No.3893 シリア:8月に逮捕拘禁された人権活動家が再び隔離拘禁されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、シリアにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<新情報>

人権擁護家のための監視機構は信頼できる情報筋より、シリア人作家で教授のアリ・シャハビさんが起訴のないまま再び隔離拘禁におかれたという情報を入手しました。アリ・シャハビさんは2006年8月10日に逮捕されました。(背景情報参照)

入手した情報によると、毎週シャハビさんを訪問している親戚が2006年10月24日に訪問すると、彼がまた隔離されたと知らされました。理由は不明です。その他の情報は何もありません。

監視機構はシリアで人権活動家が繰り返し嫌がらせや弾圧を受けている中、アリ・シャハビさんが再び隔離拘禁されたことを強く非難します。監視機構はシャハビさんの健康と心身の安全を懸念するとともに、拷問や虐待を危惧します。

<背景情報>

情報によると、2006年8月10日にシャハビさんはダマスカスにある国家治安局に召喚されました。これは、ここ数ヶ月頻繁に起きていたことでした。シャハビさんが帰宅しなかったので、妻が同局に出かけ、彼について尋ねました。妻はそこで「1週間後に戻って来なさい」と言われました。その言葉は、彼が拘禁されていることを強く示唆するものでした。彼の親戚は何度も国家治安局に行って彼に会おうとしましたが、「尋問中」ということを理由に会わせてもらえず、彼の消息を教えてもらえませんでした。

2006年10月16日、拘禁されて2ヶ月を過ぎてから、アリ・シャハビさんの親戚は彼がどこか分からない場所からアドラ刑務所に移送されたと知らされました。また、毎週火曜日に面会してもいいと言われました。

その時シャハビさんは「違法な政党の結成」とレバノンとシリアの関係正常化を求める「ダマスカス・ベイルート宣言」に2006年5月に署名したことで起訴されていました。

シャハビさんは著作や、公開討論会への参加、人権のための座り込みや集会などを通じてシリアで基本的自由や民主化を促進する活動に深く関わってきました。1年前、彼は「すべての人のためのシリア」という「運動」をはじめ、ウェブサイトを作って民主主義や基本的自由に関する文章を掲載しました。このウェブサイトは後に当局に閉鎖されました。

<行動要請>

 シリア関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、アリ・シャハビさんおよび恣意的に拘禁されているすべての人権擁護家の心身の安全を保障すること。とりわけ、シャハビさんが拘禁中に拷問やその他の残虐で非人間的で品位を貶めるような扱いあるいは処罰を受けないよう保障すること。

2.正当な嫌疑がない中で拘禁されているシャハビさんを、即時無条件で釈放すること。もし正当な嫌疑があるのならば、遅れることなく彼を公正な裁判に付し、その間、弁護士へのアクセスをはじめとした手続き上の権利をすべて保障すること。

3.シリアのすべての人権擁護家に対するあらゆる形態の嫌がらせを止めること。

4.1998年12月9日に国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

5.さらには、いかなる情況にあろうとも、シリア国内全体において、国際人権基準に沿って人権尊重と基本的自由を守ること。

Dear President ASAD,

I am wiring you to express my concern over the situation of Mr. Ali Shahabi, who is a professor and writer, and was arrested on August 10, 2006. I would like to urge you the followings:

1. To guarantee, in all circumstances, the physical and psychological integrity of Mr. Ali Shahabi, as well as of all human rights defenders arbitrarily detained, and in particular ensure that he is not subjected to torture or other cruel, inhuman or degrading treatment or punishment during their detention;
2. To release Mr. Shahabi immediately and unconditionally in the absence of any valid charges against him, or in the case of valid charges against him, bring him before an impartial tribunal without delay and guarantee procedural rights at all times, ensuring, among others, that he has access to legal advice;
3. To put an end to all forms of harassment against all human rights defenders in Syria;
4. To conform with the provisions of the Declaration on Humans Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, in particular article 1, which states that “everyone has the right, individually or in association with others, to promote the protection and realisation of human rights and fundamental freedoms at the national and international levels”, and article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”, and with the provisions of the International Convention for the Protection of all Persons from Enforced Disappearance;
5. More generally, to ensure in all circumstances respect for human rights and fundamental freedoms in Syria in accordance with international human rights standards.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information and requests your urgent intervention in the following situation in Syria.

New information:

The Observatory has been informed by reliable sources that Mr. Ali Shahabi, a writer and a professor in Syria, was again placed in incommunicado detention, still without charges against him. Mr. Ali Shahabi was arrested on August 10, 2006 (see background information).

According to the information received, on October 24, 2006, Mr. Shahabi’s relatives, when coming for their weekly visit, were informed that he had been again placed in isolation, for reasons that remain unknown. No further information was provided.

The Observatory strongly condemns Mr. Ali Shahabi’s incommunicado detention, which takes place in a context of recurrent harassment and repression of human rights defenders in Syria. The Observatory further expresses its deep concern about Mr. Shahabi’s health and physical and psychological integrity and fears that he may be subjected to torture and ill treatment.

Background information:

On August 10, 2006, Mr. Shahabi was summoned to the State Security Services in Damascus, as it had been regularly the case over the last past months. As Mr. Shahabi did not come back home, his wife went to the services in order to inquire into his situation. She was then told to “come back in a week”, strongly implying that he was being detained. Although his relatives tried to visit him on numerous occasions at the State Security Services office, they were denied the right to see him, under the pretext that he would still be “interrogated”, and were not informed of his whereabouts.

On October 16, 2006, Mr. Ali Shahabi’s relatives were informed that he had been transferred from an unknown place to Adra prison, after more than two months of detention. They were also informed that they would be allowed to meet him every Tuesday.

Mr. Shahabi was then accused of “creation of an illegal party” and of having signed the Beirut-Damascus Declaration in May 2006, which called for the normalisation of relations between Lebanon and Syria.

Mr. Shahabi was very involved in promoting fundamental freedoms and democracy in Syria through his writings and by taking part in public discussions forums, sit-ins and meetings dedicated to the defence of human rights. One year ago, he began to launch a “movement” called “Syria for all” and created a website, with articles on democracy and fundamental freedoms, which was then closed down by the authorities.

Action requested:
Please write to the Syrian authorities and ask them to :

i. guarantee, in all circumstances, the physical and psychological integrity of Mr. Ali Shahabi, as well as of all human rights defenders arbitrarily detained, and in particular ensure that he is not subjected to torture or other cruel, inhuman or degrading treatment or punishment during their detention;
ii. release Mr. Shahabi immediately and unconditionally in the absence of any valid charges against him, or in the case of valid charges against him, bring him before an impartial tribunal without delay and guarantee procedural rights at all times, ensuring, among others, that he has access to legal advice;
iii. put an end to all forms of harassment against all human rights defenders in Syria;
