No.3903 ウズベキスタン:人権NGO関係者の息子であり大学生である男性が拘禁中に再び暴力を受けました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ウズベキスタンにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構はウズベキスタン人権協会(URSU)より、2006年8月はじめから拘禁されているイクティオル・カムロブさんが再び暴力を受けたという情報を入手しました。彼は同人権協会ディザク支部の支部長バクティオル・カムロブさんの息子であり、ディザク工科大学の2年生です。(背景情報)

入手した情報によると、第64/78刑務所に移動させられたばかりのイクティオル・カムロブさんが2006年12月26日、医者に話をさせてほしいと看守に頼みました。彼の判決には懲役が含まれており、刑務所内で働いていた時に体調不良を感じました。彼は看守に、自分の体調を刑務所長に伝えてほしいとも頼みました。看守は彼が休むのを許し、刑務所長に話すと約束しました。しかし翌日、彼は刑務所の作業所で職員にひどく殴打されました。彼は手錠をかけられ、腹部などを蹴られ、髪をつかまれ、引きずり倒されました。その後、1日隔離拘禁されました。体調が悪化したため、刑務所長は彼をザファラバード地方病院に運ぶよう命じました。しかし診察を受けられないまますぐに刑務所に戻されました。

そして2007年1月5日、彼は体調がますます悪化したのでディザク地方病院に運ばれ、救急手当てを受け、胃潰瘍と診断されました。しかし翌日、医者は刑務所長と話をした後、診断を変え、ただの「胃炎」だと言いました。その日のうちに彼は刑務所に戻されました。

監視機構はイクティオル・カムロブさんに対するこの新たな報復行為を憂慮し、彼の心身の安全を危惧します。イクティオル・カムロブさんの拘禁は、父であるバクティオル・カムロブさんの人権活動に対する制裁行為と見られるため、恣意的であると考えます。

<背景情報>

2006年7月23日、イクティオル・カムロブさんがパンを買うために家を出たところ、若者の一団が彼を侮辱する言葉を投げかけてきました。そして、この一団にひどく殴打されました。

8月2日、ディザク警察はイクティオル・カムロブさんを逮捕し、尋問しました。尋問は弁護士との接見が認められないまま8時間以上続き、彼はウズベク刑事法第277号(第20章:公序犯罪)のもと、「フーリガン行為(乱暴行為)」で訴追されました。

2006年9月24日、イクティオル・カムロブさんはディザク裁判所で禁固3年の判決を受けましたが、それは検察の求刑より重いものでした。彼は控訴をしましたが、判決は2006年9月29日にディザク地方裁判所、2006年11月22日の第3審で確認されました。

2006年12月10日にイクティオル・カムロブさんはチュムルガンにある第64/43番刑務所からザファラバードの第64/78刑務所に移されました。両方ともディザク地方にあります。

拘禁が始まってから、イクティオル・カムロブさんは懲戒警告を2回受けており、そのために2006年11月30日にウズベク国会が採択した恩赦の条件を満たせず、釈放されませんでした。

彼の父親のバクティオル・カムロブさんも数々の嫌がらせと脅迫を受けています。とくに2006年8月18日には、自宅で英国大使館の外交官2人と面会している時に女性の一団から暴行を受けました。彼はひどく負傷して病院に運び込まれました。

<行動要請>

ウズベク関係当局に以下の内容の要請をお願いします。

1.以下なる情況にあろうとも、イクティオル・カムロブさんおよびバクティオル・カムロブさんの心身の安全を保障すること。

2.恣意的に拘禁されているイクティオル・カムロブさんを即時無条件で釈放すること。

3.犯行を働いた者を特定し、裁判に付し、法律に基づき処罰を適用するため、これらの暴力行為に対して公正で中立の調査を実施すること。

4.この二人に対する、またウズベキスタンのすべての人権擁護活動家に対するすべての嫌がらせ行為に終止符を打つこと。そして、1998年12月9日国連総会が採択した国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

5.国際人権基準およびウズベキスタンが批准した国際文書に沿い、いかなる情況にあろうとも、人権尊重と基本的自由を保障すること。

Dear President Karimov,

I am writing you to express my concern about new acts of violence against Mr. Ikhtior Khamroev, the son of Mr. Bakhtior Khamroev, head of the Djizak section of HRSU. I would like to urge you the followings:

1. To guarantee in all circumstances the physical and psychological integrity of Messrs. Ikhtior Khamroev and Bakhtior Khamroev;

Put an end to all acts of harassment against them as well as all other human rights defenders in Uzbekistan and conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;

4. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Uzbekistan.

URGENT APPEAL ? THE OBSERVATORY

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), has received new information and requests your urgent intervention in the following situation in Uzbekistan.

New information:

The Observatory has received information from the Human Rights Society in Uzbekistan (HRSU) about new acts of violence against Mr. Ikhtior Khamroev, the son of Mr. Bakhtior Khamroev, head of the Djizak section of HRSU, and a second-year student at the Technological University of Djizak, who has been detained since the beginning of August 2006 (See background information).

According to the information received, on December 26, 2006, Mr. Ikhtior Khamroev asked the warden of the penal colony 64/78, where he was recently transferred, the permission to talk to the doctor. He was indeed feeling bad, as he was working as part of his sentence at the colony. He also asked him to inform the chief of the colony about his health problems. The attendant allowed him to rest and promised to talk to the chief of the colony. However, on the next day, Mr. Ikhtior Khamroev was violently beaten at his workplace by employees of the colony. He was kept in handcuffs, kicked by feet, including on his stomach, seized by the hair and dragged on the ground. Then, he was placed in incommunicado detention for one day. As his health got worse, the chief of the colony ordered his transfer to Zafarabad regional hospital. However, he did not undergo any medical examination and was brought back to the colony soon after.

Later on, on January 5, 2007, as his health got even worse, Mr. Ikhtior Khamroev was brought to Djizak regional hospital, where he received emergency care and was diagnosed with stomach ulcer. However, on the next day, the doctor changed his diagnosis after talking to the chief of the colony, and stated that Mr. Ikhtior Khamroev was “only” suffering from gastritis. On the same day, he was brought back to the colony.

The Observatory is deeply concerned about these new acts of reprisals against Mr. Ikhtior Khamroev and fears for his physical and psychological integrity. The Observatory also considers his detention, which appears to be aimed at sanctioning his father’s human rights activities, as arbitrary.

Background information:

On July 23, 2006, a group of young men insulted Mr. Ikhtior Khamroev, after he went out from the family’s flat to buy some bread. Mr. Khamroev was then severely beaten by the men.

On August 2, 2006 the police of Djizak arrested him and opened an inquiry against him. Interrogated during more than eight hours without having access to a lawyer, he was then charged with “hooliganism” under article 277 of the Uzbek Criminal Code (Chapter XX: Crimes against public order).

On September 24, 2006, Mr. Ikhtior Khamroev was sentenced to a three-year’ prison term by the court of Djizak, which was more than requested by prosecutor. This sentence was confirmed in appeal on September 29, 2006, by the regional court of Djizak, and on third instance, on November 22, 2006.

On December 10, 2006, Mr. Ikhtior Khamroev was transferred from colony n°64/43, in Tchumurgan, to colony n°64/78, in the district of Zafarabad, also in Djizak region.

Since the beginning of his detention, Mr. Ikhtior Khamroev has received two disciplinary warnings, which prevented him from being released under the terms of the amnesty that was voted by the Uzbek Parliament on November 30, 2006.

His father, Mr. Bakhtior Khamroev, has also been subjected to many acts of harassment and intimidation. In particular, on August 18, 2006, he was attacked at his home, by a group of women, as he was having a meeting with two diplomats from the British Embassy. Seriously wounded, he had to be conducted to the hospital.

Actions required:

Please write to the Uzbek authorities urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Messrs. Ikhtior Khamroev and Bakhtior Khamroev;

ii. Release M. Ikhtior Khamroev immediately and unconditionally since his detention is arbitrary;

iii. Conduct a fair and impartial inquiry into those acts of violence in order to identify their authors, bring them to justice and sanction them according to law;

iv.
