  SOSトーチャー国際事務局は、ネパールにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

＜事件の概要＞

SOSトーチャー国際事務局は、SOSトーチャーネットワークのメンバーであるINSEC（インフォーマル・セクター・サービス）を含む複数の信頼できる情報筋より、12歳の少女（身の安全のために名前は明らかにしません）が2006年11月18日、モハタリ地区のガウサラ村開発委員会２においてレイプされたという情報を受けました。

情報によれば、11月18日、12歳の少女が一人自宅にいたとき、地元警察の巡査長マノジュ・チャウダリが家に入ってきて彼女をレイプしました。夕方、帰宅した両親は、その男が家から逃げ出し警察に向かうのをみました。少女は親に起きたことを話しました。それを聞いた親は、すぐに治安部隊のキャンプに行き、警視正のビマル・シャルマ、軍警察隊の警視正キシュオル・シェレスタ、そして軍中尉ミン・バハドル・タパを含む数人の警察官に事件について報せました。

2006年11月19日、12歳の少女の親は娘をモハタリ地区病院に連れて行き、医者にみせました。しかし、申し立てによれば、地区警察官（DPO）は検査の結果を無視し、事件はすでに調査中であると言いました。

申し立てられている加害者は、さらに調査が必要ということで、現在DPOにおいてレイプの嫌疑で再拘留されています。

国際事務局は、この事件の刑事捜査に妨害が入っているという報告を深刻に捉えています。事実、少女の親がDPOに行き、レイプ被害を訴えたとき、最初は拒否されました。しかし地元の村の人々の圧力のお陰で、ようやく事件は記録されました。さらには、少女の家族にお金を渡して、被害の訴えをもみ消そうとする警察官がいたといわれています。国際事務局は、警察隊の警視正キシュオル・シェレスタが、マノジュ・チャウダリと12歳の少女の間に恋愛関係があり、二人はラブレターを出しあっていたと主張しているという情報を受けました。

これらの情報を基に、OMCTはネパール政府に対して、資格のある当局が事件を調査し、その第4条 (c)で「これらの行為が国家によってなされるか私人によってなされるかを問わず、女性に対する暴力行為を防止し、調査しおよび国内法に従って処罰するために相当の注意を払うこと」と確認している女性に対する暴力の撤廃に関する宣言にしたがい、誠実さをもって、未成年者をレイプした犯人を起訴して裁くよう呼びかけます。

　国際事務局は、また、子どもの権利条約の締約国であるネパール政府に、「締約国は、親、法定保護者または子どもの養育をする他の者による子どもの養育中に、あらゆる形態の身体的または精神的な暴力、侵害または虐待、放任または怠慢な取扱い、性的虐待を含む不当な取扱いまたは搾取から子どもを保護するためにあらゆる適当な立法上、行政上、社会上および教育上の措置をとる」とした同条約の第19条1項と、「締約国は、あらゆる形態の性的搾取および性的虐待から子どもを保護する」とした第34条を守る義務があることを想起するよう求めます。

＜行動要請＞

　ネパール関係当局に以下の内容の要請をお願いします。

1．12歳の少女とその家族の心身の安全を保障し、とりわけ、彼女に必要な医療および心のケアを保障すること。

2．拷問の身体的および精神的証拠を正式に記録し、責任者すべてを特定し、裁判に付し、法律に基づき刑事および行政罰を適用するために、これら事件について綿密で公正な調査を行うよう命じること。

3．国際法と国際基準にしたがい、少女および女性たちの暴力を含む差別をうけない権利を保障すること。

4．国内法および国際人権基準、とりわけ拷問等禁止条約、女性に対するあらゆる形態の差別の撤廃に関する条約、子どもの権利条約、そして女性に対する暴力撤廃宣言にしたがい、国内全土における人権尊重と基本的自由を保障すること。

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Nepal.
Brief description of the situation:
The International Secretariat of OMCT has been informed by several reliable sources, including the Informal Sector Service Centre - INSEC, a member of the OMCT network, of the rape of a 12-year-old girl (name withheld to safeguard the victim’s identity and safety) on 18 November 2006, in Gausala Village Development Committee-2, Mohatari District.

According to the information received, on 18 November 2006, as the 12-year-old girl was alone at home, the police sub head constable Manoj Chaudhary went into her home and raped her. When her parents arrived later in the evening, they saw him escape and head to the police station. After the girl told her parents what had happened, they went immediately to the security base camp and reported the incident to several police head officers namely, police inspector Bimal Sharma, inspector of armed police force Kishor Shrestha and army lieutenant Min Bahadur Thapa.

On 19 November 2006, the parents of the 12-year-old girl went to the Mohatari District Hospital for a medical examination of their daughter. However, the report of the examination is allegedly not used by the District Police Office (DPO), arguing that the case is already under investigation.

The alleged perpetrator is now in the custody of the DPO, remanded on rape charge for further investigation.

OMCT is seriously concerned by reports on the existence of obstacles to the criminal investigation in this case. Indeed, when the girl’s parents went to the DPO to lodge a rape complaint, they faced a refusal at first and it was thanks to the pressure by the local community that it was eventually registered. Moreover, there has been allegedly an attempt by some policemen to settle the case by trying to bribe the girl’s family. Further, OMCT has been informed that the inspector of armed police Kishor Shrestha argued there was a love affair between Manoj Chaudhary and the 12-year-old girl and that they have exchanged love letters.

Based on these elements, OMCT calls upon the government of Nepal to ensure that the competent authorities investigate, prosecute and punish the perpetrator of the rape of the minor girl with due diligence, in compliance with the Declaration on the Elimination of Violence against Women, which in article 4(c) affirms that States should “exercise due diligence to prevent, investigate and, in accordance with national legislation, punish acts of violence against women, whether those acts are perpetrated by the State or by private persons.”

OMCT would also like to recall the government of Nepal, as a State Party, its duty under the UN Convention on the Rights of the Child according to which it “shall take all appropriate legislative, administrative, social and educational measures to protect the child from all forms of physical or mental violence, injury or abuse, neglect or negligent treatment, maltreatment or exploitation, including sexual abuse” (article 19 (1)) and it shall “protect the child from all forms of sexual exploitation and sexual abuse” (article 34).

Requested action:
Please write to the authorities in Nepal urging them to:

i. Guarantee the physical and psychological integrity of the 12-year-old girl and her family, in particular by granting her medical care and psychological rehabilitation as required;

ii. Order a thorough and impartial investigation into these events, in order to duly document physical and psychological evidence of torture, identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;

iii. Ensure girls and women the right to be free from discrimination, including violence, in accordance with international laws and standards;

iv. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards, especially the Convention against Torture, the Convention on the Elimination of All Forms of Discrimination against Women, the Convention on the Rights of the Child and the Declaration on the Elimination of Violence against Women.
