SOSトーチャー国際事務局は、キリギスタンにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

＜新情報＞

SOSトーチャー国際事務局は、SOSトーチャーネットワークの一員であるキリギス人権センター（KCHR）より、2006年1月14日にジャラル・アバド州でマゲイブ捜査官から激しく殴られたトゥルディエヴァさんの事件に関して、新しい情報を受けました。

情報によれば、マゲイブ捜査官がトゥルディエヴァさんを拷問したと申し立てられている事件の調査を拒否したジャラル・アバド州のアブディバキト・ハルムルザエフ検察官は、最近、キリギス共和国のオンブスマンであるツルスンバイ・バキルにより、“人権擁護家”として任命されました。ハルムルサエフさんは、“市民の人権と自由の擁護に貢献した”という名誉の賞を、キリギスタンにおいて検察官としては初めて受けた受賞者になります。

トゥルディエヴァさんの事件の調査開始をアブディバキト・ハルムルザエフさんが拒んだことを考えれば、彼に人権賞を授与することはオンブスマンの信用を傷つけることであり、もし検事総長が何ら措置を講じなければ、検察庁自体その信用を失うでしょう。

国際事務局は、トゥルディエヴァさんの事件の調査を怠ることは、キリギス共和国も締約国である国連拷問等禁止条約第13条の深刻な違反になると想起します。同13条は、「締約国は、自国の管轄の下にある領域内で拷問を受けたと主張する者が自国の権限のある当局に申立てを行い迅速かつ公平な検討を求める権利を有することを確保する。申立てを行った者及び証人をその申立て又は証拠の提供の結果生ずるあらゆる不当な取扱い又は脅迫から保護することを確保するための措置がとられるものとする」としています。

さらに国際事務局は、国連女性に対する暴力撤廃に関する宣言の第4条(c)項も想起します。それは、「女性に対する暴力行為を、かかる行為が国により行われたか又は個人によるものかを問わず、防止し調査しまた国内法に従って処罰するためしかるべき努力を払う」としています。

＜これまでの経緯＞

　情報によれば、トゥルディエヴァさんは2006年1月14日内務省に召喚され、フサンバイ・ママラジコフさん所有のゴールドの宝飾品窃盗の証人として証言を求められました。調査中、犯罪調査局の局員は2人の女性がゴールドを持っているのを発見し、盗品を押収し、容疑者を逃しました。そして、ママラジコフさんには捜査に間違いがあったと告げました。ママラジコフさんには調査局が押収した宝飾品は返却されていません。

　事件は次ぎに内務省のアリ・マゲイブさんに移管され、トゥルディエヴァさんは証人として彼に呼び出されました。報告によれば、彼女はそこで、マゲイブさんにこづかれて殴られ、罵声を浴びせられました。マゲイブさんは彼女に「証言を拒否しろ。証言などしたら、おまえを刑務所に入れてやる。おまえはそこで死ぬだけだ」と脅しました。トゥルディエヴァさんは出血しはじめ、おなかの中の子どもをほとんど失いかけました。

　この後、トゥルディエヴァさんは2006年1月23日まで産科病院に入院しました。トゥルディエヴァさんは事件を市検察官のハルムルザエフさんにすぐさま申し立てたにもかかわらず、事件は追跡されませんでした。NGOのスプラドリボスト(Spravedlivost)の支援で、オブラスト地方検察局に申し立てが行なわれましたが、その地方検察局の検察官に任命されたばかりのハルムルザエフさんは、再び事件の捜査を拒否し、本件において犯罪行為はなかったと主張しました。スプラドリボストの要請に続き、検事総長は地方検察局に事件を捜査するよう命じました。しかし、情報によれば、ちゃんとした捜査は行なわれないどころか、トゥルディエヴァさんは逆に嫌がらせを受けました。

　2005年8月、スザク地区住民のイブラヒモフさんがマゲイブさんから1万ソム巻きあげられたとして、マゲイブさんを相手に提訴しました。この事件はオブラスト検察局に移管されましたが、現在のところ、同検察局から何も反応はありません。人権団体のスプラドリボストは両方の事件を内務大臣マラ・スタリノフさんに直接訴えることにしました。それに続き、今度はマゲイブさんが、トゥルディエヴァさんとスプラドリボストの3人のメンバー、バレンチナ・グリセンコさん、アブヅマリク・シャリポフさん、マハマジャン・アブドゥハパロフさんを相手に、名誉毀損で2万5千米ドルの賠償を求めて訴えを起こしました。そして、2006年1月、トゥルディエヴァさんの事件に関する「妊娠中の女性を殴打」という記事を掲載したスプラドリボストの人権雑誌“すべての人びとの法律”が出た後、もう一つ別の提訴が行なわれました。

　最初の法廷審問は2006年6月20・21日に開かれましたが、その後は、トゥルディエヴァさんの体調不良により無期限で延長されています。受け取った情報によれば、2日間の公判で、マゲイブさんの支持者たちがトゥルディエヴァさんをののしり、手続き上の不正行為がいくつも記録されました。

　2006年1月の虐待の後、健康を著しく損ねたトゥルディエヴァさんは、2006年7月13日に男子を出産し、現在の彼女の健康状態は良好ということです。

＜行動要請＞

　キリギスタン関係当局に以下の内容の要請をお願いします。

1．ナルジザ・トゥルディエヴァさんの心身の安全を保障すること。

2．責任者をすべて特定し、裁判に付し、法律、とりわけキリギス刑法305-1条に沿って、刑事および行政罰を適用するため、トゥルディエヴァさんの虐待事件について、迅速、綿密、公正な調査を命じること。

3．法手続きに関して、トゥルディエヴァさんおよびNGOスプラドリボストのメンバーであるバレンチナ・グリセンコさん、アブヅマリク・シャリポフさん、そしてマハマジャン・アブドゥハパロフさんが、迅速で公正な裁判を受け、その間、彼女たちの手続き上の権利はすべて保障されるよう、保障すること。

4．国内全土において、国内法および国際人権基準、とりわけ拷問等禁止条約に沿って、人権尊重と基本的自由を保障すること。

VIOLENCE AGAINST WOMEN

Ill-treatment by a State agent/ Impunity/ Judicial proceedings

Geneva, 19 January 2007.

The International Secretariat of the World Organisation Against Torture (OMCT) has received new information and requests your URGENT intervention in the following situation in Kyrgyzstan.

New Information:

The International Secretariat of OMCT has received new information from the Kyrgyz Centre for Human Rights (KCHR), a member of the SOS-Torture Network, regarding the case of Ms. Nargiza Turdieva, severely beaten by an inspector of the Department of Internal Affairs, Mr. Ali Mageyev, while pregnant, on 14 January 2006, in Jalal-Abad.

According to the information received, the Jalal-Abad Oblast prosecutor, Mr. Abdibakyt Halmurzaev, who has refused to investigate into the Ms. Turdieva’s allegation of torture by Mr. Mageyev, was recently nominated as “human rights defender” by the Ombudsman of the Kyrgyz Republic, Mr. Tursunbai Bakir uulu. Mr. Halmurzaev is the first public prosecutor in Kyrgyzstan to receive a certificate of honour “for his contribution to the protection of human rights and freedoms of citizens”.

Taking into account Mr. Halmurzaev’s refusal to open a criminal investigation into Ms. Turdieva’s case, the act of granting him a human rights award discredits the figure of the Ombudsman and if no measure is taken by the General Prosecutor, his office will also lose its credibility.

OMCT recalls that the failure to investigate into Ms. Turdieva’s case is a serious violation of article 13 of the UN Convention against Torture, according to which the Kyrgyz Republic shall as a State Party “ensure that any individual who alleges he has been subjected to torture in any territory under its jurisdiction has the right to complain to, and to have his case promptly and impartially examined by, its competent authorities.”

OMCT further recalls that the UN Declaration on the Elimination of Violence against Women states in its article 4(c) that States should "exercise due diligence to prevent, investigate and, in accordance with national legislation, punish acts of violence against women, whether those acts are perpetrated by the State or by private persons."

Brief reminder of the situation:

According to the information received, Ms. Turdieva was summoned by the Department of Internal Affairs on 14 January 2006, to testify as a witness in a case of theft of golden jewellery that belonged to Mr. Husanbai Mamarazykov. During the investigation staff members of the Criminal Investigation Department found the jewellery in the possession of two women, seized the items, let the suspects go and then told Mr. Mamarazykov there had been a mistake. Mr. Mamarazykov never received back the golden items seized by the department.

The case was then transferred to Mr. Ali Mageyev from the Department of Internal Affairs, who summoned Ms. Turdieva as a witness. There she was reportedly pushed, hit and insulted by Mr. Mageyev who requested that she denies her testimony, threatening with doing “everything possible to put [her] in prison and let [her] die there”. Ms. Turdieva then started bleeding and almost lost her baby. After these events, Ms. Turdieva stayed at the Suzak maternity hospital until 23 January 2006.

Although Ms. Turdieva immediately filed a complaint before the City Prosecutor, Mr. Halmurzaev, it was not pursued. With the assistance of the NGO Spradedlivost another attempt was made before the Oblast Prosecutor’s office, i.e. the Regional office Prosecutor, but Mr. Halmurzaev, who became Oblast Prosecutor at that time, refused again to investigate into the event, arguing no crime had been committed in this case. Following requests from Spradedlivost, the General Prosecutor charged the Regional Prosecutor’s office to investigate the case. However, according to the same information, no thorough investigation was undertaken and Ms. Turdieva was even further harassed.

In August 2005, a complaint had been filed against Mr. Mageyev by Mr. Ibragimov, resident of Suzak district, who stated that Mr. Mageyev had extorted 10,000 soms from him. The case was transferred to the Oblast Prosecutor’s office. However, up until now no reply has been received from the institution. The human rights organisation Spravedlivost decided to address both cases directly to the Minister of the Interior, Mr. Marat Sutalinov. Subsequently, Mr. Mageyev filed a lawsuit against Ms. Turdieva and three members of the NGO Spravedlivost Ms. Valentina Gritsenko, Mr. Abdumalik Sharipov and Mr. Mahamatjan Abdujaparov requesting an amount of 25,000 US dollars on the basis of alleged defamation. Another lawsuit was filed following the publication in January 2006 by Spradedlivost of the article Women, Even Pregnant Ones, Being Beaten, in its Human Rights Bulletin Law of All People, relating the case of Ms. Nargiza Turdieva.

The court hearing initially took place on 20 and 21 June 2006 but was postponed sine die due to the bad physical condition of Ms. Nargiza Turdieva at that time. According to the information received, during the two-day audience Ms. Turdieva was insulted by Mr. Mageyev’s supporters and several procedural irregularities were registered.

Ms. Turdieva, whose health condition deteriorated after being ill-treated in January 2006, eventually gave birth to a boy on 13 July 2006 and her physical condition is considered as satisfactory now.

Action Requested:

Please continue to write to the authorities in Kyrgyzstan urging them to:

i. Ensure Ms. Nargiza Turdieva’s physical and psychological integrity;

ii. Order a prompt, thorough and impartial investigation into the ill-treatment of Ms. Nargiza Turdieva in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law, especially article 305-1 of the Kyrgyz Criminal Code;

iii. In respect to the judicial proceeding, ensure that Ms. Turdieva, as well as the members of the NGO Spravedilivost Ms. Gritsenko, Mr. Sharipov and Mr. Abdujaparov are given a prompt and fair trial, in which their procedural rights are guaranteed at all times;

iv. Guarantee the respect for human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards, particularly the UN Convention against Torture.
