No.3899　　　タイ：違法森林伐採に反対するタイの環境活動家が強制失踪させられました。

　「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、タイにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

＜事件の概要＞

人権擁護家のための監視機構は、市民的自由連合（UCL）よりラチャブリ県バン・カ区の著名な環境活動家であるタレス・ソドゥスリさんの強制的失踪について情報を受けました。

情報によれば、2006年12月1日、タレスさんの家のメイドが警察に行き、タレスさんが失踪したと報告しました。報告によれば、彼女は前日の11月30日の夜、仕事を終えて家を出ました。そして翌日、家に行けば、彼の姿は見えず、一部電灯がついたままでした。

警察がタレスさんの家に証拠が残されていないか捜索した結果、血痕、使用済みの拳銃の弾薬筒3つ、銃弾2つ、そして庭の芝生に残されたタイアの跡を発見しました。

2006年12月2日、警察はバン・カ地区の何ヶ所かを家宅捜査し、ピストル、血のついたトラックと衣類を押収して科学捜査に回しました。調べを受けたタレスさんの妻は、事件の数日前に、3匹の飼い犬が毒殺されていたと言いました。

それ以外にも、事件の2週間前、ラチャブリの地元政治指導者が禁じられている森林伐採を行なっていることを見せたビデオテープを、自然資源・環境省に提出していました。この森林は王室が推奨する森林保護事業の対象となっていました。彼はまた、ある森林への不法侵入事件の容疑者数人に対して法廷で証言を行なう予定でした。

タレスさんはこれまでの10年間、バン・カ地区における森林不法侵入に反対するキャンペーンを進めてきましたし、違法伐採を繰り返す地元有力者から森林を守るよう村人たちを引っぱってきました。

監視機構は、タイにおいて絶えず基本的自由の侵害が行なわれてきている中で起きたこの強制的失踪に深い憂慮を抱いています。

＜行動要請＞

　タイ関係当局に以下の内容の要請をお願いします。

1．いかなる情況にあろうとも、タレス・ソドゥスリさんおよび環境活動家を含むタイのすべての人権擁護家の心身の安全を保障すること。

2．タレスさんの行方を探し出し、その所在を公表し、即時釈放を保障するために必要な行動をすぐにとること。

3．責任者を特定し、裁判に付し、法に基づいて判決を下せるよう、即時に中立で公正な調査を実施すること。

4．タイの人権擁護家に対するあらゆる形態の報復に終止符を打つこと。

5．1998年12月9日国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第１条、「すべての人は、個々にまた他の者と共同して、すべての人権と基本的自由に関する意見、情報、知識を出版、発表もしくは他の者に伝える権利を有している」とした第6条(b)、そして「すべての人は、個人あるいはその他の人々と共に、政府機関や組織および公共業務に関係している機関に、それらの機能を向上させるための批判や提案を出したり、人権および基本的自由の促進、保護および実現を妨げたり遅らせるようなそれらの業務活動に対して注意を惹きつける権利を有する」とした第8条2項に従うこと。

6．国際人権基準およびタイが批准した国際人権文書に基づき、国内全土における人権尊重と基本的自由を保障すること。

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Thares and of all human rights defenders in Thailand, including environmental activists;

2. To take prompt action in order to locate Mr. Thares, make public his whereabouts, and ensure his immediate release;

3. To conduct an immediate, independent and impartial investigation into Mr. Thares Sodsri's enforced disappearance in order to identify those responsible, bring them to justice and sentence them according to law;

4. To put an end to any kind of reprisals against human rights defenders in Thailand;

5. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1 according to which “everyone has the right, individually or in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels”, article 6(b), which states that “everyone has the right, individually and in association with others (...) to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms”, and its article 8(2), which provides that “everyone has the right, individually and in association with others, to submit to governmental bodies and agencies and organisations concerned with public affairs criticism and proposals for improving their functioning and to draw attention to any aspect of their work that may hinder or impede the promotion, protection and realisation of human rights and fundamental freedoms”;

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Thailand.

Brief description of the situation:

The Observatory has been informed by the Union for Civil Liberty (UCL) about the enforced disappearance of Mr. Thares Sodsri, a prominent environmental activist in Ban Kha District, Rachaburi province.

According to the information received, on December 1, 2006, Mr. Thares’ house maid went to the police station to report his disappearance. Indeed, she reportedly left him on the evening of November 30, 2006 and the following day, he was missing although some lights were still on inside the house.

Police officers, while searching evidences at Mr. Thares’ home, found several traces of blood, three used handgun cartridges, two bullets and tire prints on the front lawn of Mr. Thares’ house.

On December 2, 2006, the police raided several locations in Ban Kha district and confiscated pistols, a blood-strained truck and clothes, to be examined by forensic services. When interrogated, Mr. Thares’ wife stated that a few days before these events, their three dogs had been poisoned.

Besides, two weeks before these events, Mr. Thares had submitted a video to the Minister of Natural Resources and Environment, showing illegal forest destruction by a local political leader, in Ratchaburi, which is under a royally-initiated project for forest protection. He was also to testify in court against several suspected persons in a forest encroachment case.

Mr. Thares has also conducted a campaign against illegal forest encroachment projects in Ban Kha sub-district over the last ten years, and has led villagers to protect their forest from local influential persons, seeking to illegally exploit it.

The Observatory expresses its deepest concern regarding this enforced disappearance, which occurs in the context of persistent violations of fundamental freedoms in Thailand.

Actions required:
Please write to the Thai authorities and ask them to:

i. Guarantee in all circumstances the physical and psychological integrity of Mr. Thares and of all human rights defenders in Thailand, including environmental activists;
ii. Take prompt action in order to locate Mr. Thares, make public his whereabouts, and ensure his immediate release;
iii. Conduct an immediate, independent and impartial investigation into Mr. Thares Sodsri’s enforced disappearance in order to identify those responsible, bring them to justice and sentence them according to law;
iv. Put an end to any kind of reprisals against human rights defenders in Thailand;
v.
