist. He was reportedly arrested on 30 October 2006 while he was having coffee in a cafe. Approximately eight riot police arrived in the cafe and apprehended him. He was informed that the reason of his arrest was “threatening a car driver on one of the main roads in Male”.
Mr. Mohamed Falah, Vice President of Male’ Constituency for the MDP. He was reportedly arrested on 30 October 2006. No reason of arrest was given.
Mr. Abdul Majeed Shameem, MDP Cell President. He was arrested on 31 October 2006. No reason of arrest was known.
Mr. Shehenaz Abdulla, who was contacted by MDP to coordinate the 10 November 2006 gathering. She was arrested on 6 November 2006. She was reportedly handcuffed and carried to an awaiting police vehicle by the riot police.
The International Secretariat of OMCT expresses its concern over the psychical and psychological integrity of the above mentioned persons. OMCT recalls that these events are in clear infringement of articles 7 and 9 (1), (5) of the International Covenant on Civil and Political Rights, to which the Republic of Maldives has acceded in September 2006, which state that “no one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment [and that] no one shall be subjected to arbitrary arrest or detention” and which require that “anyone who has been the victim of unlawful arrest or detention shall have an enforceable right to compensation.” OMCT calls upon the authorities of the Maldives to initiate an impartial investigation into this case of arbitrary detention and ill-treatment by police forces in order to find those responsible for these violations of human rights and to bring them to justice.
Action requested:
Please write to the authorities of the Republic of Maldives urging them to:
i. Guarantee, in all circumstances, the physical and psychological integrity of the above mentioned persons;
ii. Order the immediate release of the above mentioned persons in the absence of valid charges that are consistent with international law and standards, or, if such charges exist, bring them before an impartial and competent tribunal and guarantee their procedural rights at all times;
iii. Order a thorough and impartial investigation into these events, especially in regards to the allegations of ill-treatment, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
iv. Guarantee that adequate medical assistance is provided to the above mentioned people if necessary;
v. Guarantee that adequate compensation is awarded to above mentioned people:
vi. Ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
