No.3891 アンゴラ:人権団体が強制的に閉鎖され、団体に禁止令がだされました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、アンゴラにおける下記の状況に関して皆様の緊急の働きかけをお願いします。 

<事件の概要>

人権擁護家のための監視機構は信頼できる情報筋より、アンゴラのカビンダ州内唯一の人権団体である「ムパラバンダーカビンダ市民協会」が閉鎖されたという情報を入手しました。

入手した情報によると、2006年7月20日にカビンダ州裁判所が政治活動への関与を理由として同団体を禁じる決定を出し、2006年9月14日に同団体は閉鎖され、事務所は立ち入り禁止になりました。協会のメンバーは控訴しており係争中にもかかわらず、州知事は閉鎖を命じ、警察が実行しました。

ムパラバンダは戦争、抑圧、弾圧、汚職に対する平和的な闘いを主な目的として2003年7月に創設されました。とくに、政府や「カビンダ解放戦線(FLEC)」による人権侵害の証拠を複数集めていました。

また、2006年9月29日にムパラバンダの代表のアゴスティンホ・チカイアさんと報道官のラウル・マヌエル・ダンダ博士がカビンダ州空港に到着したところを州刑事捜査局警察に恣意的に逮捕されました。2人はルアンダにあるダンダさんの家を訪問した帰りでした。警察はダンダさんの荷物を調べ、書類を押収しましたが、それはダンダさんや数名のジャーナリストが書いた、カビンダでの紛争に関係する書類でした。これらの書類の中には、すでにアンゴラの全国紙で発表されているものもありました。これ以前にも、カビンダでの人権侵害を記録した報告書が2003年、2004年、2005年に発表されて以来、ムパンバラのメンバーは恣意的な逮捕、拷問、殺害脅迫、パスポートの押収など、様々な嫌がらせにあっています。

ラウル・ダンダさんは最初、カビンダ市内の州刑事捜査局警察本部で2006年10月3日まで起訴のないまま拘禁されていました。彼は「州の治安に対する犯罪の煽動、教唆、容認」で起訴され、カビンダ民事刑務所に移送されましたが、2006年10月27日に釈放され、裁判中です。ラウル・ダンダさんは刑事捜査の続く間、ルアンダの自宅に戻ることを認められましたが、検察の許可なくルアンダを離れることはできません。

釈放日は不明ですが、アゴスティンホ・チカイアさんは釈放されていますが、彼を再び拘禁することを狙いとした審理手続きが進められています。

監視機構はムパンバラが閉鎖されて以来、そのメンバーに対する嫌がらせが増え、集会の自由が組織的に妨害されているという情報を入手しています。メンバーの中には身の安全のため、カビンダ州を離れて隠れている人もいるということです。

情報によると、アンゴラ政府はムパンバラをFLECに属していると主張しています。「カビンダ住民・友人協会」の助力を得て、当局は「反ムパンバラ」キャンペーンを行い、同協会が人種差別的な分離主義グループのように見せかけています。

監視機構はムパンバラの閉鎖を強く非難し、メンバーの心身の安全を憂慮します。

<行動要請>

 アンゴラ関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、アゴスティンホ・チカイアさんとラウル・マヌエル・ダンダさん、並びに国内のすべての人権擁護家の、心身の安全を保障すること。

2.ラウル・ダンダさんの公正で中立な裁判を受ける権利がいかなる情況にあろうとも守られるよう保障し、彼に対する恣意的な嫌疑を撤去すること。

3.ムパラバンダの活動に対するあらゆる妨害と、アンゴラの人権擁護家に対するあらゆる形態の嫌がらせを即時止めさせること。

4.1998年12月9日国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条、「すべての人は、個人的にあるいは他の人々と共に、国内および国際レベルにおいて、非政府組織、協会あるいは団体を結成したり、加入してりあるいは参加する権利を有する」とした第5条、「すべての人は、個々にまた他の者と共同して、すべての人権と基本的自由に関する意見、情報、知識を出版、発表もしくは他の者に伝える権利を有している」とした第6条(b)、そして、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

5.いかなる情況にあろうとも、アンゴラが批准した地域および国際人権文書に沿って、国内全体における人権尊重と基本的自由を保障すること。

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Agostinho Chicaia and Mr. Raul Danda, as well as of all human rights defenders in the country;
2. To ensure that the rights of Mr. Raul Danda to a fair and impartial trial will be guaranteed in any circumstances, and that the charges against him be dropped, as they are arbitrary;

To conform with the provisions of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, in particular article 1, which states that “everyone has the right, individually or collectively, to promote the protection and fulfilment of human rights and fundamental freedoms at the national and international levels”, article 5.b, which stipulates that everyone has the right “to form, join and participate in non-governmental organisations, associations or groups”, article 6a), which provides that “everyone has the right, individually and in association with others, freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms”, as well as article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with regional and international human rights instruments recognised by the Republic of Angola.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in the Republic of Angola.

Brief description of the situation:

The Observatory has been informed by reliable sources about the closing down of “Mpalabanda - Civic Association of Cabinda” (Mpalabanda - Associacao Civica de Cabinda), the only human rights organisation operating in the Cabinda Province of Angola.

According to the information received, on September 14, 2006, Mpalabanda was closed down and its offices sealed off, following a sentence issued by the Provincial Tribunal of Cabinda on July 20, 2006, banning the organisation for its alleged involvement in politics. Although members of the organisation appealed to the Supreme Court and are still waiting for a decision, the Provincial Governor ordered its closing down, carried out by the police.

Mpalabanda was created in July 2003, and its main objectives are the peaceful fight against war, oppression, repression and corruption. In particular, the organisation gathered several proofs of human rights violations committed by the government and members of the Front for the Liberation of the Enclave of Cabinda (Cabinda Liberation Force or Forca de Libertacao de Cabinda - FLEC).

Besides, on September 29, 2006, both Mr. Agostinho Chicaia and Dr. Raul Manuel Danda, respectively Mpalabanda President and Spokesperson, were arbitrarily arrested by members of the Provincial Criminal Investigative Police, on their arrival at the airport in Cabinda province. They were coming back from a trip to Mr Danda’s house in Luanda. Police officers searched and confiscated documents from Mr. Danda’s luggage, which were reportedly related to the conflict in Cabinda, written by Mr. Raul Danda and several other journalists. Some of these documents had already been published in national newspapers in Angola. These acts of harassment against the organisation’s members follow many other that took place since the publication of three reports documenting human rights violations in Cabinda, in 2003, 2004 and 2005, Mpalabanda members have been victims of acts of harassment including arbitrary arrests, torture and death threats, and passport confiscations.

Mr. Raul Danda was initially held without charge at the headquarters of the Provincial Criminal Investigation Police in the city of Cabinda until October 3, 2006. He was charged with “instigating, inciting and condoning crimes against the security of the State” and transferred to the Civil Prison (Cadeia Civil) in Cabinda, from where he was released on October 27, 2006, pending a trial. Mr. Raul Danda has been allowed to return to his home in Luanda while criminal investigations continue, but cannot leave Luanda without permission from the prosecutor’s office.

Mr. Agostinho Chicaia was also released at an unknown date, but proceedings against him would be pending, aiming at ordering again his detention.

Finally, the Observatory was informed about the increasing acts of harassment against Mapalbanda members since its closure, as well as systematic obstacles against their freedom of assembly. Several of them had reportedly to hide outside of the Cabinda province, in order to ensure they physical integrity.

According to the information received, the Angolan government claims that Mapalabanda is a FLEC allied. With the help of the Association of Natives and Friends of Cabinda (Associacao dos Naturais e Amigos de Cabinda - ANAC), the authorities have launched a campaign against Mapalabanda, presenting it as a radical and separatist group.

The Observatory strongly condemns the closing down of Mpalabanda, and expresses its deep concern about the physical and psychological integrity of its members.

Actions required:

Please write to the Angolan authorities urging them to:

i. guarantee in all circumstances the physical and psychological integrity of Mr. Agostinho Chicaia and Mr. Raul Danda, as well as of all human rights defenders in the country;

ii. ensure that the rights of Mr. Raul Danda to a fair and impartial trial will be guaranteed in any circumstances, and that the charges against him be dropped, as they are arbitrary;

iii. put an immediate end to any obstacles to the activities of Mpalabanda as well as to all forms of harassment against human rights defenders in Angola;
