＜新情報＞

SOSトーチャー国際事務局は信頼できる筋⁽¹⁾より、2006年12月18日にドゥ・ヤンミン（杜陽明）さん、ワン・シュイチェン（王水珍）さん、ティアン・バオチェン（田寶成）さんという3人の陳情者に対して有罪判決が出たという情報を入手しました。

情報によると、この3人の陳情者は「騒乱」の嫌疑で2006年11月8日と9日にザベイ地区人民裁判所に出廷しました。ティアン・バオチェンさんとドゥ・ヤンミンさんは２年半の刑期、ワン・シュイチェンさんは1年の刑期となりました。ティアン・バオチェンさんの妻、チャン・クイピン（張翠萍）さんはすでに1年半の労働再教育(RTL)という判決を受けています。

同じ情報筋によると、ティアン・バオチェンさんに対する判決は、2006年3月15日にティアン・バオチェンさんとドゥ・ヤンミンさんがヘンシャン通りにある新華社通信支部の近くの公衆トイレで使用料を払うのを拒否して公共の秩序を乱し、また、新華社通信の社員を叱りつけるよう、他の陳情者を煽動した、としています。当該事件は2006年3月に起きているにもかかわらず、ティアン・バオチェンさんとドゥ・ヤンミンさんは、多国間組織である上海協力機構の会議開催時期にあたる2006年6月2日まで拘禁されませんでした。

ワン・シュイチェンさんは2006年4月に北京で行われた故趙紫陽元国務院総理の追悼式典に出席しようとした嫌疑で有罪判決を受けたということです。

3人の陳情者全員が以前に陳情活動を理由に拘禁され労働再教育を受けさせられており、拘禁中に身体的虐待を受けています。

国際事務局は2006年11月初旬に逮捕され虐待された上海市の陳情者、ドゥアン・フイミンさんに関しては新たな情報は得ていません。

国際事務局は上記の陳情者、ドゥ・ヤンミンさん、ワン・シュイチェンさん、ティアン・バオチェンさん、チャン・クイピンさんの心身の安全を憂慮し、正当な嫌疑が不在の中拘禁されている彼らの釈放を要請します。さらに、中国当局は、新設の国連人権理事会のメンバー国選出の際に中国が再確認した国際的な人権の責務を遵守するよう、要請します。

＜事件の概要＞

情報によると、ドゥ・ヤンミンさん、ワン・シュイチェンさん、ティアン・バオチェンさん、チャン・クイピンさんの4人の陳情者は、2006年6月に開かれた上海協力機構の会合中に、彼らの活動に関連して拘禁され起訴されたということです。また、ドゥアン・チュンファンさんとドゥアン・フイミンさんという2人の上海市民の陳情者が2006年11月に逮捕された後、虐待されたということです。

情報によると、ドゥ・ヤンミンさん（60歳）は2006年6月2日に自宅に来た警察に尋問のために連行された後、逮捕されたということです。彼は長年、以前の自宅の解体に関して当局に陳情していたということです。彼は労働再教育を18ヶ月受けさせられ、また3度にわたって刑事拘禁されましたが、その時に深刻な身体的虐待を受けたということです。

同じ情報筋によると、ワン・シュイチェンさんは、2006年6月5日、国家機密漏洩の罪で3年間拘禁された弁護士のゼン・エンチョン（鄭恩寵）さんの釈放に立ち会うためにティランキャオ（提籃橋）刑務所に向かう彼の妻ジャン・メイリに付き添っている道中、逮捕されました。ワン・シュイチェンさんは2006年7月初旬に正式に逮捕されました。彼女は以前、地元の住宅委員会委員長に命じられた思想教育を受けることを拒否し、2003年4月に「騒乱罪」で刑務所で2年拘禁されたことがあります。

また、ティアン・バオチェンさんと妻のチャン・クイピンさんは2006年6月2日に拘禁され、その後ティアン・バオチェンさんは「騒乱罪」で同年7月8日に正式に起訴され、妻は18ヶ月の労働再教育の判決を受けました。この2人は2003年に労働再教育を受けたことがあります。ティアン・バオチェンさんは深刻な身体的虐待を受け、歯を2本失い、頭、胸、腕、足に複数の負傷を負いました。

同じ情報筋によると、ドゥ・ヤンミンさん、ワン・シュイチェンさん、ティアン・バオチェンさんは「騒乱」の嫌疑で2006年11月8日と9日にザベイ地区人民法院に出廷する予定になっていました。ドゥ・ヤンミンさん、ワン・シュイチェンさん、ティアン・バオチェンさんは弁護士を雇う余裕がなく、裁判所が任命した弁護士の弁護を受けました。しかし、家族たちは、この弁護士たちと話し合うことも会うこともできなかったと言っています。ワン・シュイチェンさんの夫は妻に対する訴状の複写を裁判所に求めたものの得られず、妻の弁護士に頼みました。しかし、この弁護士は「それは政府が決めることだ。私をわずらわせないでくれ。」と言って、彼への支援を拒否したということです。

さらに、ドゥアン・チュンファンさんとドゥアン・フイミンさんが逮捕後に虐待を受けたということです。兄弟であるこの2人は2006年11月初旬に中央当局に陳情しようとして北京に出かけました。11月3日早朝に彼らが宿泊していた旅館に20人ほどの私服警官が突入し、2人を連行しました。警察の車の中でドゥアン・チュンファンさんは気分が悪くなり、窓際に座らせてほしいと頼みましたが、警官の対応は彼女の髪を引っ張るというものでした。

情報によると、彼女が酷い目にあっているのを見たドゥアン・フイミンさんが彼女の近くに行こうとすると、警官らは彼を車から引きずり出し、10人以上で殴る蹴るをしました。彼は手錠をかけられ、車の後部座席に乗せられました。ドゥアン・チュンファンさんとドゥアン・フイミンさんは上海へ電車で送り返される時、別々に乗せられ、チュンファンさんは上海に戻った時、フイミンさんを見つけられませんでした。同じ情報筋によると、彼は明らかに負傷した状態で電車に乗せられているのを目撃されています。そして彼は、武器を使って治安部隊員を襲撃したとして、刑事拘禁されています。彼の両親は息子に会おうと一昼夜にわたって拘禁所の外で過ごしましたが、結局警察に追い返されました。

＜行動要請＞

　中国関係当局に以下の内容の要請をお願いします。

1．いかなる情況にあろうとも、ドゥ・ヤンミンさん、ワン・シュイチェンさん、ティアン・バオチェンさん、そしてチャン・クイピンさんの心身の安全を保障すること。

2．国際法や国際基準と合致する正当な嫌疑が不在の中、ドゥ・ヤンミンさん、ワン・シュイチェンさん、ティアン・バオチェンさん、そしてチャン・クイピンさんの即時釈放を命じること。もしそのような嫌疑があるならば、彼らを公正で資格のある法廷に付し、その間、彼らの手続き上の権利を常に保障すること。

3．国内法および国際人権基準に沿って、中国全土における人権尊重と基本的自由を保障すること。

The International Secretariat of the World Organisation Against Torture (OMCT) has received new information regarding the following situation in the People’s Republic of China.
New Information
The International Secretariat of OMCT has been informed by a reliable source[1] of the sentencing of three petitioners, Mr. Du Yangming, Ms. Wang Shuizhen, and Mr. Tian Baocheng to prison terms on 18 December 2006.

According to the information received, the three petitioners appeared in Shanghai’s Zhabei District People’s Court on 8 and 9 November 2006 on charges of “causing a disturbance”. Mr. Tian Baocheng and Mr. Du Yangming were sentenced to two-and-a-half years in prison and Ms. Wang Shuizhen to one year. Mr. Tian Baocheng’s wife, Ms. Zhang Cuiping was earlier sentenced to one-and-a-half years of Reeducation Through Labor (RTL).

According to the same information, the judgment against Mr. Tian Baocheng states that on 15 March 2006, Mr. Tian Baocheng and Mr. Du Yangming disturbed public order by refusing to pay for the use of a public toilet near the Xinhua News Agency branch office in Hengshan Road, and for instigating other petitioners to berate Xinhua employees. Although the alleged offence occurred in March 2006, Mr. Tian Baocheng and Mr. Du Yangming were not detained until 2 June 2006, around the time of the intergovernmental Shanghai Cooperation Organization (SCO).

Ms. Wang Shuizhen was reportedly convicted and sentenced for attempting to attend a memorial for late Party secretary Zhao Ziyang in Beijing in April 2006.

All three petitioners have previously served terms of imprisonment or RTL for their petitioning activities, and have suffered physical abuse in detention.

OMCT has no further information regarding Mr. Duan Huimin, a Shanghai petitioner, arrested and ill-treated beginning of November 2006.

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of the above mentioned petitioners, especially for Mr. Du Yangming, Ms. Wang Shuizhen, Mr. Tian Baocheng and Ms. Zhang Cuiping and calls for their release in the absence of valid charges. Furthermore, the International Secretariat of OMCT urges the Chinese authorities to conform with China’s international human rights obligations, commitments that were reaffirmed on the occasion of its election as a member of the new United Nations Human Rights Council.
Reminder of the situation
According to the information received, Mr. Du Yangming, Ms. Wang Shuizhen, Mr. Tian Baocheng and Ms. Zhang Cuiping, four petitioners, were reportedly detained and charged in connection with their activities around the time of the meeting of the intergovernmental Shanghai Cooperation Organisation in June 2006. Furthermore, two Shanghai petitioners, Ms. Duan Chunfang and Mr. Duan Huimin, have been subjected to ill-treatment after being arrested in November 2006.

According to the information received, Mr. Du Yangming, 60 years old, was detained on 2 June 2006, after police came to his home and took him away for questioning. Mr. Du Yangming has been reportedly petitioning the authorities for years over the demolition of his former home. He has previously spent 18 months in Reeducation through Labor (RTL), and has been put under criminal detention three times, during which he reportedly suffered serious physical abuse.

According to the same information, Ms. Wang Shuizhen was detained on 5 June 2006 while on her way to accompany lawyer Zheng Enchong's wife, Jiang Meili, to Tilanqiao Prison to await Zheng's release upon completion of his three-year prison sentence on charges of revealing state secrets overseas. Ms. Wang Shuizhen was formally arrested in early July 2006. She previously served two years in prison for "causing a disturbance" when in April 2003 she refused to undergo ideological training as ordered by her local housing committee chairman.

It is also reported that Mr. Tian Baocheng and his wife Zhang Cuiping were detained on 2 June 2006, after which Mr. Tian Baocheng was formally charged with "causing a disturbance" on 8 July 2006, and his wife Zhang was sentenced to 18 months of RTL. Both Mr. Tian Baocheng and Ms. Zhang Cuiping had previously served terms of RTL in 2003, and during his detention, Mr. Tian Baocheng was reportedly subjected to serious physical abuse that resulted in the loss of two teeth and multiple injuries to his head, chest, arms and legs.

According to the same information, Mr. Du Yangming, Mr. Wang Shuizhen and Mr. Tian Baocheng were scheduled to appear in Shangai’s Zhabei District People court on 8 and 9 November 2006 on charges of “causing a disturbance”. Mr. Du Yangming, Ms. Wang Shuizhen and Mr. Tian Baocheng cannot afford a lawyer and are reportedly being defended by court-appointed counsel. However, family members reported that they have been unable to talk to or meet with the lawyers. Ms. Wang Shuizhen's husband reportedly requested a copy of the indictment against his wife from her lawyer after the court refused to provide it to him. The lawyer reportedly also refused to assist him, saying, "That's up to the government - don't bother me!"

Furthermore, two Shanghai petitioners, Ms. Duan Chunfang and Mr. Duan Huimin, have been subjected to ill-treatment after being arrested. Ms. Duan Chunfang and Mr. Duan Huimin, who are brother and sister, went to Beijing to petition the central authorities at the beginning of November 2006. Early on the morning of 3 November, a dozen plainclothes police officers reportedly burst into the guesthouse where they were staying and took them away. While in the police van, Ms. Duan Chunfang felt ill and asked to be allowed to sit near the window. Police officers reportedly responded by yanking her hair.

According to the information, when Mr. Duan Huimin saw what was happening to his sister, he tried to move near her, only to be pulled from the vehicle and beaten by more than 10 police officers. Mr. Duan Huimin was then handcuffed and forced into the rear of the vehicle. Ms. Duan Chunfang and Mr. Duan Huimin were kept separate on the train back to Shanghai, and Ms. Duan Chunfang was unable to find her brother upon arrival. According to the same information, Mr. Duan Huimin was seen on the train with obvious injuries, and he has reportedly been placed under criminal detention on accusations of assaulting a security officer with a weapon. Mr. Duan's parents spent all day and night outside of the detention center trying to see him, until police finally forced them to return home.

Action requested:

Please write to the authorities in the People’s Republic of China urging them to:

i. Guarantee, in all circumstances, the physical and psychological integrity of Mr. Du Yangming, Ms. Wang Shuizhen, Mr. Tian Baocheng and Ms. Zhang Cuiping;
ii. Order the immediate release of Mr. Du Yangming, Ms. Wang Shuizhen, Mr. Tian Baocheng and Ms. Zhang Cuiping in the absence of valid charges that are consistent with international law and standards, or, if such charges exist, bring them before an impartial and competent tribunal and guarantee their procedural rights at all times;
iii. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
